GOVERNMENT REGULATION
of 3 April 2002
laying down a safeguard measure for the import of sugar into the Czech Republic
The Government mandates pursuant to § 24 of Act No. 62 / 2000 Coll., on certain arrangements for the export or import of products and on licensing and amending certain laws:
§ 1
(1) For goods referred to in heading 1701 of the Customs Tariff (1) - cane or beet sugar and chemically pure sucrose, in solid form, the rate of import duty fixed by the Customs Tariff (1) or the international contract (2) applies to the tariff quotas set out in the Annex to this Regulation.
(2) The tariff quota is opened at 8.00 on the first day of the period for which that quota is opened. If this day falls on a Saturday, Sunday or a public holiday, the quota shall be opened on the next working day.
§ 2
(1) Before the opening of the tariff quota and after its exhaustion in accordance with Article 1, the rate of import duty fixed by the Customs Tariff (1) or the international contract (2) shall be applied to the goods defined in Article 1, plus 80.
(2) If the duty calculated in accordance with paragraph 1 is less than CZK 13,50 / kg, the duty rate shall be CZK 13,50 / kg.
§ 3
(1) For the period of validity of this Regulation, the rates of duty laid down in the international Treaty shall not apply to goods originating in the Republic of Poland, as defined in Paragraph 1 and under the conditions laid down therein. (2)
(2) GOODS ORIGINATING IN THE REPUBLIC OF POLAND MEANS GOODS WHICH COMPLY WITH THE CONDITIONS PROVIDED FOR IN THE INTERNATIONAL AGREEMENT (3)
§ 4
(1) Paragraphs 1 and 2 do not apply to goods originating in the Slovak Republic.
(2) Religious goods originating in the Slovak Republic are goods which meet the conditions laid down in the international contract (4).
§ 5
(1) The provisions of Sections 1 and 2 shall not apply to goods originating in a developing country (1) or least developed country (1) which is a member of the World Trade Organisation (5), provided that its share of imports of goods as defined in Section 1 does not exceed 3% of the total imports of those goods and that imports from those countries with a share of less than 3% do not represent more than 9% of the total import volume.
(2) Religious goods originating in a developing country or least developed country are goods which meet the conditions laid down in specific legislation. 6)
§ 6
Government Decree No. 212 / 1999 Coll., laying down a safeguard measure for the import of sugar, is hereby repealed.
§ 7
This Regulation shall enter into force on the day of its publication.
