concerning the interim management of the state economy of the Czechoslovak Republic in 1946.
The Provisional National Assembly of the Czechoslovak Republic decided on the following Act:
The Government hereby authorises itself to conduct, for the period from 1 January 1946 until the publication of a constitutionally approved state budget for 1946, until the end of March 1946 at the latest, the state economy, either bearing only the urgent needs of the state, requiring the fulfilment of legal obligations or the necessary functioning of the state administration and the state economy at all.
The central authorities managing expenditure and revenue, as well as public undertakings and funds, shall be required to send to the Ministry of Finance, by the 20th day of the current month, the statements of expenditure and revenue expected in the next calendar month. These expenses are decided by the government. For the authorities and businesses in Slovakia, these monthly statements of cash expenditure and revenue shall be sent by the financial officer.
The Minister for Finance is hereby authorised to:
(a) to provide credit operations with a remuneration for State expenditure not paid on State revenue;
(b) to provide temporary loans for the payment of transitional deficits resulting from a time discrepancy between revenue and expenditure;
(c) to carry out the credit operations necessary for the prolongation, conversion or payment of sovereign debts due in 1946, including expenditure relating to such credit operations.
1. The credit arrangements made by the Government from 5 May to 31 December 1945 abroad for the purchase of food, goods and raw materials are subsequently approved.
2. The Government shall be empowered,
(a) to provide additional loans for purchases of food, goods and raw materials abroad or to take over state guarantees for foreign loans up to a total of $400,000,000 or up to an amount equivalent to that in other foreign currencies;
(b) to provide funds for the necessary administrative salaries abroad by credit operations abroad;
(c) to carry out the credit operations needed to convert national foreign debt, including expenditure relating to such credit operations.
1. The Minister of Finance is hereby authorised to assume state guarantees for loans granted to fulfil essential public tasks. Guarantees for debtors in Slovakia are taken over by a finance officer under uniform national conditions.
2. The vouchers and guarantee clauses, issued under the authorization referred to in the preceding paragraph, shall be exempt from the fees.
The Government hereby authorises itself to adjust the interest and amortisation of the Czechoslovak internal government debt by regulation, following also debts agreed by the holders of executive power in the period of infreedom in the territory of the Czechoslovak Republic. Until such adjustment is made, the interest and amortisation shall be suspended, suspended where appropriate.
Expenditure and revenue for the interim management of the state economy shall be settled according to it after the declaration of the constitutionally approved state budget for 1946.
The decree of the President of the Republic of 14 August 1945, No 52 Coll., on the provisional management of the state economy, will cease to apply - with the exception of Paragraph 5 (2) of this Decree - on 31 December 1945.
This Law shall take effect on 1 January 1946; it shall be carried out by all members of the Government.
