GOVERNMENT REGULATION
of 4 June 2007
on the definition of the Bird Region of Høman - Odra - Poolší
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' zone is defined as the Høman state - Odra - Poolší (hereinafter referred to as the bird region).
(2) The birds' area is protected by the populations of the leprechaun (Ixobroubus minutus), the iceberg (Alcedo atthis) and the blue nightingale (Luscinia svecica) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area
(1) The bird region is situated in the territory of the Moravian-Silesian Region in the cadastral territories of Dětamerovice, Lower Lutyna, Hermanice, Upper Lutyna, Hrušov, Kopytov, Koukolná, Nové Bohumín, Petrovice u Karviné, Poruba u Orlová, Pudlov, Speedvald, Skryň, Old Town u Karviné, Old Bohumin, Šilheřovice, Věřenovice, Vrice nad Odrá, Zábáží u Bohumin and Záda nad Olší.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (1) may the birds' area, outside the concurrently built-up territory of the municipalities and the stalled areas of the municipalities (2),
(a) remove lithoral crops;
(b) enter the lithoral crops of ponds between 1 April and 31 July; This does not concern the owners and tenants of the land where these crops are located,
(c) carry out activities causing a change in the level of established surface and groundwater levels which could cause a change in the biotope of the species for which the bird area is established;
(d) to change the type of land and the way it is used (3);
(e) the establishment of non-commercial poultry farming;
(f) to release artificially reared ducks;
(g) to carry out activities carried out by watercourses managers in the course of interventions into banks and coastal areas;
(h) actively change the water level on the Záblatský, Forestry, Sirotek, Safar and Málčina ponds from 15 April to 31 July by more than 20 cm in a period of time of less than 14 days.
(2) Prior consent of the competent nature conservation authority is not required for activities
(a) as referred to in paragraph 1 (c), if the procedure is in accordance with the approved water control rules (4),
(b) in accordance with paragraph 1, in the case of activities carried out under specific legislation5) in the territory of the specified conquest area and exclusive bearings;
(c) necessary to ensure the operational competence of the road (6);
(d) in accordance with paragraph 1 (a) and (b), in the railway protection zone under special legislation (7);
(e) in accordance with paragraph 1 (d), where such activities are subject to a decision pursuant to special legislation (8) and have been given an opinion by the competent nature conservation authority;
(f) in accordance with paragraph 1 (a) and (g), where such activities have been notified at least 20 days in advance to the competent nature conservation authority;
(g) as referred to in paragraph 1 (g), in the event of an emergency in which damage to property is imminent or of immediate danger to the safety and health of persons.
Efficacy
This Regulation shall enter into force on 1 June 2008.

Territorial demarcation and description of the border Birds' regions of Høman - Odra - Poolší
From border stone no. III / 353 near the point where the flow of Petrevka is distant from the state border, it leads southwest to local communication and after about 180 m it reaches the district road Petrovice near Karviné - Glasses. From there along this road *) leads west of the village Dolany up to about 3.3 km it reaches the village Závada. In front of the school in the centre of the village it turns south on the road to the Olše River, crosses the railway line and continues along the road along the Olše River to the intersection with road No I / 67. At this intersection it turns east and takes this road in the southeast direction 570 m to the system of Karvinsky ponds. At booth 214,95 it changes direction to north and crosses the railway line 130 m. He follows the road north along the Vetrov pond. The border is formed on the way to the pond dam and runs under the discharge towards the bypass canal, which follows the east towards the 221m booth. From there, the border of the bird area leads south on the road about 550 m to the edge of the forest and along the road at the eastern edge of the forest to the construction at the Sirotek pond and further along the road on the east bank of Sirotku to the Olšina settlement. Along the eastern and then southeast banks of Panic pond and then Ženich to the railway track, from there 120 m along the southeast to the road bridge at cubicle 229 m, where the border bends southwest by road. After 230 m crossing the road Karvinský creek - here the border along the Karvinsky creek is turning northwest. Connecting to road No I / 67 passes to it and turns north. It runs along its edge along the ponds of Widovec, Olšová, Dubová and Lipová. From cubicle 215.75, Karvinsky stream copies to confluence with Olší. It goes to the left bank of Olš and copies the channel parallel to the main trough, goes north to the railway line.
The border continues on the right side of the railway embankment about 1300 m northwest, after joining the next railway line on the right, behind the bridge over the water tower Mlýnka ducts northeast and along the left bank of this watercourse continues along the Dětřetřovice power plant and further along the left bank Mlýnka. In the confluence of Mlýnka with Olší, it deflects northwest and runs along the field path to the west, along the draw, intersects the local waterproof. It turns southwest and runs 490 meters between the fields to cubicle 207. At this point it turns northwest and continues along the alley to booth 206.5. From this point it runs further 440 m northwest by field along the field to booth 205. At this point it breaks to the southwest and leads along the field road to the agricultural facility Bezdinek. It continues in the northwest direction along the north-eastern part of the agricultural area by direct route between the fields to the point where the road crosses the border of the parcel No 971 / 2, k.Ú. Věřenňovice. From there it follows the border of the parcel No 972 / 7, 966 / 2, 966 / 4, 184, 183, 182, 179, 177, 172, 168, 164, 159, 155, 1033 / 7, 1035 / 4, 1033 / 18, 646 / 23, 646 / 30, 646 / 32, 646 / 31, 85, 70 / 2, 89, 97, 99, 630 / 2, 630 / 1, 631 / 2, 632 / 2, 635 / 2, 636 / 2, 639, 640 / 2, 641 / 2, 642, 628, 663, 645, 668, 667 / 2, 608, 603, 602, 596 / 1, 710 / 22, 589, 706 / 2, 587, 669 / 8, 584 / 2 leží v. From the west edge of the village it is heading northwest along the road between the field and the river Lutyňka, which intersects, and along its left bank it is heading north to the local part of Chervin. Here it turns to the northwest and continues along the left bank of Lutynka to the edge of the forest it goes west and then continues to the local part of Kopytov. Here it is connected to the local communication * * *) and leads along it further west about 510 m to the intersection where it breaks in the southwest direction and continues after the same communication about 1070 m to Bohumian reef, intersects it and continues along the road to the north edge of the gravel shop Kalishčák. Furthermore, the borders are copied by the eastern and southern edges of the gravel mill.
