DECLARATION
of 29 May 2009
amending Decree No 215 / 2008 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products
The Ministry of Agriculture provides pursuant to § 88 (1) (b) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 626 / 2004 Coll., Act No. 444 / 2005 Coll., Act No. 131 / 2006 Coll. and Act No. 249 / 2008 Coll., ("the Act '):
Decree No 215 / 2008 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, is amended as follows:
1. Paragraph 1 (1), including footnotes 1 and 2, reads:
"(1) This decree (1) implements the relevant provisions of the European Communities (hereinafter referred to as" the Community ") 2 and provides for measures to prevent the introduction and spread of harmful organisms of plants and plant products.
1) It is issued on the basis and within the limits of the law in which the relevant Directives of the European Communities have already been reflected and the content of which allows the relevant provisions of the European Communities to be incorporated by decree.
2) Commission Directive 92 / 70 / EEC of 30 July 1992 laying down detailed rules for surveys carried out for the purpose of the recognition of protected zones in the Community. Commission Directive 92 / 90 / EEC of 3 November 1992 laying down the obligations to which producers and importers of plants, plant products or other objects are subject and laying down the details for their registration. Commission Directive 92 / 105 / EEC of 3 December 1992 establishing the degree of unification of plant passports used for the movement of certain plants, plant products or other objects within the Community and the detailed procedures for the issue of such plant passports and the conditions and detailed procedures for their replacement. Commission Directive 93 / 50 / EEC of 24 June 1993 determining certain plants not listed in Part A of Annex V to Council Directive 77 / 93 / EEC whose producers or warehouses or dispatch centres in the production areas of those plants must be entered in an official register. 4. In Paragraph 27 (1), the word "relevant 'is deleted.
5. In Paragraph 27, the following paragraphs 2 to 5 are inserted after paragraph 1:
"(2) The scope of the investigation to verify compliance with the requirements of the importing or, where applicable, accompanying State for the protection against introduction of harmful organisms shall include for the consignment of plants, plant products or other objects intended for export:
(a) the control of the import requirements submitted by the importing or, where appropriate, by the accompanying State for protection against the introduction of harmful organisms, unless those requirements have been published in accordance with Article 28 (7) (b) of the Act, including an additional declaration, where such declaration is part of the import requirements;
(b) verification of the validity of the import authorisation of the importing State or, where appropriate, of the accompanying State where the issue of such authorisation is part of the import requirements of that State;
(c) checking the particulars given in the original or officially certified copy of the plant health certificate issued by the third country, if reexport is concerned and such certificate has been issued;
(d) verification of the identity of the consignment by comparing the information in the documents identifying the consignment and certifying its origin with the actual situation;
(e) verification of compliance with import requirements, if any, by the importing State or, where applicable, by the accompanying State for protection against the introduction of harmful organisms which cannot be proven to have been complied with at the place of the investigation;
(f) professional inspection of the consignment, where appropriate, of its representative sampling and laboratory testing to verify the absence of harmful organisms the introduction of which into the importing or, where appropriate, accompanying State is prohibited by the import requirements of that State, or to verify compliance with any other plant health requirements, where such requirements are part of the import requirements of that State.
(3) Minimum requirements for technical equipment for carrying out an investigation under Section 28 (2) of the Act are:
(a) a reinforced driveway for the passage of a passenger motor vehicle;
(b) artificial lighting when the investigation is to be carried out in covered areas or in reduced visibility;
(c) by means of means of supporting work, opening and closing means of transport, establishing ladders, bridges and taxiways, so as to enable a representative inspection of all lots of the whole consignment, including its clear removal from storage or unloading, where the consignment is already loaded on the means of transport and where the commodity is needed,
(d) office spaces allowing detailed inspection of the samples taken and the issue of a phytosanitary certificate, in particular in such a way that, when exporting consignments of plants presenting a high level of risk of introduction and spread of harmful organisms, the room heated during the winter period to the temperature required to ensure testing methods, if carried out during that investigation period, with a 220 V electrical network socket connection and with a water supply and drainage of waste water into the sewer.
(4) Plants, plant products and other objects presenting a high level of risk of introduction and spread of harmful organisms and harmful organisms causing them to be contaminated are listed in Annex 21a to this Decree. "
Paragraph 2 shall become paragraph 5.
6. In Annex No 1 (A) (I) (a), the following point 10.0 is inserted after point 10:

7. In Annex 1 (A) (I) (a), point 10.4 is replaced by the following:

8. In Annex No 1 (A) (I) (a), the following point 19.1 is inserted after point 19:

10. In Annex No 2 (A) (I) (a), the following point 1.1 is inserted after point 1:

21. In Annex 3, Part B, points 1 and 2, the right column reads:

22. In Annex 4, Part A, Section I, point 2, the right column reads:

- be free from bark, except for any number of individual bark residues, the width of which, at any length, shall not exceed three centimetres or, if they are larger than three centimetres, shall not have an area exceeding 50 centimetres square,
- be subjected to one of the approved treatments set out in Annex I to FAO International Standard for Phytosanitary Measures No 15 of the Guidelines for the Control of Wood Packaging Material in International Trade, and
- be marked according to Annex II to FAO International Standard for Phytosanitary Measures No 15 Guidelines on the regulation of wood packaging material in international trade, confirming that wood packaging material has undergone approved phytosanitary treatment. '
23. In Annex 4, Part A, Section I, the following points 2.3, 2.4 and 2.5 are inserted after point 2.2:

