on the adjustment and extension of classes in public social insurance.
The Provisional National Assembly of the Czechoslovak Republic decided on the following Act:
Čl. I.
The Act of 9 October 1924, No 221 Coll., on the insurance of workers in the event of sickness, invalidity and old age, as amended by the Regulations amending it and supplementing it, is amended as follows:
1.
(1) Insurers shall be classified for sickness, disability and old-age insurance according to their earnings as follows:

(2) An insurer who usually works six days a week or whose period of employment with one employer usually does not exceed a week is classified according to the earnings per working day. If the insured person is working regularly seven days a week, he is to be classified according to the sixth part of the earnings earned per week. If the insured person is working in restricted operations, which is likely to last for more than four weeks consecutive in such a way that he is employed five or less days a week, he shall be classified according to the sixth part of the earnings achieved per week; if they are then alternated over weeks or longer periods in which the insured person is working, with weeks or longer periods in which he is not working, he shall be allocated according to the twenty-fourth part of the earnings achieved in four weeks.
(3) According to the weekly or monthly earnings, the insured person with whom fixed weekly or monthly salaries are agreed or fixed salaries determined over a longer period of time, excluding the number of working days, is included.
(4) An insurer whose earnings are determined in whole or in part by a different manner from that of the time (salary, group, benefits of third parties and others), or who has other irregular benefits, is to be classified in accordance with the average earnings likely to or usually due to week.
(5) An apprentice (volonter, intern) who either has no earnings at all or only benefits in kind is classified in the first class.
(6) The Minister for Labour and Social Welfare may, in an agreement with the Minister of Agriculture and the Supreme Bureau of Price and in Slovakia, also appoint a decree in the Official Gazette for each year for the purposes of sickness insurance, medium-day earnings for deputies, agricultural and forestry workers, agricultural families and agricultural apprentices. The earnings thus determined shall be paid for the purposes of invalidity and old-age insurance for daily earnings.
(7) The sickness insurance company may, in agreement with the employer and the race council, determine the way in which the average earnings of the insured persons referred to in paragraph 2, the last sentence and paragraph 4 will be collected. The agreed agreement shall be submitted within eight days to the Central Social Insurance Corporation, which may prohibit its further implementation within 30 days. If no agreement is reached, the Central Social Insurance Corporation may, after hearing the others, determine the way in which the average earnings of those insured persons will be established.
(8) The Central Social Insurance Corporation may, by hearing the Central Council of Trade Unions (Slovakia) and the representatives of the Employers' Trade Unions, determine for a certain period of time classes for groups of employees whose earnings depend on various random circumstances. Such a decision requires the approval of the Ministry of Labour and Social Welfare and the Social Welfare Authority in Slovakia.
(9) The value of natural benefits (§ 11) may qualify for a maximum of three classes, only two classes higher for household and apprenticeship helpers than for money.
2.
§ 95.
The sickness insurance company shall provide:
I. aid in sickness, namely:
1. insured persons free of charge medical assistance as well as the necessary medicines (medicines) and other therapeutic aids (medical treatment). Disability treatment shall be provided from the beginning of the illness until the disease lasts, but no more than one year from the date of removal from employment or from the date of withdrawal pursuant to § 17, paragraph 2.
Furthermore, the insured person is entitled to medical treatment of family members (§ 96);
2. an insurer who is unable to work for a disease which is not intended shall be granted from the fourth day of that incapacity, for a maximum period of 365 days, the following daily sick leave:

