Government Regulation
of 2 September 1947
on certain measures ensuring the fulfilment of the tasks of the two-year economic plan in agriculture.
The Government of the Czechoslovak Republic hereby orders pursuant to § 12, § 1 and § 16, § 1 of the Law of 25 October 1946, No 192 Coll., on a two-year economic plan:
Animal movement.
(1) Farmers of livestock are required to notify the local national committee within the time limits laid down by the Ministry of Agriculture in an agreement with the Ministry of Food in Slovakia, in principle through the entrants of agriculture and land reform, the number of horses, bovine animals and pigs which they intend to offer for sale or transfer for lack of feed. Local national committees shall notify the total number of animals offered for sale and moved by species and weight to the district national committee. The Regional National Committee shall organise the movement of animals within its perimeter under the cooperation of the Regional Association of the competent Union of Farmers according to the reports received.
(2) The local national committees shall, in cooperation with the local association of the relevant Single Union of Farmers, classify bovine animals into productive and slaughter animals. In doing so, it is important to ensure that they are not moved, as far as possible, mainly by efficient cows, pregnant heifers and heifers capable of breeding.
(3) The number, type and weight of animals which cannot be placed in the perimeter of each district will be reported by the district national committees to the Ministry of Agriculture, which organises the movement and location of the reported commercial animals between each district; as regards slaughter cattle, the Ministry of Nutrition does so in agreement with the Ministry of Agriculture. In Slovakia, the Ministry of Agriculture and Nutrition shall exercise the powers referred to in the previous sentence in principle through the respective mandates, which shall be governed by their directives.
Transfers of livestock within and between counties shall be carried out by the Ministry of Agriculture, in agreement with the Ministry of Nutrition, to its own account by the farm cooperatives and their head office, in cooperation with the relevant units of the Single Union of Farmers and for the cooperation of livestock operators.
Loss on animals moved, resulting from death or from a disease or accident that is not covered by insurance shall be paid from the Treasury, unless the seller, buyer or transporter is obliged to pay them. The granting of the refund shall be decided upon on a reasoned request from the damaged Ministry of Agriculture, Slovakia, by means of a delegation of agriculture and land reform.
Feedingstock and litter detection.
(1) Breeders of livestock are obliged to obtain replacement litter (§ 5 (a)), mainly from their own resources, and to use for that purpose also waste such as potato seed and such. Such waste shall not be destroyed by incineration, compost or similar in places where the lack of feed and litter is found.
(2) The local national committees shall take appropriate measures to ensure that, according to local circumstances, straw is used as a litter to the minimum possible and to use it to conserve spare straws [§ 5 (a)] in order to allow straw to be used as bulky fodder.
The Regional National Committees shall immediately identify and report to the Ministry of Agriculture and the Ministry of Nutrition in Slovakia, by 10 October 1947 at the latest, by way of delegation of agriculture and land reform and nutrition, by municipality:
(a) finished stocks of bulky manure and litter, including spare litter (sawdust, reeds, peat, leaves and j.), from 1947 and earlier,
(b) surpluses, after a lack of litter and feed, taking into account the need for livestock in the municipality.
In agreement with the Ministry of Agriculture, the Ministry of Nutrition will take measures to ensure that excess manure and litter are redeemed and allocated to municipalities, where appropriate. In Slovakia, the Ministry of Food and Agriculture will make this measure fundamentally through the respective mandates, which are governed by their directives.
Mining of forest litter and fodder.
(1) If this is not detrimental to the proper restoration of the forest, the owners, after the smugglers or other forest users, shall be obliged to extract forest fodder and litter, collect them in the forest and report the harvested quantities after deduction of the own needs of the district national committee. According to the reports received, the District National Committee organises the relocation of forest fodder and litter to its district, where there is a shortage.
(2) The Regional National Committees will, in principle, notify the Ministry of Agriculture, Slovakia through the delegation of agriculture and land reform, the amount of surplus forest fodder and litter. The Ministry of Agriculture, in Slovakia, organises, in principle, the relocation of the Ministry of Agriculture and Land Reform through the responsibility of agriculture and land reform under the guidelines of the Ministry of Agriculture.
(3) With regard to the State forests managed by the Ministry of National Defence, the Minister for National Defence will take special measures for the extraction of forest fodder and litter.
If the owner, after having been able to carry out the harvest of forest fodder and the extraction of forest litter himself by his own means, after the owner or any other forest user, is unable to allow the harvest of grass and the extraction of forest litter to be carried out by himself, he is obliged to allow farmers who, even when using the resources of the replacement litter (§ 4 (1)), lack of feed and litter.
The Ministry of Agriculture, Slovakia, after a statement by the authority of agriculture and land reform, will determine, with a view to the protection of the nature of the forest, by decree in the Official Journal of the Republic of Czechoslovakia, the detailed conditions for the extraction of forest grass and forest litter.
Management products which may serve as feed.
The production of spirit from molasses, beet, potatoes and cereals and the production of starch from potatoes and cereals shall be limited to the minimum. Only potatoes that are frozen, rotten and similarly unfit for consumption shall be used for the production of alcohol.
Provisions criminal and final.
In accordance with the provisions of Section 4 of the Act of 13 February 1947, No 27 Coll., on the criminal protection of the implementation of a two-year economic plan, the transfers of this Regulation are punishable.
This Regulation shall enter into force on the day of its publication and shall apply until 15 July 1948; They shall be implemented by the Agriculture and Nutrition Ministers in agreement with the Ministers involved.
