laying down the form of the Telecommunications Bulletin, the manner in which the data are published and the manner in which they are transmitted for publication
The Ministry of Informatics provides, pursuant to § 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), for the implementation of § 126 (3) of the Act on Electronic Communications:
In the Telecommunications Bulletin ("the Bulletin '), the Czech Telecommunications Office publishes data and information in cases where the Electronic Communications Act so provides.
Form of the Bulletin
(1) The header of each amount of the Bulletin contains
(a) the name "Telecommunications Bulletin,"
(b) the date of issue on the public service portal (1);
(c) the word "Year" followed by the calendar year in which the amount is issued;
(d) the word "Amount" followed by the order number in the calendar year; and
(e) the name and trade mark of the Czech Telecommunications Office.
(2) The numbering of the amounts of the Bulletin and the numbering of the pages of the Bulletin is carried out in two separate continuous rows since the beginning of the calendar year. The numbering of amounts and numbering of the pages of the Bulletin shall be closed at the end of each calendar year.
(3) A comprehensive annex may be published in a separate annex of the amount of the Bulletin, issued at the same time as the relevant amount in which the text in question is published. The parties to the Annex shall be numbered in a continuous series following the numbering of the parties to the amount to which it is annexed.
From the point of view of the requirements of specific legislation, the content of the published data and information on the public administration portal and the date on which the data or information was published on that portal is relevant.
Method of transmission of data for publication on the public administration portal
(1) The original or officially certified copies of the documents containing the particulars or information to be published shall be the basis for publication in the Bulletin. Such data or information may be sent to the Czech Telecommunications Office (hereinafter referred to as the Office)
(a) paper and electronic at the same time; or
(b) by electronic means, where they are accompanied by a guaranteed electronic signature of an applicant for publication based on a qualified certificate issued by an accredited certification service provider under a special legislature2).
The applicant for publication shall be responsible for the content of the documents for publication.
(2) A Bulletin prepared by the Office in the form referred to in Article 2 shall be sent by the Office to the public administration portal operator for publication in electronic form, signed by a guaranteed electronic signature of the authorised person based on a qualified certificate issued by an accredited certification service provider under a special legislature2). The Office is responsible for the accuracy of the processing of the Bulletin.
(3) The operator of the public administration portal is responsible for compliance by the Office of the Bulletin and the published Bulletin.
Efficacy
This Decree shall take effect on 1 May 2005.
