Federal Ministry of Agriculture and Nutrition
of 28 March 1972
on alcohol management
The Federal Ministry of Agriculture and Nutrition provides in an agreement with the central authorities concerned pursuant to § 6 (1) of Act No. 63 / 1950 Coll., on the treatment of tobacco, salt and alcohol management and on the abolition of state financial monopolies:

Oddíl I

Purpose of the decree and basic terms
§ 1
(1) The purpose of the Decree is to ensure uniform management of alcohol, uniform planning of production and sales of alcohol.
(2) Lime means ethyl alcohol (ethanol) obtained by the production referred to in Article 2 (1), as well as blends and mixtures of ethanol with other substances, provided that they have a concentration of more than 15% by volume of ethanol and are not obtained by distillation or other separation at the first stage of production prior to the registration of alcohol.
(3) Spirits are not fortified wines or fruit juices.
(4) The basic unit of measurement of volume ethanol is the cubic meter of alcohol (m3 a) and derived unit of litre of alcohol (1 a) at a normal temperature of 20 ° C for which the volume concentration has been detected by a glass areometer for alcohol. A litre of alcohol is equal to 10-3 m3 of alcohol (exactly).
§ 2
(1) The production of alcohol means the extraction of alcohol by distillation from fermented sugar solutions, from raw materials containing sugar, starch, cellulose and inulin and from raw materials containing alcohol or other separation or synthesis at the first stage of production.
(2) Liquidity refining means cleaning (refining), strengthening (rectification), drainage (dehydration), and recovery of alcohol from spirits waste (regeneration).
(3) Cleaning (refining) means further distillation of alcohol, which is to remove both impurities resulting mainly as by-products of fermentation, and the product is to be reinforced to obtain a product with a maximum ethanol content. Strengthening (rectification) is the repeated distillation of raw fruit distillate in order to achieve an amplification of the product while leaving part of the fermentation by-products not typical of the product. The drainage (dehydration) of alcohol is the removal of the last proportion of water from alcohol, or the impurities from refined alcohol. Regeneration is the redistillation of spirit-based waste fluids and lye resulting from the treatment (use) of alcohol as the main or auxiliary raw material for the manufacture of other substances and goods.
(4) Distillers under this Decree are:
(a) industrial (molasses) distilleries, agricultural, fruit and distillery distilleries carrying out the cultivation burning;
(b) cabbages for which the alcohol is a by-product, alcohol refiners, water-free distilleries, denaturants, mixers and denaturants warehouses, separate alcohol stores;
(c) distillates (egalitation stations);
(d) the production of synthetic alcohol, the production of sulphite alcohol and the production of alcohol by separation other than distillation.
(5) Distiller plants are not alcohol processing plants as the main raw material, such as vinegar mills, spirits, punishments and other fragrance and flavourings, etc.
(6) Industrial distilleries process molasses and other sugar products. Agricultural distilleries mainly process raw materials containing starch and inulin, such as potatoes, cereals, maize or waste from processing such raw materials, such as back and sludge starch, waste water from starch production. Fruit distilleries process fruit, wine, waste in the production of wine or fruit processing, juniper fruit etc. The distilleries carrying out the burning process process yeast and fruit from the growers' own harvest. Synthetic alcohol mills obtain alcohol by hydrating ethylene, sulphite distilleries process sulphite lees.

Manufacture of alcohol
§ 3
The alcohol may be produced by legal persons who are distilleries and, where appropriate, in which the distillery is incorporated and, as regards the production of fruit, (1) natural persons authorised to carry out production under specific regulations. The production of alcohol requires the authorisation of the Ministry of Agriculture of the Czech Republic or of the Ministry of Agriculture and Nutrition of the Slovak Republic, issued after consultation with the Federal Ministry of Finance and the competent Ministry of the Republic. Other socialist organisations can only produce alcohol with the permission of the relevant Ministry of Agriculture and Nutrition of the Republic after consulting the Federal Ministry of Agriculture and Nutrition, the Federal Ministry of Finance and the competent Ministry of Finance of the Republic. If the production of sulphite alcohol or synthetic alcohol is concerned, the production permit shall be issued by the competent Ministry of Industry of the Republic after consultation with the Federal Ministry of Finance.
§ 4
(1) The approval of the competent Ministry of Agriculture and Nutrition of the Republic, after consulting the Federal Ministry of Finance and the competent Ministry of Finance of the Republic, is necessary to establish and abolish distilleries.
(2) The approval of the competent Ministry of Industry of the Republic, after consultation with the Federal Ministry of Finance and the competent Ministry of Finance of the Republic, is necessary to establish and abolish the production of sulphite and synthetic alcohol.
§ 6
The cultivation and denaturing of alcohol are regulated by specific regulations. * *)

Oddíl III

Sales of alcohol
§ 7
(2) All alcohol produced or imported into the territory of the Czech and Slovak Federal Republic, with the exception of synthetic alcohol intended for industrial processing, may be removed or put into circulation only with the consent of the Ministry of Agriculture of the Czech Republic or the Ministry of Agriculture and Nutrition of the Slovak Republic.
(3) Synthetic alcohol produced or imported into the Czech Republic or the Slovak Republic and intended for industrial processing in the enterprises of the relevant Ministry of Industry of the Republic may be removed or put into circulation only according to the instructions of this Ministry.

Oddíl IV

Provisions common and final
§ 8
The competent Ministry of Agriculture and Nutrition of the Republic shall, in agreement with the Federal Ministry of Finance and the competent Ministry of Finance of the Republic, regulate the standards of loss for the production and circulation of alcohol for distilleries and processors for which the alcohol is the main raw material; for sulphite and synthetic alcohol, the loss standards referred to by the competent Ministry on a proposal from the Ministry of Industry of the Republic are adjusted.
§ 9
Authorisations for the production of alcohol issued under the current rules shall remain in force before the Decree is effective.
§ 10
The Decree of the Ministry of Nutrition No 565 / 1950 Ú. I. (541 / 1950 Ú. v.) on alcohol management, as amended by Decree No 108 / 1958 Ú. l, is hereby repealed.
§ 11
This Decree shall take effect on 1 April 1972.