In determining the average daily earnings referred to in Paragraph 12 (6), the amount of the sickness allowance shall also be determined.
The period of illness preceding the onset of incapacity for work and during which only sick treatment is provided shall not be counted against the period for which sickness is paid. If the entitlement to sickness benefit is maintained, the right to medical treatment shall also be granted.
II. maternity assistance to insured women and wives of insured persons, namely:
A. Insurance:
1. Free assistance of the midwife and, if necessary, medical assistance (assistance for childbirth). A cash refund may be granted instead of the assistance of the midwife, the amount of which shall be determined by the statutes. This compensation may be paid directly to the midwife. These provisions shall also apply to abortion;
2. a one-off allowance for expenses incurred in the event of a fall-down or pregnancy of 100 Kčs. In the current birth of more than one child, the birth of each child is calculated separately. If not pregnant, 60 Kčs shall be paid as a contribution to the cost of the pregnancy difficulties;
3. Aid in six weeks equal to the sickness allowance (I, No 2) six weeks before birth and six weeks after birth, provided that the insured person is not entitled to sickness benefit and does not carry out work for hire. For the period during which six weeks after childbirth work for wages, only half of the aid in six weeks shall be granted. In any case, the aid in six Sundays shall be at least 10 CZK per day;
4. if they breast-feed their children, a breast-feeding allowance equal to half-sick (I, No 2), but not less than 5 Ccs per day until twelve weeks after birth.
The entitlement to maternity benefits shall be maintained if the insurance claim for pregnancy is withdrawn within 12 weeks prior to birth.
B. Insurers' wives:
1. Aid for childbirth to the same extent as for insured persons;
2. a one-off allowance (A, No 2) of 200 Kčs; unless she is pregnant, 150 Kčs shall be paid as a contribution to the costs of pregnancy difficulties;
3. six-month aid of 10 CZK per day for four weeks before birth and six weeks after birth;
4. a breast-feeding allowance of 5 Cds per day until 12 weeks after delivery.
Benefits are provided even if they are delivered within nine months of the death of the insured person. She's entitled to be pregnant or six Sundays.
K A and B:
The benefits listed under A, 2 to 4 and B, 2 to 4, are granted only if the insured person or her spouse has been insured for at least 180 days in the last 12 months prior to childbirth.
If a six-Sunday child dies at birth or when she is entitled to benefits, the remainder of the aid shall be paid in six Sundays and the suckling allowance until the entitlement is exhausted to care for the child.
III. Funeral benefits (replacement of funeral expenses), namely:
1. If the insured person has died at the time when he was entitled to benefits, or before six months have elapsed since the date on which his pay of the sickness was definitively suspended, the death allowance shall be the following:

The funeral fee will first pay the funeral expenses paid to the person who provided the funeral.
Any remainder shall be entitled to the spouse before the children, the children before the parents and those before the siblings if they live with the insured person at the time of his death in the common household. If they are not, the rest shall be for the insurance undertaking;
2. If a member of the family of an insured person (§ 96) has died not more than two years old, the insured person shall be entitled, if he has given him a funeral, to a funeral in the amount of Kčs 500.-, if he is a senior but not exceeding 14 years old, in the amount of Kčs 1.000.- and if he is a senior, in the amount of Kčs 1.300.-, if he is a wife, in the amount of Kčs 1.500.-.

(3) The increase amounts for each week shall be:

§ 121.
(1) If the insured person has died before the expiry of the waiting period (Paragraph 107), his survivors shall be entitled to compensation to be determined according to the class in which the insured person was classified on or before the date of death and shall be:

(2) If the insured person has died after the waiting period or if he has died of a pensioner who is entitled to an invalidity or old-age pension and if he is not entitled to the payment of a widow's pension, his survivors are entitled to a pension equal to twice the annual pension which would otherwise be payable to the widow. If the widow's pension is contested within two years of the death of the insured person (pensioner's pension), there will be a fall from the widow's pension of as many twenty-four payments as there are months left from the date of the widow's pension until two years after the husband's death. If the widow's pension and the pension are granted at the same time, but the widow's pension is contested from a later date than the date of death of the insured person (pensioner's pension), only as much as the twenty-four days of the total pension are payable as the months elapsed from the date of death of the insured person (pensioner's pension) to the date of the idea of the widow's pension.
(3) The survivors referred to in the preceding paragraphs shall be the widow (widower), if the circumstances referred to in § 115 (1) (a) and (c) are not present, children under 18 (§ 118), parents and grandfather and grandmother of the deceased. In doing so, the husband takes precedence over the children, if he takes care of them, the children over the parents and these over the grandfather and the grandmother. Parents and grandfathers and grandmothers are entitled to compensation only if they were mainly dependent on the pensioner.
(4) Children over 18 years of age and siblings shall be admitted in cases where they are considered to be viable if they are mainly dependent on the pensioner.
(5) If the sum of the payments of the pension paid to the widow's pension (widower's pension) is lower than the amount payable to the widow's (widower's) the amount by which the sum of the pension payments would exceed the amount of the pension payments; If a widow (widower) dies, this amount is paid to children under 18 years of age.
§ 122.
Entitlement to benefits shall cease if it is not exercised within two years of the death of the insured (pensioner).
6.
(1) The insurance premiums for invalidity and old-age insurance are:

Article 7 (159) (1) and (2) reads as follows:
(1) Insurance sickness insurance is 6% of the average daily earnings.
(2) If 6% of the average daily earnings are found not to be sufficient to cover the compulsory benefits, the level of the premium shall be determined by the Central Social Insurance Agency after hearing the sickness insurance undertaking.

