Decree of the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic on feed management and the registration of certain types of feed and their producers

Ministry of Agriculture and Nutrition of the Slovak Socialist Republic
of 17 October 1975
on feed management and the registration of certain types of feed and their producers
The Ministry of Agriculture and Nutrition of the Slovak Socialist Republic provides in agreement with the participating central authorities of the state administration pursuant to § 39 of Act No. 61 / 1964 Coll., on the development of plant production:
§ 1
Preliminary provisions
(1) The provision of and use of the planned management of resources and the production of feed requires a consistent management of feed. In order to ensure this objective and to improve quality control of certain types of feed, the intended feed and its manufacturers shall be registered.
(2) According to this Decree, feed is all organic and inorganic substances intended for animal feed. Feedingstuffs are also compound feed and feed supplements.

§ 2
Central feed and feed management fund of this fund
(1) The central feed fund shall consist of feed designated by the Federal Ministry of Agriculture and Nutrition within the balance sheet of the central feed fund (1).
(2) The Central Feed Fund is managed by the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic (hereinafter referred to as "the Ministry") in accordance with the principles laid down by the Federal Ministry of Agriculture and Nutrition.
(3) Organisations buying and storing feed, domestic production or imported for a central feed fund, as well as organisations producing compound feed and feed supplements for a central feed fund, and organisations in which feed is present as by-products or waste, are treated in accordance with a specific Ministry Regulation.
§ 3
Maximum recipes for compound feed and feed supplements
(1) For the production of compound feed and compound feed, the Ministry shall determine the limit recipes setting out the basic indicators of the content and representation of the main components (nutrient carriers) for each species and category of animal as well as the raw materials that may be used for the production of compound feed and feed supplements.
(2) Proposals and proposals to amend the limit recipes for compound feedingstuffs and compound feedingstuffs are submitted by their manufacturers to the Ministry. submit at the same time a proposal for physical and chemical characteristics of the quality and conditions determining their health. Proposals for limit recipes for compound feedingstuffs and compound feedingstuffs and their amendments shall be approved by the Ministry.

