amending and supplementing Decree No. 136 / 1973 of the Government of the Czechoslovak Socialist Republic Coll., on State proceedings in the field of prices, as amended by Decree No. 72 / 1978 Coll.
The Government of the Czechoslovak Socialist Republic orders pursuant to § 18 (2) of Act No. 111 / 1971 Coll., on contributions to the state budget and social security contributions:
The Decree of the Government of the Czechoslovak Socialist Republic No. 136 / 1973 Coll., on State Price Procedure, as amended by the Government of the Czechoslovak Socialist Republic No. 72 / 1978 Coll., is amended as follows:
1. In Article 5 (5), the following sentence is added at the end:
"Specific provisions apply to the financial settlement of differences in the revaluation of stocks with government budgets.9) '.
2. in Article 11 (5), the following paragraph (b) is added:
"(b) 3% of the price of the standardisation plan task resulting in the technical standard according to which the product for which the provisional price limit was to be set is to be manufactured;"
The current provisions of point (b) shall become point (c).
3. The last sentence of Paragraph 12 (5) reads:
"This provision shall not apply to the additional contributions provided for in Article 11 (3), (4), first sentence, and (5), and to the additional contributions received by the investor from non-own resources or loans to reimburse the funds requested by the supplier unduly as a result of a breach of price regulations. 10)."
4. In Paragraph 12 (9), the following sentence is added at the end:
"However, for commercial, sales and supply organisations and other organisations entrusted with commercial, sales and supply performance, the additional levy or, where applicable, the increase shall be subject only to the amount by which their trade or sales premium or withholding has increased and any other amounts of asset gain resulting from the breach of price regulations. This shall be without prejudice to the validity of Article 11 (4) and (5) for those organisations. ';
5. After Paragraph 13, the following Section 13a is inserted:
Additional levy on products with insufficient export efficiency
The additional levy on products whose price disadvantage is determined on the basis of export prices shall not exceed 30% of the wholesale price or, where appropriate, the registered wholesale price. The definition of the scope of the products and the method of calculating the amount of the additional levy in accordance with the prices achieved, or the shares in the additional levy for production organisations and for foreign trade organisations, shall be laid down by a separate decision. ';
6. Paragraph 13a is renumbered 13b.
1. For the Standardisation Plan, the additional levy referred to in Article 11 (5) (b) shall be imposed from 1981 onwards.
2. The increase in the additional levy provided for in Article 12 (5) shall not apply in the cases referred to in Article 11 (4) and in the cases of the drawing-up of investment funds by an investor from other than own resources or loans to cover the funds requested by the supplier unjustly, unless the contribution referred to in Article 11 has been imposed before the entry into force of this Regulation.
The Prime Minister of the Czechoslovak Socialist Republic is hereby authorised to declare in the Collection of Laws the full text of the Order of the Government of the Czechoslovak Socialist Republic No. 136 / 1973 Coll., on state proceedings in the field of prices, as follows from the amendments and additions made by the Government of the Czechoslovak Socialist Republic No. 72 / 1978 Coll. and by this Regulation.
This Regulation shall enter into force on 1 January 1981.
