GOVERNMENT REGULATION
of 25 June 1997
on the payment of a single refund to mitigate certain injustices caused by the Communist regime
The Government orders pursuant to § 8 of Act No. 198 / 1993 Coll., on the illegality and resistance of the Communist regime:
(1) Persons who have performed the sentence of imprisonment, part of it or a link to the offence for which they have been rehabilitated under Act No. 82 / 1968 Coll., on judicial rehabilitation, pursuant to Act No. 119 / 1990 Coll., on judicial rehabilitation, as amended by Act No. 47 / 1991 Coll. and Act No. 633 / 1992 Coll., or whose conviction for the offence referred to in § 2 of Act No. 119 / 1990 Coll., as amended by Act No. 47 / 1991 Coll., was repealed by the decision on the renewal of proceedings, a complaint for infringement of the Act No. 198 / 1993 Coll., on the illegality of the Communist regime and opposition against it, and by persons included in a forced labour camp which was annulled pursuant to § 17 (1) of Act No. 87 / 1991 Coll.
(2) A one-off refund is set at CZK 625 for each month of detention, imprisonment, time spent in a forced labour camp or in a centralized monastery with a regime similar to forced labour camps.
(1) A one-off refund will be awarded by decision of the local authority responsible for the municipal authority (2), issued on a written request, to which the rehabilitation persons shall attach evidence of their entitlement.
(2) A one-off refund is payable within 15 days of the legal authority of the decision.
The right to apply for a lump sum does not pass on to the heirs of the rehabilitation.
This Regulation shall not apply to rehabilitation persons who have carried out a custodial sentence, part of it or a bond of less than 12 months, or have been assigned to a forced labour camp or a centralised monastery with a regime similar to forced labour camps for less than 12 months.
This Regulation shall enter into force on 1 January 1998.
