THE LAW
of 18 June 2015
amending Act No. 426 / 2011 Coll., on Pension Savings, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 426 / 2011 Coll., on Pension Savings, as amended by Act No. 399 / 2012 Coll. and Act No. 241 / 2013 Coll., is amended as follows:
1. Paragraph 2 (1) reads as follows:
"(1) The participant is only a natural person who has a pension savings agreement with the pension company registered in the Central Register of Contracts pursuant to § 6. '.
2. Paragraph 2 is deleted.
Paragraph 3 shall become paragraph 2.
3. Paragraph 4 (1) is deleted.
Paragraphs 2 to 8 shall be renumbered paragraphs 1 to 7.
4. In Article 4 (3), the words "a natural person who fulfils the conditions for participation in a pension 'are replaced by the words" a pensioner'.
5. Article 30 shall be deleted;
6. In the sentence of Paragraph 56 (2), the first number "24 'is replaced by" 48' and the words "or until the value of the assets in the pension fund exceeds CZK 100 000 000, if this occurs earlier 'are deleted.
7. Paragraph 99 (1) reads as follows:
"(1) The Czech National Bank may order pension companies to transfer the management of pension funds to another pension company if the pension company is unable to fulfil its obligations towards participants."
Transitional provisions
1. From the date of entry into force of this Act, the first pension savings contract cannot be registered in the Central Register of Contracts. If the first pension savings agreement was not registered in the Central Register of Contracts until the date of entry into force of this Act, this contract shall cease from the outset.
2. The amendment to the pension fund statute made in accordance with § 56 paragraph 2 of Act No. 426 / 2011 Coll., on Pension Savings, as effective from the date of entry into force of this Act, is not subject to prior approval by the Czech National Bank.
Efficacy
This Act shall take effect on the day of its publication.