From its southwest tip, it goes on the way to bridge the flow of Bajcůvka. Behind the bridge, it runs 90 m downstream of the Bajcůvka stream to the water tank Little Kalishčák. There it changes the direction west and leads along the edge of the woody tree along the south bank of the tank to the road on the edge of the coastal waters of the river Odra. At this point it breaks in the southwest direction and runs upstream to the Odra stream about 470 meters along this road to the border bridge in Old Bohumín. It continues upstream along the flood barrier forming a terrain wave of about 530m to the railway bridge leading to Poland. At the foot of the bridge, the border breaks southeast and runs along the international route to the crossing point with road No I / 58. It continues south on the road about 430m to the point of crossing with the flow of Bajčuvka and with the electrode. The road continues southwest through the village Vrbice to the stadium on its southwest end. Here it turns between the building and local communication on the southeast towards the railway line Ostrava - Bohumín. On the right side of the embankment of the track goes northeast about 1900m to the embankment of the railway line Orlová - Bohumín. Here it turns sharply to the south, following the western embankment of the track and the industrial area up to the new state pond.
Here he continues along Bohumín Stružky to the northeast and further turns east along the teat to the road to Bohumín. The road is also a green tourist brand, and the border follows it north to the swimming pool in Bohumín. Around the area of the swimming pool and returns to Bohumín Stružka and goes downstream along the left bank to bridge road No II / 471. From the bridge it returns first on the right bank of Bohumín Stružky, then along the road on this bank to the south to the Záblat pond and runs along its edge to cubicle 202. From this point on, it continues along the southwest road to Březin forest. Further along the path through this field to the water works of the mine of Hermanice. In cubicle 228 it turns southeast and leads on the way to the New Court agricultural building. From there it leads to the north-east first after the local communication, after 190m it breaks again southeast and runs 480m to the intersection where it turns southwest and heads towards the Little Bricklayer pond. He goes further east on Orlovská Street to cross with Rychwald Lutyňka. Then along the flow of Rychwald Lutynka to the Natural Reserve Skukák and further upstream to the stream to the marsh over the Statková Pond, which goes around the north side on the outer border of the cottage settlement after local communication. On the north side, it passes the marsh over the Statko ponds along the field road, then continues on the northeast road to cubicle 236. It turns east, crosses a nameless water-phone and ducts south after about 85 m. It goes 100 meters south, then 60 meters east, and 107 meters south again. Then it goes about 260 m west, crossing the nameless water tower, and along the next watercourse it reaches the path leading from the marsh. About 50 metres east of the place where the nameless flow flows into the marsh, it bends the border south to the field road, along which it leads in the south, it crosses the tiny nameless flow and the southwestern direction passes the nameless pond to the intersection of local roads. It also leads south after communication to another intersection with booth 251. Here it breaks southeast and after local communication leads about 500 m. At the intersection of local roads, it breaks in the southwest direction and leads about 800 m after the local communication, which continues to cross into the field path to the water-flowing pond Kout. This is where the border turns southeast and the Kout pond goes around the field road to cubicle 236. From this point it leads east and after about 200 m reaches the nameless watercourse powering the Kout pond. From there it heads east along this watercourse to the garages in Orlová, the local part of Poruba. On the western edge of the built-in garage area along the field road, they head south to the flow of the Rychwald Sour.
It follows the flow of Fastwald Stružka up to the system of Underchurch ponds to the cubicle 214 m near the southwest tip. Here it breaks south and walks the street Mikhalkovicka 170 m, then the street Myslivecká to the west about 200m, then again to the south along the street between the meadows and the scattered pavement to the ponds Extractor to the Upper Gorřalčok. Here it turns to the north and goes along the road to the north along the entire pond system all the way to the Stružek. It also goes again on the left bank of Rydvald Stružky, which passes in the cadastral territory of Vrbice nad Odrou in Vrbický Stružka. It leads to the railway bridge. From this point he runs along the railway line to the bridge through the tributary of the Hømanický pond. Behind the bridge, it breaks in the north direction, and after 300 m it turns northwest and goes along the pond to its southwest tip. It continues northwest after unpaved communication to road I / 58. On this road goes approx. 950 m to Ostrava, then ducts northwest in the crossing point of the road with the electrode and under the electrode crosses the river Oder.
From the southwest the forest passes west of the southernmost flooded gravel pit and continues in the same direction until the crossing of local roads. Here it breaks in the northeast direction and follows the communication between Koblov and Antošovice to the crossing of this road with the nameless watercourse near the Mížikovec gravel house and then copies this water tower to the Oder. From this point, it leads the left bank of the Odra River to the state border. From there, the border of the bird region follows the state border, which leads first through the Odra stream, after the confluence with Olší then against the stream of this river. At Věřňovice, the national borders form a smaller outpost and when it returns to the Olše flow, it reaches a confluence with Petrůvka. Further along the flow of Petrovka to border stone No III / 356.
Explanatory notes:
