of 19 January 2024
amending Decree No. 37 / 1992 Coll., on Rules of Procedure for Regional and Regional Courts, as amended
According to Article 374 (1) (a) of Act No. 99 / 1963 Coll., Civil Code, as amended by Act No. 133 / 1982 Coll., Act No. 263 / 1992 Coll., Act No. 24 / 1993 Coll., Act No. 238 / 1995 Coll., Act No. 30 / 2000 Coll., Act No. 151 / 2002 Coll. and Act No. 218 / 2021 Coll.:
Decree No. 37 / 1992 Coll., on Rules of Procedure for Regional and Regional Courts, as amended by Decree No. 584 / 1992 Coll., Decree No. 194 / 1993 Coll., Decree No. 246 / 1995 Coll., Decree No. 278 / 1996 Coll., Decree No. 234 / 1997 Coll., Decree No. 482 / 2000 Coll., Decree No. 104 / 2002 Coll., Decree No. 268 / 2003 Coll., Decree No. 322 / 2007 Coll., Decree No. 384 / 2017 Coll., Decree No. 222 / 2009 Coll., Decree No. 457 / 2009 Coll., Decree No. 457 / 2009 Coll., Decree No. 438 / 2011 Coll., Decree No. 322 / 2013 Coll., Decree No. 322 / 2017 Coll.
1. the words "and restructuring" shall be added at the end of Paragraph 2 (2) (b).
2. in Article 6 (2), the following point (u) is inserted after point (t):
"(u) acts in the restructuring procedure with the exception of negotiations and decisions on:
1. the appointment of a restructuring trustee;
2. the withdrawal of the restructuring trustee from office,
3. termination of the function of the restructuring trustee;
4. the proposal for a general moratorium,
5th motion to declare an individual moratorium,
6. a proposal to carry out a preliminary examination of the claim's dispute,
7. the proposal to confirm the restructuring plan,
8. end of preventive restructuring;
9. the proposal to abolish the restructuring plan; ';
Point (u) shall be renumbered as point (v).
3. in Article 6 (9), the following point (f) is inserted after point (e):
"(f) in the restructuring proceedings, they shall indicate both the original and the copies of the documents for which disclosure is the relevant date or time of publication in the restructuring register or on the electronic official plate of the restructuring court, the clause at the time of publication in the restructuring register or on the electronic official plate of the restructuring court, and shall, in simple cases, make personal data available to natural persons in the documents (s) published in the restructuring register, the electronic official plate of the restructuring court or in the collection of documents of the commercial register of the entrepreneur,";
Point (f) shall be renumbered as point (g).
4. In Section 6a (c) (5), the words "or restructuring 'are inserted after the word" insolvency'.
5. in Article 6a, the following point (n) is inserted after point (m):
"(n) negotiations and decisions in the restructuring procedure
1. the appointment of a restructuring trustee;
2. the withdrawal of the restructuring trustee from office,
3. termination of the function of the restructuring trustee;
4. the proposal for a general moratorium,
5th motion to declare an individual moratorium,
6. a proposal to carry out a preliminary examination of the claim's dispute,
7. the proposal to confirm the restructuring plan,
8. end of preventive restructuring;
9. the proposal to abolish the restructuring plan; ';
Point (n) shall be renumbered (o).
Efficacy
This Decree shall take effect on the day following that of its publication.
