THE LAW
of 18 March 2004
amending Act No. 301 / 2000 Coll., on Matrices, Names and Surnames and on the Amendment of Certain Related Acts, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 301 / 2000 Coll., on Matrices, Name and Surname and on the Amendment of Certain Related Acts, as amended by Act No. 320 / 2002 Coll. and Act No. 578 / 2002 Coll., is amended as follows:
1. In Article 2, at the end of the text of paragraph 2, the words "if there are no changes in the geographical breakdown of the State at a different date 'shall be added.
2. Paragraph 4 (1) reads as follows:
"(1) The Office with extended scope shall carry out an inspection of the management of the matrix books and the collections of documents, at least once a year for all the matrix offices in its territorial district. ';
3. Paragraph 9 (1), including footnote (1a), reads:
"(1) The Matrikár can be a citizen who is an employee of the municipality, in the capital city of Prague an employee of the city, who has the competence of the Matrikání office, who has proved his expertise by examination at the extended office or regional office, or by examination of special competence on the section of the matrix and citizenship under a special law. (1a)
(1a) Article 21 of Act No. 312 / 2002 Coll., on officials of local and local authorities and amending certain laws. "
4. In Article 33 (2), the words "the information system" and the words "the population register" shall be inserted after the words "the information system of the citizens' cards,"
5. In Paragraph 43 (1), the words "if the foreign matrix document for a serious obstacle cannot be presented at the end of the text of point (a), registration may also be carried out on the basis of other authentic instruments'.
6. Paragraph 43 (6), including footnote 17, is deleted.
7. In Paragraph 45, the last sentence is deleted.
8. Paragraph 57 (2), including footnote 19a, reads as follows:
"(2) The documents referred to in paragraph 1 shall bear the necessary verifications. 19a) The Matrix Office may waive the necessary verification of documents if their action is associated with a difficult obstacle.

„§ 69
(1) The surname of women is made up in accordance with the rules of the Czech speaker.
(2) When entering a marriage, a surname which will be used after the marriage may be entered in the journal, at the request of the woman to whom it relates, in the form of a man, if:
(a) a stranger,
(b) a citizen who is, or will be, resident abroad;
(c) a citizen whose husband is a foreigner,
(d) a citizen other than Czech nationality.
(3) At the time of the birth of the child, the surname of the female child in male shape may be indicated at the request of the parents if the child is:
(a) by a stranger,
(b) a citizen who has, or will be, a resident abroad;
(c) a citizen whose parents are foreigners,
(d) a citizen who is different from the Czech nationality.
If one parent is not known, or is deprived of parental responsibility by a final decision of the court, or suspended from exercising parental responsibility, or the parent is deprived of legal capacity by a final decision of the court, or is restricted to legal capacity, the male form of the surname of the female child shall be recorded as declared by the other parent.
(4) Upon registration of the death of a foreign woman, the surname of the woman to whom the registration relates shall be indicated in the matrix book in a male form, where the use of that person is demonstrated by a matrix document or other public instrument, as the case may be. ';
10. In Paragraph 70, the following sentence shall be added at the end of paragraph 2: "If a citizen has declared, in the course of his marriage, that he will use the previous surname together with the common surname and, in second place, the surname may not be waived by declaration of the use of the common surname if the marriage continues. '
11. in Article 72 (6), the word "permanent" shall be inserted after the word "authorised."
12. The reference to footnote 22 is added at the end of § 84.
Footnote 22) reads as follows:
"22) Act No. 328 / 1999 Coll., on Civil ID, as amended. Act No. 133 / 2000 Coll., on the registration of residents and birth numbers and on the amendment of certain laws (Act on the registration of residents), as amended. '
13. In Paragraph 84, the present text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) For the performance of the state administration on the matrix section, the Ministry and the matrix authorities use the following data from the population registration information system:
(a) the name and, where appropriate, the names, date and place of all their amendments;
(b) surname, maiden name, date and place of all their changes;
(c) the birth number, the date and the reason for the change;
(d) date and place of birth;
(e) the address of the place of stay;
(f) citizenship;
(g) personal status, date and place of change;
(h) removal or limitation of legal capacity;
(i) the date and place of death and, where appropriate, the declaration of death of the natural person;
(j) the date and place of adoption.
(3) For the performance of the state administration on the matrix section, the Ministry and the matrix authorities use the following data from the civil card registration information system:
(a) the name and, where appropriate, the name, surname and family number of the citizen;
(b) the number or series of identity cards, where appropriate;
(c) the date and place of issue of the identity card;
(d) the validity of the identity card;
(e) the number or series of lost and stolen identity cards, as appropriate. ';
14. Paragraph 87 (1) is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
15. in § 87 (1), the words "§ 57 (2), §" shall be inserted after the words "56."
16. in § 89, "2004" is replaced by "2006."
17. Article 93 shall be deleted;
18. in Paragraph 96 (b), the words "prebound" shall be inserted after the word "lead."
19. in Paragraph 100, "2004" is replaced by "2006."
Čl. II
Transitional provision
Matrix events, matrix facts, changes and repairs may be conducted simultaneously by computer technology from the date of publication of this Act until 31 December 2005. The collection of documents referred to in Article 8 (1) shall in such a case also consist of a copy of the computer record.
Čl. III
This Act shall take effect on the day of its publication.
