DECLARATION
of 31 March 2021
on the permitted production of gas and expansion weapons and on the technical requirements for gas casings for expansion weapons
The Ministry of Industry and Trade provides pursuant to § 79 (4) of Act No. 119 / 2002 Coll., on firearms and ammunition (Act on Weapons), as amended by Act No. 229 / 2016 Coll. and Act No. 13 / 2021 Coll.:
Subject matter
This decree implements the relevant European Union1 regulations and regulates the permitted production of gas and expansion weapons and technical requirements for gas casings for expansion weapons.
Allowed production of gas weapon
(1) The main part of a gas weapon must be constructed in such a way as to prevent its modification to a weapon into which it would be possible to charge and in which it would be possible to detonate a bullet or a bullet.
(2) The dimensions of the chamber of charge of the gas weapon must allow the use of only the ammunition to which the weapon is designed.
(3) In the case of a gas weapon the design solution of which enables the removal of the main part during the normal handling and cleaning of the weapon, the main part must be designed in such a way as to prevent the firing of a spherical charge or a mass projectile.
General requirements for permissible production of an expansion weapon
A newly manufactured expansion weapon complies with the requirements of the permitted production design if:
(a) it is not possible to fire a single or mass missile or another solid projectile; only a pyrotechnic article with an acoustic, light or smoke effect can be fired from it using an oral adapter;
(b) is designed for the casings specified in technical standard CSN 39 5020 Bullets and corkscrews - Dimensions, pressures and energy in Table VIII of the dimensions tables of the cartridges and chamber,
(c) it cannot be modified, using ordinary tools, to a firearm allowing a bullet to be fired with a mass or single missile or other solid projectile;
(d) its essential parts shall not be used as essential parts of a firearm which allows a bullet to be fired with a mass or single projectile or other solid projectile;
(e) its barrel cannot be separated, removed or modified from the weapon without functionally significant damage or destruction of the expansion weapon;
(f) all barriers are permanent and cannot be removed; when removed, the chamber of charge or the expansion weapon in question must be destroyed; and
(g) the cartridge chamber and barrel are shifted, bent or deflected in such a way as to prevent the firing of a mass or uniform missile or other rigid projectile.
Specific requirements for the permissible production of an expansion weapon
(1) A newly manufactured short expansion weapon shall comply with the requirements of § 3 and shall also contain a barrel with an inseparable barrier along the whole length of the barrel, the barrier starting at the nearest possible distance behind the cartridge chamber in such a way as to allow gas to escape through the relevant orifices and ending so that the free space left in the mouth does not exceed, in particular, 1 cm of the length of the barrel, such that no single or mass projectile or other rigid projectile can pass through such a main chamber.
(2) A newly manufactured long expansion weapon shall comply with the requirements of § 3 and shall also contain a barrel with inseparable barriers of a total length of at least one third of the barrel length, with the barrier starting at the nearest possible distance behind the cartridge chamber in such a way as to allow gas to escape through the relevant openings and ending so that the open area left in the mouth does not exceed, in particular, 1 cm of the barrel length, so that no single or mass projectile or other solid projectile can pass through such a main chamber.
(3) A newly manufactured expansion weapon designed on the revolver principle must meet the requirements of § 3 and
(a) each part of the revolver cylinder shall be narrowed by at least one half of the chamber diameter compared to the hub and shall be superimposed by at least one third of the chamber diameter; and
(b) each chamber of the revolver cylinder shall contain a barrier.
(4) A newly manufactured expansion weapon with an explosion of the flue gas in the axis must mainly comply with the requirements of § 3 and must contain inseparable barriers as referred to in paragraph 1 or 2 which prevent:
(a) the creation or extension of an opening in the barrel along its axis and in the guide part of the revolver cylinder;
(b) removal mainly, except where, as a result of its removal, the frame and the cartridge chamber become useless or the integrity of the expansion weapon is significantly violated.
(5) The newly manufactured expansion weapon with the firing of the flue gas fire outside the axis must mainly meet the requirements of § 3 and the barrel must be completely closed in the direction of the shot. The barrel thus manufactured shall contain one or more gas escape holes behind the cartridge chamber.
(6) Unseparable barriers must be made of steel with minimum hardness
(a) 610 HV 30 if it is a barrier referred to in paragraph 1 or 2;
(b) 700 HV 30, if it concerns the barriers referred to in paragraph 5.
Technical requirements for gas casings for expansion weapons
(1) The gas cartridge shall be so designed that, when fired, a fraction or part of the cartridge or ammunition is not cast which would break through a sheet of paper of 100-115 g / m2 and a thickness of 0,12 ± 0,02 mm when fired at a distance of 1,5 m from the mouth of the gun. The filling of the gas cartridge shall be in the gaseous, liquid or aerosol state when leaving.
(2) The ICt50 irritant shall not exceed 100 mg.min.m-3 and one hundredth of the LCt50 value. The ICt50 is the concentration of an irritant that causes 50% of exposed exposed persons to be unable to continue the attack after one minute of exposure.
(3) The discharge time of a single gas cartridge during detonation must not exceed one second and no more irritant in milligram than four times the ICt50 value must be released.
(4) Gas charges may contain as an irritant chloracetofenone of not more than 300 mg, o-chlorobenzenedenemononitrile of not more than 80 mg and nonivamide of not more than 50 mg per gas cartridge.
(5) The gas cartridge must bear at the bottom of the cartridge a mark of the type of irritant, for chloracetofenone the CN mark, for o-chlorobenzenedenemononitrile the CS mark and for nonivamide the PV mark (technical pepper). If this does not allow the diameter of the shell bottom, the shell bottom shall be marked in colour for:
(a) chloroacetophenone in blue;
(b) o-chlorobenzylidenedenemononitrile in yellow; and
(c) nonivamide in brown.
(6) The following information must appear on the consumer packaging of gas cartridges in the Czech language:
(a) the labels of the irritants contained in the gas cartridge referred to in paragraph 5 and their chemical names;
(b) the weight of the individual irritants contained in the gas cartridge;
(c) a warning that nonivamide gas casings can only be used against animals;
(d) the month and year into which the gas casings are applicable;
(e) the types of weapons in which gas casings may be used;
(f) a warning for safe use as follows: "Attention! Contains irritants. Protect from children. There is a risk of serious damage to health when shooting within 1 m and when used in enclosed areas. ';
(g) further instructions for safe use and guidelines for emergency assistance.
Transitional provisions
(1) The provisions of this Decree shall not apply to a gas weapon, expansion weapon or gas casings for expansion weapons placed on the market before the date of entry into force of this Decree.
(2) The provisions of Decree No. 370 / 2002 Coll., on the lawful production of a gas weapon, expansion weapon and ammunition and on the requirements for the modification of a weapon for film or theatrical activity shall apply to gas weapons, expansion weapons and gas casings placed on the market before the date of entry into force of this decree and repealing certain Regulations of the Ministry of Industry and Trade, as effective before the date of entry into force of that decree.
Repeal
They shall be deleted:
1. Decree No. 370 / 2002 Coll., on the lawful production of a gas weapon, expansion weapon and ammunition and on the requirements for the modification of a weapon for film or theatre activities, and repealing certain regulations of the Ministry of Industry and Trade.
2. Decree No. 179 / 2017 Coll., amending Decree No. 370 / 2002 Coll., on the lawful production of gas weapons, expansion weapons and ammunition.
Efficacy
This decree shall take effect on the 15th day following its publication.