24. In Annex 4, Part A, Section I, point 8, the right column reads:
"Wood shall:

25. In Annex No 4, Part A, Section I, the following point 11.4 is inserted after point 11.3:

26. In Annex 4, Part A, Section I, point 14, the right column reads:
"In addition to the measures in force for these plants referred to in point 11.4. of Part A of Section I of this Annex, official confirmation that no signs of infection with Elm phlöem necrosis mycoplasm / son have been observed at the place of production or in its immediate vicinity since the beginning of the last complete growing season. = Elm yellows phytoplasma /. '
27. In Annex 4, Part A, Section I, the following points 25.4.1 and 25.4.2 are inserted after point 25.4:
| „25.4.1. 28. In Annex 4, Part A, Section I, point 25.8 is deleted.
29. In Annex No 4, Part A, Section I, the following point 28.1 is inserted after point 28:
| „28.1. Rostliny Dendranthema (DC.) Des Moul. a Lycopersicon lycopersicum (L.) 30. In Annex 4, Part A, Section I, the following point 37.1 is inserted after point 37:
| „37.1. Rostliny Palmae, určené k pěstování, které mají průměr kmene u paty větší než 5 cm a patří do následujících rodů: Brahea Mart., Butia Becc., Chamaerops L., Jubaea Kunth, Livistona R. Wendl., Trithrinax Mart., Washingtonia Raf. | Kromě zákazů, vyplývajících z bodu 17. části A přílohy č. 3 a požadavků uvedených v bodu 37. části A oddílu I této přílohy, úřední potvrzení, že rostliny a) byly trvale pěstovány v zemi, ve které se nevyskytuje Paysandisia archon (Burmeister), nebo b) byly trvale pěstovány v oblasti, která byla uznána národní organizací ochrany rostlin za prostou Paysandisia archon (Burmeister) podle příslušných mezinárodních standardů pro fytosanitární opatření, nebo c) byly pěstovány po dobu nejméně dvou let před vývozem v místě produkce: – které je registrováno národní organizací ochrany rostlin v zemi původu a tato organizace nad ním vykonává dohled, – kde byly rostliny umístěny v prostoru s úplnou fyzickou ochranou před zavlečením Paysandisia archon (Burmeister) nebo za použití vhodných preventivních ošetření a – kde nebyly pozorovány žádné příznaky napadení Paysandisia archon (Burmeister) při 3 úředních prohlídkách za rok prováděných ve vhodnou dobu, včetně bezprostředně před vývozem. “. |
31. In Annex 4, Part A, Section I, point 43, left-hand column, 'countries' is replaced by 'countries'.
32. In Annex 4, Part A, Section II, the following point 19.1 is inserted after point 19:
| „19.1. Rostliny Palmae, určené k pěstování, které mají průměr kmene u paty větší než 5 cm a patří do následujících rodů: Brahea Mart., Butia Becc., Chamaerops L., Jubaea Kunth, Livistona R. Br., Phoenix L., Sabal Adans., Syagrus Mart., Trachycarpus H. Wendl., Trithrinax Mart., Washingtonia Raf. | Úřední potvrzení, že rostliny a) byly trvale pěstovány v oblasti, která byla uznána národní organizací ochrany rostlin za prostou Paysandisia archon (Burmeister) podle příslušných mezinárodních standardů pro fytosanitární opatření, nebo b) byly pěstovány po dobu nejméně dvou let před přemístěním v místě produkce: – které je registrováno příslušným úředním orgánem v členském státu původu a tento subjekt nad ním vykonává dohled, – kde byly rostliny umístěny v prostoru s úplnou fyzickou ochranou před zavlečením Paysandisia archon (Burmeister) nebo za použití vhodných preventivních ošetření a – kde nebyly pozorovány žádné příznaky napadení Paysandisia archon (Burmeister) při 3 úředních prohlídkách za rok prováděných ve vhodnou dobu.“. |

36. In Annex No 9, Part A, Section I, the following point 2.3.1 is inserted after point 2.3:

37. In Annex No 9, Part B, Section the following third indent shall be added to point 5:
"- Fraxinus L., Juglans mandshurica Maxim., Ulmus davidiana Planch., Ulmus parvifolia Jacq. and Pterocarya rhoifolia Siebold et Zucc., originating in Canada, China, Japan, Mongolia, the Republic of Korea, Russia, Taiwan and the USA. '.
38. In Annex 9, Part B, Section I, point 6 (a), the following sixth indent is added:

39. In Annex 9, Part B, Section I, point 6 (b), the CCN code ex 4407 99 is deleted and replaced by the new CCN codes:

40. In Annex No 21, Part B, point 4. The model phytosanitary certificate for re-export shall be deleted from the words "Czech Republic '.
41. the following Annex 21a is inserted after Annex 21:
"Annex No 21a to Decree No 215 / 2008 Coll.
Plants, plant products and other objects presenting a high level of risk of introduction and spread of harmful organisms causing them to be contaminated:
(a) plants of ornamental herbal species and vegetables intended for cultivation other than:
1. onions,
2. cloth tubers,
3. plants of the family Graminae,
4th rhizome,
5. Seeds,
6. tubers,
7. tissue cultures,
(b) cut flowers.
Harmful organisms that cause hidden infestations on plants, plant products and other objects which present a high level of risk of their introduction and spread:
(a) Thisanoptera;
(b) redfish (Agromyzidae). ';
Efficacy
This Decree shall take effect on the date of its publication, with the exception of the provisions of the first indent of Article 5 (1) (a) of the Code. I, point 22 and the first indent of Article I, point 24, which shall take effect on 1 July 2009.