A.
The Government Order of 15 March 1943, No 70 Coll., on insurance against brotherly treasuries, as amended by the regulations, is amended and supplemented as follows:
1. Section 62 (a) of the following text is inserted after Section 62:
§ 62 a).
(1) Insurers shall be classified in the following classes for the purpose of determining the amount of sickness according to their earnings:

(2) For determining the daily earnings, the sixth part of the earnings achieved per week or the twenty-fifth part of earnings per month is decisive.
2. § 64 is amended as follows:
(a) Paragraph 1 shall read as follows:
(1) An insurer who is unable to work for a disease which is not intentionally produced is entitled, if the disease persists for more than three days, from the first day of incapacity to work for the duration of the disease, but for a maximum of 365 days, to the following sickness days:

The funeral expenses will be set first. These will be set up for whoever arranged the funeral. If the remainder remains, the spouse, children, father, mother and siblings shall be entitled to it gradually if they were living with the insured person at the time of his death in the common household. If this is not justified, the rest of the county brotherly treasury will remain.
5. in Paragraph 69 (2) (a), the figure "100 K" shall be replaced by the figure "200 Kns" and the figure "60 K" by the figure "150 KCs," in point (b) the figure "5 K" by the figure "10 KCs" and in point (c) the figure "2.50 K" by the figure "5 KCs."

If a member of the family of an insured person (§ 80) has died not more than two years old, the insured person is entitled, if he has given him a funeral, the death allowance in the amount of Kčs 500.-, if it is the death of a senior but not exceeding 14 years, in the amount of Kčs 1.000.- and if it is the death of an older person, in the amount of Kčs 1.300.-, if it is the wife, in the amount of Kčs 1.500.-.
7. in Paragraph 90 (2), the figure "250 K" shall be replaced by the figure "1.000 Kčs" and the figure "500 K" by "1.500 Kčs."
8. In Section 122, the digits "3,000 K 'are replaced by" 5,000 Kcs'.

Outstanding.
§ 135.
(1) If the insured person died before the expiry of the waiting period, his survivors shall be entitled to a refund to be determined according to the class in which the insured person was classified on or before the date of death.
(2) If the insured person has died after the expiry of the waiting period, or if the traveller who enjoys the mining commission (full miner) has died, and if he is not entitled to the payment of the widow's commission, his survivors are entitled to a remuneration of twice the annual commission which would otherwise be payable to the widow.
(3) The survivors referred to in the preceding paragraphs shall mean the spouse, if the marriage has not been divorced out of his own or two-sided guilt, children under the age of 18 (§ 119), parents, and the grandfather and grandmother of the deceased. In doing so, the husband takes precedence over the children, if he takes care of them, the children over the parents and these over the grandfather and the grandmother. Parents and grandfathers and grandmothers shall be entitled to the allowance only if they have been mainly dependent on the insured person (provisionist) for their provision.
(4) Children over 18 years of age and siblings shall be admitted in cases where they are aware of the benefits, provided that they are mainly dependent on the insured (supporsionist) by nutrition.
§ 136.
The compensation shall be:

§ 1.

