amending and supplementing the law on certain service conditions for soldiers
The Bureau of the National Assembly of the Czechoslovak Socialist Republic has decided pursuant to Article 60 (2) of the Constitution on the following legal measure:
Act No. 76 / 1959 Coll., on certain service conditions of soldiers, is amended as follows:
1.
"Professional soldiers transferred to the advance before entitlement to an old-age pension is established shall be entitled to a placement appropriate to their morally political qualities and professional competence. The details shall be determined by the government. '
2. The following text is added to the place of current Part VIII which is deleted:
Service allowance
(1) Professional soldiers who are to be transferred to an advance payment after the age of 48 are entitled to a service allowance of 350 to 650 CZK per month if they do not fulfil the conditions for entitlement to an old-age pension or if they do not receive another pension. The amount of this contribution shall be determined by the Minister for National Defence and the Minister for Home Affairs, acting on a proposal from the commissions set up by them; taking into account the current course of service, function, merit, social circumstances, health status, qualifications acquired and the age of a soldier.
(2) The contribution does not belong to professional soldiers transferred to the advance at their request or for moral policy reasons; does not also apply to the withdrawal or loss of military rank.
(3) The Minister for National Defence and the Minister for the Interior may grant a contribution at the lowest level even in the cases referred to in the preceding paragraph, provided that there are grounds for special consideration.
(4) When the allowance is combined with the earnings, the allowance shall be reduced by an amount by which the sum of the allowance and gross earnings exceeds the amount of the last gross service income.
(5) The Minister for National Defence and the Minister for the Interior provide details; may also remove hardness which would occur in the implementation of the provisions of this Part. ';
3. In Paragraph 26 (2), the words "retirement pension 'are replaced by the words" old-age pension'.
This legal measure shall take effect on 1 October 1964.
