on the provisional application of the Trade Agreement on the Valorisation of the Conventional Rate of Duty between the Republic of Czechoslovakia and Spain, negotiated in Prague by exchange of notes of 4 March and 6 April 1948.
Under Article 1 of the Act of 4 July 1923, No 158 Coll., on the provisional treatment of trade relations with foreign countries, and Article VII of the Law of 22 June 1926, No 109 Coll., which partially amends the Customs Tariff Act for the Czechoslovak customs territory and the Customs Tariff and issues provisions on trade relations with foreign countries, I declare:
According to the Resolution of the Government of the Czechoslovak Republic of 13 April 1948 and with the agreement of the President of the Republic, a trade agreement on the indexation of the contractual tariff between the Republic of Czechoslovakia and Spain, negotiated in Prague in exchange of the notes of 4 March and 6 April 1948, is hereby entered into force with effect from 20 April 1948.

The Ministry of Foreign Affairs of the Czechoslovak Republic has the honour to state that the following agreement was proposed with the Czechoslovak parties for the recent negotiations with the Spanish Embassy in Prague:
As a result of the new adjustment of the Czechoslovak currency in November 1945, the duties of the Czechoslovak Customs Tariff, as bound by the Additional Agreement of 13 December 1928 to the Trade Convention of 29 July 1925, negotiated between the Republic of Czechoslovakia and Spain (Final Protocol - ad Article I of the Additional Agreement) are increased on the basis of Article VI of the Additional Agreement.
The new rates are set out in the attached list. This list replaces the corresponding list annexed to the Final Protocol to the Additional Agreement of 13 December 1928, as well as the provisions concerning Spanish wines contained in the letters of 13 December 1928 which were exchanged when the Additional Agreement was signed.
This Agreement shall enter into force following the constitutional approval in Czechoslovakia and shall remain in force for the duration of the Commercial Convention of 29 July 1925 between the Republic of Czechoslovakia and Spain.
However, it will enter into provisional effect on 20 April 1948.

Additional provisions
on the import of Spanish wines.
The consignments of Spanish wines must not only be accompanied by a certificate of origin but also by an analysis finding, which will contain the following information in particular:
specific weight,
alcohol grade;
the content of all acids,
volatile acid content,
the extract content,
sugar content,
a sugar-free extract content,
ash (mineral) content,
a statement that it is a natural wine without any ingredient.
Certificates of origin for Spanish wines imported into Czechoslovakia shall be issued by the following official Spanish institutes:
Official Chamber of Commerce
Official agricultural chambers.
Certificate of analysis of Spanish wines imported into Czechoslovakia will be issued by the following official Spanish institutes:

The envoy of the Republic of Spain shows respect for the Ministry of Foreign Affairs and has the honour of giving him the reply of his government to the note of a number. 258.925 of 4 March 1948 relating to the adjustment of autonomous tariff rates of the Czechoslovak Customs Tariff.
The special circumstances in which the Government of the Republic of Spain does not allow it to maintain direct contact with vital parts of the Spanish economy which could be affected by this change. In these circumstances, it cannot open detailed negotiations.
However, in order not to prevent the Czechoslovak administration, within the framework of the current trade agreements, the autonomous tariff rates and the contractual duties required by the circumstances, the Government of the Republic of Spain takes note of the changes contained in the proposal annexed to the note of 4 March 1948.
In the event that these changes were unilaterally adopted by the Czechoslovak Government, the Government of the Republic of Spain will not consider this measure to be contradictory to the effectiveness of the 1925 and 1928 trade agreements, subject to final adoption, in the sense of the most favourable relationship between our two countries, once normal circumstances occur in Spain and the final legal power is restored.
