DECLARATION
Minister for Foreign Trade
of 25 November 1969
amending and supplementing Decree No 121 / 1968 of the Minister for Foreign Trade Coll., on a Foreign Trade Authorisation
The Foreign Trade Minister provides, pursuant to § 2 of Act No. 119 / 1948 Coll., on the State Organisation of Foreign Trade and International Shipbuilding:
Decree of the Minister for Foreign Trade No. 121 / 1968 Coll., on the authorisation to trade abroad, is amended as follows:
1. Paragraph 1 (2) shall read as follows:
"The authorisation to carry out foreign trade activities to date shall be deemed to have been granted to an unaltered extent in accordance with the provisions of this Order. '
2. The following Section 4a is added after Section 4:
Since the decision on foreign business activities is inseparable from the implementation of the principles of foreign trade policy and must ensure economic cooperation with foreign countries (Article 16 of the Constitutional Act on Federation No. 143 / 1968 Coll.), the decision on applications for authorisation to foreign trade activities belongs to the Ministry of Foreign Trade in cooperation with the relevant central authority of the state administration of the CSSR, the CSSR or the SSR, competent according to the residence of the applicant, in particular the Ministry of Commerce of ČSR or SSR. '
3. Note to Section 6 will read:
"The management of Qualifying Organisations shall be subject to relevant rules which are not affected by this provision. ';
4. Paragraph 7 is deleted.
5. the text of Paragraph 8 shall be deleted (*) and replaced by the following:
"The existing authorisation of undertakings established or designated under Act No. 119 / 1948 Coll. will be specified by the Ministry of Foreign Trade after consulting the Ministry of Trade of the Czech Republic or the SSR by decision pursuant to § 2 (3) of the cited Act. This shall be decided by the Ministry of Foreign Trade to each undertaking without their request. ';
6. The following Section 8a is added after Section 8:
The exceeding of the scope of an authorisation to carry out an activity on the basis of an authorisation granted - including an authorisation pursuant to § 8 - shall be considered as a breach of the professional discipline of the responsible official of the organisation concerned. ';
All current authorisations to conduct foreign trade activities granted under the Foreign Trade Minister Order No. 121 / 1968 Coll. by the Ministry of Foreign Trade or by the Ministry of Trade of the Czech Republic or the Ministry of Trade of the SSR will cease to be valid until the date of the effective date of that decree, unless the Ministry of Foreign Trade has confirmed them in cooperation with the Ministry of Trade of the Czech Republic or the SSR within two months of the issue of the decree in full or limited extent. An organisation which is not certified as having a foreign trade licence may complete the implementation of contracts with foreign partners concluded until the date of issue of this decree. To this end, organisations are required to submit to the Ministry of Foreign Trade pending vision contracts.
The Foreign Trade Minister's competence under § 2 (4) of Act No. 119 / 1948 Coll., remains with the Ministry of Foreign Trade to decide, after consulting the Minister of Commerce of the Czech Republic or the SSR, on exemptions from the authorisations of individual organisations and enterprises to conduct foreign business activities.
The full text of the decree will be published in the Foreign Trade Ministry Bulletin.
This decree shall take effect on the day of its publication.