(2) For determining the daily earnings, the sixth part of the earnings achieved per week or the twenty-fifth part of earnings per month is decisive.
§ 2.
(1) An insurer who is unable to work for a disease which is not deliberately produced is entitled, if the illness persists for more than three days, from the first day of incapacity to work for a maximum period of 365 days, to the following sickness days:

(2) If the incapacity for work ends on a Sunday or a holiday recognised by law, the sickness allowance shall also be granted on that day.
(3) The period of illness preceding the onset of incapacity for work and during which only medical treatment is provided shall not be counted against the period for which sickness is paid.
(4) The right to sickness benefit rests if and when the insured person is paid a salary (salary). Employers' contributions to sick leave are not considered to be profitable even if they are based on a commitment.
§ 3.
(1) In childbirth, the insured persons receive:
a) free assistance of the midwife, and, if necessary, medical assistance (assistance for childbirth). A cash refund may be granted instead of the assistance of the midwife, the amount of which shall be determined by the statutes. This compensation may be paid directly to the midwife. These provisions also apply to abortion;
(b) a one-off allowance for expenses incurred in the event of a fall-down or pregnancy of 100 Kčs. In the current birth of more than one child, the birth of each child is calculated separately. If not pregnant, 60 Kčs shall be paid as a contribution to the cost of the pregnancy difficulties;
(c) aid in six Sundays equal to the sickness allowance (Section 2) six weeks before birth and six weeks after birth, provided that the insured person is not entitled to sickness benefit and does not carry out work for hire. For the period during which a six-Sunday worker works for wages, only half of the six-week support shall be granted. The aid in six Sundays shall be at least 10 CZK per day;
(d) if they are breast-feeding, a breast-feeding allowance of half-sick (§ 2) until twelve weeks after birth.
(2) Entitlement to maternity benefits is maintained if the insured person leaves pregnancy insurance within 12 weeks before birth.
(3) If a six-Sunday child dies during childbirth or when she is entitled to benefits, the remainder of the aid shall be paid in six Sundays and the suckling allowance until the entitlement is exhausted to care for the child's nutrition.
(4) The benefits referred to in paragraph 1 (b) to (d) shall be granted only if the insured person has been insured under public sickness insurance legislation in the last 12 months before childbirth for at least 180 days.
§ 4.
(1) If the insured person has died at the time when he was entitled to benefits, or before six months have elapsed since the date on which his final payment of the sickness benefit was terminated, the following shall be payable:

(2) Funeral shall be at the rate of death of a supporsionist of not more than 14 years of age:
§ 5.
(1) Family members of insured persons shall be assisted in childbirth under § 3 (1) (a).
(2) The following shall be granted to the spouses of insured persons:
(a) a one-off contribution [§ 3 (1) (b)] of 200 Kčs; if she is not pregnant, she shall be paid as a contribution to the cost of pregnancy problems 150 Kčs;
(b) six-month aid of 10 CZK per day for four weeks before and six weeks after birth;
(c) a breast-feeding allowance of 5 CZK per day until 12 weeks after delivery.
(3) If the insured person does not live up to the insurance case, the benefits referred to in paragraphs 1 and 2 shall also be granted to the spouse if the insured person's death occurred 300 days before the insurance case.
(4) Paragraph 3 (3) and (4) apply mutatis mutandis.
§ 6.
If a member of the family of a insured person or of a provisionist has died for a maximum of two years, the insured person or a provisionist shall be responsible for the death of the insured person, if he has given him the funeral, the death in the amount of Kčs 500.- if the death is not more than 14 years old, in the amount of Kčs 1.000.- and the death of the elderly, in the amount of Kčs 1.300.-, but the wife, in the amount of Kčs 1.500.-.
C.
The Act of 11 July 1922, No 242 Coll., on insurance at the Bohemian brotherly treasury, as amended by the regulations amending it and supplementing it, is amended as follows:
Article 1 (16a) (2) reads as follows:
(2) The allowance shall be determined according to the class in which the insured person was classified in sickness insurance at the time of the marriage or last before that period, and shall be:

Article 4 (22) (1) and (2) reads as follows:

(2) If a member of the family of an insured person (§ 32) has not more than two years of age, the insured person is entitled, if he has given him a funeral, to be paid in the amount of Kčs 500.- if it is the death of a senior but not exceeding 14 years, in the amount of Kčs 1000.- and if it is the death of an older person, in the amount of Kčs 1.300.- if it is the wife, in the amount of Kčs 1.500.-.

§ 72.
The funds needed to cover insurance benefits and administrative costs and to establish the funds necessary for the implementation of this Regulation shall be provided with insurance premiums and pension contributions.
6. Article 73 is amended as follows:
(a) Paragraph 1 shall read as follows:
(1) Monthly premiums are 6% of the average monthly service.
