amending Decree No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, as amended
The Ministry of Agriculture provides pursuant to Article 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll. and Act No. 308 / 2011 Coll., ("the Act ') for the implementation of Section 10 (3) of the Act:

Decree No. 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, as amended by Decree No. 356 / 2004 Coll., Decree No. 389 / 2004 Coll., Decree No. 214 / 2005 Coll., Decree No. 36 / 2007 Coll., Decree No. 316 / 2007 Coll., Decree No. 288 / 2008 Coll. and Decree No. 12 / 2010 Coll., are amended as follows:
1. footnote 1 shall read:
"(1) Council Directive 92 / 119 / EEC of 17 December 1992 introducing general Community measures for the control of certain animal diseases and specific measures relating to swine vesicular disease, as amended. Commission Directive 2007 / 10 / EC of 21 February 2007 amending Annex II to Council Directive 92 / 119 / EEC as regards the measures to be taken within the protection zone following an outbreak of swine vesicular disease. Council Directive 82 / 894 / EEC of 21 December 1982 on the notification of animal diseases within the Community, as amended. Council Directive 2000 / 75 / EC of 20 November 2000 laying down specific provisions for the control and eradication of bluetongue, as amended. Directive 2012 / 5 / EU of the European Parliament and of the Council of 14 March 2012 amending Directive 2000 / 75 / EC as regards vaccination against bluetongue. Council Directive 2001 / 89 / EC of 23 October 2001 on Community measures for the control of classical swine fever, as amended. Council Directive 92 / 66 / EEC of 14 July 1992 introducing Community measures for the control of Newcastle disease, as amended. Council Directive 2009 / 158 / EC of 30 November 2009 on animal health conditions governing intra-Community trade in and imports from third countries of poultry and hatching eggs, as amended. Council Directive 92 / 35 / EEC of 29 April 1992 laying down rules and measures to combat African horse sickness, as amended. Council Directive 78 / 52 / EEC of 13 December 1977 laying down Community criteria for national plans for the accelerated eradication of brucellosis, tuberculosis and enzootic bovine leukosis. Council Directive 77 / 391 / EEC of 17 May 1977 introducing Community measures for the eradication of brucellosis, tuberculosis and leucosis in bovine animals, as amended. Council Directive 82 / 400 / EEC of 14 June 1982 amending Directive 77 / 391 / EEC and introducing additional Community measures for the eradication of brucellosis, tuberculosis and leukosis in bovine animals, as amended. Council Directive 64 / 432 / EEC on animal health problems affecting intra-Community trade in bovine animals and swine, as amended. Council Directive 91 / 68 / EEC of 28 January 1991 on animal health conditions governing intra-Community trade in ovine and caprine animals, as amended. Council Directive 80 / 1095 / EEC of 11 November 1980 laying down the conditions for the establishment of a Community territory free of classical swine fever and for the maintenance of that territory free of classical swine fever, as amended. Council Directive 2002 / 99 / EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption. '
2. In Article 31, at the end of point (c), the dot is replaced by a semicolon and the following point (d) is added:
"(d) live attenuated vaccine - vaccine produced by treatment of bluetongue virus field isolate by subsequent passages on tissue cultures or in chicken embryos."
3. The following Section 33a is inserted after Section 33:
„§ 33a
(1) The State Veterinary Administration may authorise the use of bluetongue vaccines in the framework of protection and control measures in accordance with Articles 15 (1) (i) and 48 (1) (e) of the Act, on the basis of the results of the risk assessment carried out by the State Veterinary Administration. The State Veterinary Administration shall inform the Commission of the authorisation of the use of bluetongue vaccines before the vaccination begins.
(2) Where a live attenuated vaccine is used, the State Veterinary Administration shall define a protection zone in the framework of protection and control measures covering at least the area where vaccination is carried out. They shall be accompanied by a surveillance zone which shall form part of the territory within at least 50 km beyond the protection zone. ';
4. in Article 34 (1) (a) (4), the words "; the State Veterinary Administration shall inform the Commission of the initiation of vaccination" shall be replaced by "or other alternative measures."
5. In Article 35 (2), "no vaccination 'is replaced by" vaccination against bluetongue with a live attenuated vaccine'.
6. In Paragraph 37 (1), the words "live attenuated vaccine 'shall be added at the end of the text in point (b).
7. Point 17 of Annex 6 reads as follows:
"17. Aujeszky's disease as regards domestic pigs,"

Efficacy
This Decree shall take effect on 1 July 2012.
