THE LAW
of 20 May 1993
amending and supplementing Act No. 283 / 1991 Coll., on the Police of the Czech Republic, as amended by Act No. 26 / 1993 Coll. and Act No. 67 / 1993 Coll., and Act No. 553 / 1991 Coll., on the Municipal Police, as amended by Act No. 67 / 1993 Coll.
Parliament has decided on this law of the Czech Republic:
Act of the Czech National Council No. 553 / 1991 Coll., on Municipal Police, as amended by Act No. 67 / 1993 Coll., is amended as follows:
1. In Paragraph 14, the following paragraph 2 is inserted after paragraph 1:
"(2) The officer shall be entitled, after a previous futile call for the issue of a weapon, to remove a weapon from a person in a place accessible to the public, if necessary in order to protect public order, the life and health of persons or the safety of property, and if there is a risk that weapons may be used for violence or threats by force. The person who issued the weapon or to whom the weapon was taken, the officer shall issue a receipt of the weapon. The firearm taken shall be handed over by the officer to the appropriate police department, which shall be indicated in the certificate in accordance with the previous sentence. ';
Paragraph 2 shall become paragraph 3 and the words "referred to in paragraph 1 'shall be replaced by the words" referred to in paragraphs 1 and 2'. Paragraph 3 shall become paragraph 4.
2. the following paragraph 5 shall be added to Article 14:
"(5) If the reasons for the withdrawal of the weapon referred to in paragraph 2 have ceased and do not prevent any other legal grounds, the weapon shall be returned to the person who issued it or to whom it has been withdrawn if the person has applied for the return of the weapon to the municipal police office and if the firearm is present, the police department indicated in the receipt certificate. ';
3. In Paragraph 15 (1), the following sentence is added at the end: "Technical means may be used to indicate or define a designated place. '
This Law shall take effect on 1 July 1993.