Registration of feed and their producers
§ 4
Registration, production and putting into circulation of feed
(1) The register of intended feedingstuffs and its producers (hereinafter referred to as "the register") is kept by the Ministry. The entries in the register shall be published in the publishing body of the Ministry.
(2) Not to be entered in the register
(a) raw materials intended by the Ministry for the manufacture of compound feed and feed supplements;
(b) compound feed and compound feed produced for biological testing of research tasks under approved methodologies;
(c) compound feed produced by an organisation in its own establishment for its own use or, where appropriate, by a joint agricultural holding for its own use or for that of a member organisation;
(d) manure and bulk feed (e.g. grains, hay, straw, silage, Senate) and potatoes;
(e) wet industrial feed (beet pulp, molasses, potato crushers, etc.).
(3) Only manufacturers registered may manufacture feed subject to registration and put them into circulation.
(4) Feed mixtures and feed supplements corresponding to limit receptors are entered in the register after the reporting procedure has been carried out. Feed, compound feed or feed supplements which do not comply with that condition shall be entered in the register only after the approval procedure has been carried out.
§ 5
Notification procedure
(1) An application for the entry of a compound feed or feed supplement in the register following the reporting procedure is submitted by the organisation to the Ministry through the Central Control and Examination Institute of the Agricultural Institute in Bratislava (hereinafter referred to as the Control Institute) on the prescribed forms in three copies; it shall also submit the required number of samples with the control institute. The inspection institute shall immediately send one copy of the application to the Ministry and one to its State Veterinary Administration.
(2) The application for registration of a compound feed or feed supplement in the register shall include:
(a) the name of the compound feed or feed supplement or, where appropriate, an abbreviation in accordance with the provisions of technical standards;
(b) the trade name (if used) or, where appropriate, the word and image expression of the trade mark;
(c) the content of the main nutrients (for feed supplements, biological efficacy),
(d) representation of individual components in material minima and maxima;
(e) physical and chemical characteristics of quality within the scope specified by CSN 46 7006,
(f) information on the content and biological efficacy of the added biofactors and, where appropriate, other added substances;
(g) a brief description of the production technology;
(h) feeding instructions (for feed supplements, instructions for its use),
(ch) a technical description of the packaging (if only standardised packaging is used, it is sufficient to specify the technical standard; for compound feed and feed supplement supplied without packaging, the mode of transport must be indicated),
(i) a model label (label, tag) or any other means of marking the product in accordance with the provisions of the technical standard;
(j) the list of production sites proposed for the production of compound feed and feed supplements.
(3) The application shall also be supported by a complete analysis of the nutritional value (Weenden analysis) and analytically verified values of quality indicators according to the technical quality standard; a complete analysis of the nutritional value is not submitted for the feed supplement.
(4) If the compound feed or feed supplement contains a new ingredient, the manufacturer shall submit at the same time a draft analytical methodology to verify their content and, where appropriate, biological efficacy.
(5) Where justified, the Ministry may, at the request of the organisation, refrain from requesting certain elements referred to in paragraphs 2 to 4.
(6) The application shall be examined by the Ministry's inspection institute and state veterinary administration; where necessary, such organisations may request additional data, samples of raw materials or finished products from the manufacturer. The manufacturer shall comply with these requirements.
§ 6
Approval procedure
(1) The application for entry of feed in the register on the basis of the approval procedure shall be submitted in the manner referred to in Article 5 (1) and shall contain the information referred to in Article 5 (2) to (4); where justified, the Ministry may, at the request of the organisation, refrain from requesting some of those particulars.
(2) The application for entry of feed in the register shall be examined by:
(a) a control institute based on its own analysis and biological testing;
(b) State Veterinary Administration of the Ministry from the point of view of veterinary care in accordance with the expression of the Slovak Socialist Republic's chief hygienist.
(3) For biological testing, the manufacturer is obliged to deliver the required amount of feed and, where appropriate, the necessary components to the inspection institute and the State Veterinary Administration of the Ministry.
(4) If the manufacturer submits with the application sufficient documentation on the biological tests according to the methodology laid down, the Ministry's inspection and veterinary administration may waive further biological tests and recommend to the Ministry the registration.
(5) If the nature of the validated feed so requires, the Ministry's inspection and veterinary administration may request special expertise.
§ 7
Registration
(1) The Control Institute and the State Veterinary Administration of the Ministry of Sciences have given the result of the examination in the context of the notification or approval procedure with their opinion to the Ministry. The costs of the notification or approval procedure shall be borne by the applicant; The Ministry may, where justified at the request of the applicant, waive payment of these costs.
(2) The Ministry shall decide on the entry of feed in the register; the decision shall be notified to the manufacturer.
(3) The registration number shall indicate:
(a) trade description of the feed (exact name, abbreviation and number of the single product classification),
(b) feeding instructions (for feed supplements, instructions for its use),
(c) the name and address of the manufacturer (by manufacturer),
(d) the raw material composition of the feed or compound feed in weight percentage, in the case of feed supplement in weight units and international units of effectiveness;
(e) quality indicators - technical quality standard;
(f) a brief technological process for production;
(g) the date of submission of the application;
(h) the number and date of the decision;
(ch) the date of registration.
(4) The entry in the register may be cancelled by the Ministry if the conditions laid down for the production of feedingstuffs are not complied with, or if further production of certain feedingstuffs is not desirable; immediately inform the manufacturer in writing.
§ 8
Quality control of registered feedingstuffs
(1) The inspection centre regularly checks the quality of the feed produced.
(2) If the inspection centre finds that the feed produced does not comply with mandatory quality indicators, it shall designate it as a reduced quality feed; (2) it shall at the same time determine when the product will be re-inspected. The costs associated with this check shall be borne by the manufacturer.
(3) If the manufacturer requests a new inspection by the inspection institute, the control institute shall take samples of feed and communicate the result of the check to the manufacturer; the costs of this inspection shall be borne by the manufacturer.
(4) The designation for a reduced-quality feed shall be valid until it is established by inspection that the feed complies with the specified characteristics.
(5) The health of feed is checked by the State Veterinary Administration of the Ministry in accordance with specific regulation.3)

Common and final provisions
§ 9
The Ministry shall establish, for the purposes of assessing the proposals for limit recipes for compound feed and feed supplements and the opinions of the bodies referred to in Section 7 (1) of the Panel of Experts.
§ 10
(1) Organisations authorised under existing rules to produce feed and put them into circulation before 31 December 1975 may only do so until that date.
(2) Organisations authorised under existing rules to produce feed and put them into circulation without a time limit may still produce and put them into circulation after 31 December 1975 if they submit an application for registration by 31 March 1976 at the latest.
(3) The organisation's authorisation referred to in paragraph 2 shall end with the notification of the processing of the application.
§ 11
The Decree of the Ministry of Agriculture No 199 / 1959 on feed management is hereby repealed.

This Decree shall take effect on 1 January 1976.
