THE LAW
of 17 December 1969
amending and supplementing Act No 19 / 1966 Coll., on Higher Education
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
Čl. I
Act No. 19 / 1966 Coll., on Higher Education, is amended as follows:
1. The following Section 28a is inserted after Section 28:
„§ 28a
The employment of higher education teachers will end at the end of the semester in which they reached 65 years of age if they did not end for another reason earlier. Exemptions are permitted by the Minister for Education. '
2. Paragraph 46 (4) of the first sentence shall be amended and read as follows:
"(4) The members of the Scientific Council of the Faculty are the Dean and the Dean."
3. After Section V, the following Section Va - Authorization of the Minister for Education with Section 55a is inserted:
„§ 55a
(1) Where justified, the Minister for Education may:
(a) if it does not agree with the proposal adopted by the Scientific Council of the College, submit its proposal to the Government to appoint a Rector; may also file an appeal application for the rector;
(b) if the choice of prorectors of higher education institutions, the Dean and the Dean of faculties and separate faculties has not been confirmed, appoint these academic officials from among university teachers for a period of three years, usually from ordinary or extraordinary professors or teachers; it may also revoke those officials without complying with the conditions set out in Sections 39 (6), 42 (4) and 45 (4) of the Act;
(c) establish, abolish, distribute and merge departments, research institutes, scientific institutes, or other organisational departments for the scientific and educational activities and purpose facilities of universities and appoint and remove their heads;
(d) to enter into the place of the relevant universities and faculties of employment contracts and to untie employment relationships with university staff on the basis of a comprehensive assessment of political education, teaching, scientific (artistic) and, where appropriate, other professional activities;
(e) staff meeting moral, political, pedagogical, scientific (artistic) or other professional conditions, to appoint lecturees, or to submit proposals to the government, where appropriate, for the appointment of ordinary and extraordinary professors, exceptionally without habilitation or appointment procedures.
(2) In the cases referred to in paragraph 1, the relevant provisions of the previous sections of the Act do not apply. "
Čl. II
The provisions of this Act do not apply to military universities.
Čl. III
The employment of higher education teachers who have reached the age of 65 years before the Law expires on 1 March 1970; the derogation is granted by the Minister for Education.
Čl. IV
This Act shall take effect on the day of its publication.
