of 18 March 2020
amending Act No. 29 / 2000 Coll., on postal services and amending certain laws (Postal Services Act), as amended, and Act No. 634 / 1992 Coll., on Consumer Protection, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Postal Services Act
Act No. 29 / 2000 Coll., on Postal Services and on the amendment of certain laws (Act on Postal Services), as amended by Act No. 517 / 2002 Coll., Act No. 225 / 2003 Coll., Act No. 501 / 2004 Coll., Act No. 95 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 444 / 2005 Coll., Act No. 264 / 2006 Coll., Act No. 110 / 2007 Coll., Act No. 250 / 2016 Coll., Act No. 41 / 2009 Coll., Act No. 221 / 2009 Coll., Act No. 212 / 2013 Coll., Act No. 258 / 2014 Coll., Act No. 329 / 2011 Coll., Act No. 89 / 2012 Coll.
1. At the end of the title of Part One, the words "AND SERVICE OF PASSENGERS 'are added.
2. Paragraph 1 (2), including footnote 27, reads as follows:
"(2) This law further regulates, following the directly applicable regulation of the European Union27) the procedure of the provider of parcel delivery services and the scope and powers of the Czech Telecommunications Office (hereinafter the Office) in the field of cross-border parcel delivery services.
27) Regulation (EU) 2018 / 644 of the European Parliament and of the Council of 18 April 2018 on cross-border parcel delivery services. '.
3. Paragraph 1 (3) is deleted.
4. in Article 2, the following point (a) is inserted:
"(a) a postal service activity which, as a general rule, includes the submission, sorting and transport of a postal consignment through the postal network and is carried out for the purpose of delivering a postal consignment to the consignee; the delivery of the amount of money required shall be considered as a postal service; ';
Points (a) to (o) shall be renumbered (b) to (p).
5. In Article 2, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The postal service under this law is not
(a) the transport of mail, provided that it is carried out by a person who has not carried out at the same time submissions, sorting or delivery of such consignments;
(b) a service similar to a postal service carried out by a consignor or a connected person. ';
6. in Article 3 (2) (a), the words "the Czech Telecommunications Office (hereinafter" the Office ")" shall be replaced by "the Office."
7. In Part One, the following Title X is inserted after Title IX:
Packing services
(1) The provider of parcel delivery services pursuant to Regulation (EU) 2018 / 644 of the European Parliament and of the Council on cross-border parcel delivery services ("the Regulation on cross-border parcel delivery services") provides information under this Regulation to the Authority.
(2) The information referred to in Article 4 (1), (3) and (5) and in Article 5 (1) of the Regulation on cross-border parcel delivery services is provided by the provider referred to in paragraph 1 by means of an electronic form (28).
28) Commission Implementing Regulation (EU) 2018 / 1263 of 20 September 2018 establishing forms for the submission of information by parcel delivery service providers pursuant to Regulation (EU) 2018 / 644 of the European Parliament and of the Council. '
Titles X and XI to date shall be renumbered Titles XI and XII.
8. In Paragraph 36a (1), the words "and the Regulation on cross-border parcel delivery services' shall be added at the end of the text in point (j).
9. In Paragraph 36a, at the end of paragraph 1, the dot is replaced by a comma and the following point (o) is added:
"(o) is the competent national regulatory authority under the regulation on cross-border parcel delivery services."
10. In Paragraph 37a, the following paragraphs 4 and 5 are inserted after paragraph 3:
"(4) The provider of parcel delivery services pursuant to the regulation on cross-border parcel delivery services shall commit an infringement by not providing information under this Regulation to the extent and in the manner set out in Section 35a.
(5) The provider of the cross-border parcel delivery service under the Regulation on cross-border parcel delivery services shall commit an offence by not submitting to the Office, by 31 January of each calendar year, the public tariff list referred to in Article 5 (1) of this Regulation in the manner set out in Section 35a. ';
Paragraph 4 shall become paragraph 6.
11. in Article 37a (6) (c), the words "or paragraphs 4 and 5 shall be inserted after the words" or 3 (b), "
Amendment to the Consumer Protection Act
Act No. 634 / 1992 Coll., as amended by Act No. 217 / 1993 Coll., Act No. 40 / 1995 Coll., Act No. 104 / 1995 Coll., Act No. 110 / 1997 Coll., Act No. 356 / 1999 Coll., Act No. 36 / 2008 Coll., Act No. 151 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 227 / 2003 Coll., Act No. 214 / 2003 Coll., Act No. 439 / 2003 Coll., Act No. 119 / 2004 Coll.
1. In Article 23, the following paragraph 21 is added:
"(21) The Czech Trade Inspection Centre shall supervise compliance with the obligations laid down in Article 7 of Regulation (EU) 2018 / 644 of the European Parliament and of the Council on cross-border parcel delivery services."
2. In Paragraph 24, at the end of paragraph 8, the dot is replaced by a comma and the following point (e) is added:
"(e) shall not disclose information pursuant to Article 7 of Regulation (EU) 2018 / 644 of the European Parliament and of the Council.";
3. In Paragraph 24 (14), the words "and paragraph 8 (e) 'shall be added at the end of the text of point (a).
EFFECTIVE
This Act shall take effect on the day of its publication.
