on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on mutual cooperation in the field of mining and rescue services
On 16 December 1959, the Agreement between the Government of the Czechoslovak Republic and the Government of the People's Republic of Poland on mutual cooperation in the mining rescue service was signed in Katowice.
The Government of the Czechoslovak Republic approved the Agreement on 4 March 1960. The approval of the Agreement by the competent authorities of the People's Republic of Poland was communicated by a note dated 18 February 1960 and its approval by the Government of the Czechoslovak Republic by a note dated 17 May 1960.
Pursuant to Article 10 of the Agreement, the Agreement entered into force on 17 May 1960.
The Czech version of the Agreement is hereby published at the same time.

AGREEMENT
between the Government of the Czechoslovak Republic and the Government of the Polish People's Republic on mutual cooperation in the branch of the Mining Rescue Service
Government of the Czechoslovak Republic and Government of the Polish People's Republic
led by a desire to establish close cooperation on the mining rescue service section, they decided to conclude this Agreement and appointed to that end their agents:

Jana Mitrega, Minister of Mining and Energy,
Those who exchanged their powers of authority, which they found to be right and in due form, have agreed on the following:
The Contracting Parties shall provide each other, on request, with mutual active assistance in rescue work on coal mines.
The assistance will be provided through the main mining rescue stations of each of the Contracting Parties, namely: for the benefit of the stone-coal mines of the Czechoslovak Republic of Ostrava-Karvinsky and Trutnovsky via the Main Mining Rescue Station in Bytomi and for the benefit of the stone-coal mines of the Polish People's Republic through the Main Mining Rescue Station in Ostrave- Radvanice.
The main mining rescue stations of the Contracting Parties shall exchange schematic drawings of the situation of mines that are eligible for assistance with the designation of access routes to mines since the crossing of state borders.
The provision of active assistance shall be carried out by sending a necessary rescue corps to the territory of the other Contracting Party for assistance in order to participate in a rescue operation.
The main mining rescue station of one Contracting Party requests assistance by telephone.
Phone calls concerning the request for assistance will be referred to as "safety of human life 'in accordance with the relevant provisions of the International Telephone Code. The competent authorities of both Contracting Parties shall issue national guidelines to guarantee a rapid telephone connection between the said Main Mining Rescue Stations.
In order to provide assistance as quickly as possible, the emergency services may cross national borders at any border crossing point closest to the mine in need of assistance.
The main mining rescue station sending assistance shall immediately inform the competent border authorities.
The head of a rescue team crossing national borders shall carry a list of all members of the rescue team and submit it to the border authorities, upon request, to carry out checks on persons crossing national borders. For every rescue vehicle crossing the state border, the commander of the corps will have a list of the tools and materials carried.
The return journey shall be carried out by the emergency services after a secure border crossing where they are subject to border and customs control.
During the stay in the second The Parties shall comply with the legislation in force in this territory.
Rescue corps fire-fighting vehicles have the right to use red and special warning horns on the territory of the other Contracting Party. Other vehicles have the right to use blue colour warning lights with corresponding alarm sirens.
Members of the Liaison Rescue Corps The main mining rescue stations of the other Contracting Party shall be insured for illness and shall have pension insurance in accordance with the legislation in force in the territory of the Contracting Party whose main mining rescue station has sent assistance, in conformity with the Convention between the Czechoslovak Republic and the Republic of Poland on Social Insurance signed in Warsaw on 5 April 1948.
The main mining rescue centre requesting the provision of assistance shall ensure, free of charge, necessary medical emergency assistance to the members of the requested rescue corps, as well as treatment to the extent and time strictly necessary for their stay in the territory of the Contracting Party whose main mining rescue centre has requested assistance.
All expenses incurred as a result of the provision of assistance shall be charged to the Main Mining Rescue Station or to the other relevant organisation of the Contracting Party whose Main Mining Rescue Station has requested assistance, in particular by:
1. They shall hold the Main Mining Rescue Station or any other relevant organisation of the Contracting Party providing assistance:
(a) any wage requirements of the members of the rescue corps incurred during the period from leaving the Main Mining Rescue Station, which provides assistance until return to that station;
(b) transport costs for the site of the rescue and recovery action, including any costs of non-fault damage on vehicles;
(c) the value of the material consumed supplied by the Main Mining Rescue Station providing assistance;
(d) costs incurred in connection with the payment of social security pensions or sickness insurance benefits to members of the rescue service where the payment has taken place in connection with a disease or accident which has arisen as a result of the provision of rescue aid;
(e) the cost of compensation for accidents at work suffered by members of the rescue service in the course of their work or on their way to the place of rescue or return, provided that such costs are borne by the employer, irrespective of the claims due to the injured party under the heading of social security referred to in Article 5 of this Agreement. The payment shall be determined in accordance with the provisions of the Contracting Party from which the Rescue Corps originates;
(f) the cost of transporting a sick or deceased member of the rescue service.
2. It shall pay all taxes and charges on the amounts referred to in point 1 of this Article, provided that they have been imposed by the competent authorities of the Party providing assistance.
3. It shall provide members of the rescue service with free catering, accommodation, washing, cleaning and repair of laundry and clothing, as well as payment of the allowance provided for.
4. It shall provide, where necessary, a rescue corps with propulsion agents for rescue vehicles, as well as ensuring the necessary repair of rescue vehicles and tools.
In addition, the Main Mining Rescue Station shall pay assistance to the requesting Main Mining Rescue Station, providing remuneration for participation in a rescue operation, belonging to the members of the Rescue Corps, if such remuneration is granted.
All commitments arising from the provision of assistance in rescue operations will be settled under the non-commercial pay agreement between the Czechoslovak Republic and the People's Republic of Poland valid on due date. The time-limits and manner of settlement under the commitments referred to in Article 6 shall be agreed by the Contracting Parties' State Banks in agreement with the participating organisations.
The Contracting Parties shall exchange experience on the mining rescue service.
The scope of mutual exchange of experience will be determined by the framework annual plans drawn up by the Ministry of Fuel of the Czechoslovak Republic and the Ministry of Mining and Energy of the People's Republic of Poland on the basis of a protocol on direct economic and scientific and technical cooperation of scientific, research, design and economic organisations, adopted by the Czechoslovak-Polish Committee on Economic Cooperation.
Detailed provisions concerning mutual cooperation in the field of mining rescue will be set out in the Implementation Protocol agreed by the Main Mining Rescue Station in Ostrava-Radvanice and the Main Mining Rescue Station in Bytomi.
This Agreement shall be subject to the approval of the two Governments and shall enter into force on the date of the exchange of notes on its approval.
This Agreement shall be concluded for a period of five years from the date of its entry into force. It shall be extended for a further period of two years each time, unless either Contracting Party denies the Agreement at least six months before the expiry date.
