DECLARATION
of 19 April 2005
laying down minimum requirements for the draft contract on access or interconnection of public communications networks
According to Section 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (the Act on Electronic Communications), the Ministry of Informatics provides for the implementation of Section 80 (5) of the Act:
§ 1
Minimum requirements of the draft access contract
(1) The proposal to conclude an access contract pursuant to Article 80 (1) of the Act must contain at least the applicant's identification details, a proposal for a technical approach solution, a proposal for prices and other commercial terms and specifications of the required services.
(2) The applicant's identification details are:
(a) in the case of a natural person, the name and surname or, where applicable, the business firm, the place of permanent residence or temporary residence in the Czech Republic or, where applicable, the place of residence abroad, the identification number, if any, the name, surname and address of the agent responsible and the registration number of the certificate of notification of the operation of the communication activity;
(b) in the case of a legal person, the name, registered office or, where applicable, the location of the organisational body in the Czech Republic, the identification number, if assigned, the name, surname and address of the person authorised to act on behalf of that legal person and the registration number of the certificate of notification of the communication activity.
(3) The proposal for a technical approach solution means:
(a) design of the location of the access points (exact addresses and, if possible, specification of the building floor, room numbers, or a simple situation sketch according to the cadastral map),
(b) draft specification of the equipment proposed for access;
(c) design of electrical and physical interface parameters for network access according to standards or specifications (Section 62 of the Act) and other data needed to ensure interoperability of services intended for network end or access points;
(d) a proposal for a specification of the network elements and the associated means to which access is requested, including a proposal for data on their required capacities at the time of start of operation, with an estimate of the need for the relevant capacities with a view to 2 years;
(e) a proposal for the required date for the opening of access; and
(f) the design of the required qualitative interface parameters for access, including their values and the methodology for their detection.
(4) The proposal for prices and other trading conditions means:
(a) a proposal for the price of the total and the price of the sub-installations, in an appropriate breakdown by network elements and allocated means;
(b) draft solutions for failure and reduced access quality; and
(c) a proposal for a solution to a case of non-use of the required capacities of network elements, associated resources or services.
(5) The specification of the required services means:
(a) the specification of the service provided in cooperation between the Contracting Parties, including a brief description of the service parameters;
(b) the specification of the service provided to users; and
(c) the specifications of the additional service; the ancillary service is a service which complements the basic electronic communications service and which cannot be offered to the user separately but only in conjunction with the basic service provided.
(6) The draft access contract requiring unbundled access to the local loop (1) must also contain at least the specification of the part of the network to which access is sought, including the required type of unbundled access to the local loop and the operator's identification number assigned.
§ 2
Minimum details of the draft network interconnection contract
(1) The proposal for the conclusion of a network interconnection contract pursuant to Article 80 (1) of the Act must contain at least the applicant's identification data, a proposal for technical interconnection solutions, a proposal for prices and other commercial conditions, a specification of the required measures and services, and a proposal for the method of measuring traffic and the operational load between connected networks.
(2) The applicant's identification details are:
(a) in the case of a natural person, the name and surname or, where applicable, the business firm, the place of permanent residence or temporary residence in the Czech Republic or, where applicable, the place of residence abroad, the identification number, if any, the name, surname and address of the agent responsible and the registration number of the certificate of notification of the operation of the communication activity;
(b) in the case of a legal person, the name, registered office or, where applicable, the location of the organisational body in the Czech Republic, the identification number, if assigned, the name, surname and address of the person authorised to act on behalf of that legal person and the registration number of the certificate of notification of the communication activity.
(3) The proposal for a technical interconnection solution means:
(a) design of the location of interconnection points (precise addresses and, if possible, specification of the building floor, room numbers, or a simple situation sketch according to the cadastral map) and the required network level of interconnection;
(b) the design of the number of circuits or interfaces for each interconnection point at the time of the start of operation and the estimation of their capacity requirement with a 2-year view;
(c) draft specification of the equipment to be used for interconnection;
(d) design of electrical and physical parameters, transmission and signalling protocol of the interface for interconnection of networks according to standards or specifications (Section 62 of the Act), data needed to ensure interoperability of services in interconnected networks, data to ensure other functions that the interface allows, and evidence of verification of the technical capability of the interface of equipment;
(e) the draft numbering and, where appropriate, the network address details relevant to the type of interconnected services and the operator's identification number;
(f) a proposal for a description of the network structure, the means of transmission used to the extent necessary for the conclusion of the interconnection contract, traffic routing data and the way in which the networks are synchronised;
(g) design of the volume of operational load for the start-up connection in 1 year and with a 2-year view, broken down by national and international traffic and by type of service required, indicating the expected level of operational load concentration; and
(h) a proposal for testing.
(4) The proposal for prices and other trading conditions means:
(a) the proposal for prices for the use of network elements, associated resources, services provided and for the establishment, modification and cancellation of interconnection;
(b) draft dates for testing interconnections, establishing interconnections and initiating service provision, including conditions for termination of services, including interconnections;
(c) design of solutions for failure and reduced interconnection quality; and
(d) a proposal for a case resolution not using the required capacity of network elements, associated resources or services.
(5) The specification of the measures and services required means:
(a) the specification of the service provided in cooperation between the Contracting Parties, including a brief description of the service parameters;
(b) the specifications of the technical and supervisory service for the operation of the network provided in cooperation between the Parties;
(c) the specification of the service provided to users;
(d) the specifications of the additional service; and
(e) specifications of the required measures aimed at meeting the network integrity and interoperability requirements of services.
(6) The design of the method of measuring traffic and the operational load between connected networks means:
(a) a proposal for measuring operating losses, quality and reliability of the service; and
(b) a proposal for measuring the operation carried out for billing.
§ 3
Efficacy
This Decree shall take effect on 1 May 2005.
