THE LAW
of 15 March 2006
amending Act No. 19 / 1993 Coll., on the Government Administration of the Czech Republic in the field of punching and testing of precious metals, as amended by Act No. 309 / 2002 Coll., and Act No. 539 / 1992 Coll., on punching and testing of precious metals (Puncture Act), as amended
Parliament has decided on this law of the Czech Republic:
Amendment to Act No. 19 / 1993 Coll.
Act No. 19 / 1993 Coll., on the Government Administration of the Czech Republic in the field of punking and testing of precious metals, as amended by Act No. 309 / 2002 Coll., is amended as follows:
1. In Paragraph 1 (1), the first words "the Czech Republic 'are deleted and in the second sentence, the words" budgetary organisation' are replaced by the words "organisational component of the State '.
2. In Paragraph 1 (2), the word "Director 'is replaced by the word" President'.
3. in Article 4 (b), including footnote 5a:
"(b) allocates and cancels the production marks to producers of domestic goods (5), and assigns and cancels liability marks to traders importing foreign goods (5a),
(5a) Sections 46a and 47 of the punk law. '
4. In Section 4, at the end of the text in point (d), the words "and issue a certificate of entry of the jewellery alloy into the list of registered alloys' are added.
5. in Article 4, the following point (e) is inserted after point (d):
"(e) decide to retain the assigned mark or the mark of responsibility;"
Points (e) to (j) shall be renumbered as points (f) to (k).
6. in § 4 (f) and (j), the word "Czechoslovak" is replaced by "Czech."
7. in Article 4 (i), the words "goods' are replaced by the words" products and goods';
8. In Article 4, at the end of point (k), the dot is replaced by a comma and the following point (l) is added:
"(l) carry out other tasks arising from specific legislation."
9. In Paragraph 5 (1), the word "Director 'is replaced by the word" President'.
10. in Article 5 (3) (b), the word "Czechoslovak" shall be replaced by "Czech" and in paragraph (3) (c) the word "Director" shall be replaced by "President."
11. in Article 5 (4) (b), the word "Director" is replaced by the word "President."

13. in Article 6 (1), "§ 4 (b), (c) and (d)" is replaced by "§ 4 (b), (c), (d) and (e)";
14. in Article 6 (2), "(e) to (g)" shall be replaced by "(f) to (h) and (l)";
15. in Article 6 (3), "(f) and (g)" shall be replaced by "(g), (h) and (l)";
16. in Article 6 (4), the words "the Czech Republic" shall be deleted;
17. in Article 7, paragraph 2 is deleted;
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
18. The following Section 7a is inserted after Section 7, including footnotes 16a, 16b and 16c:
(1) The Ministry of the Interior shall provide the Punk Office with data on the population of the population from the information system for the administration of the punk inspection (4) and the register of producers and traders (16a); a resident means a natural person under special legislation16c). The Ministry of the Interior shall provide the Punk Office with data in electronic form in a way that allows remote access.
(2) The data provided under paragraph 1 shall be:
(a) State citizens of the Czech Republic
1. name (s) or surname (s), surname (s) or change thereof, surname (s),
2. date of birth,
3rd birth number,
4. the address of the place of permanent residence, including previous addresses of the place of permanent residence;
5. the date and place of death, if any, if any, of the death of a citizen outside the Czech Republic, the date of death and the State in whose territory the death occurred;
On the 6th day in the court's decision to declare himself dead,
(b) foreign residents
1. name (s) or surname (s), surname (s) or change thereof, surname (s),
2. date of birth,
3rd birth number,
4. type and address of residence,
5. Start of stay or date of termination of stay,
6. Date and place of death, or, where applicable, the date indicated in the court's decision on the death declaration as the date of death.
(3) Only such data as are necessary to fulfil the purpose may be used from the data provided in a particular case.
16a) § 40a of the punk law.
16b) Act No. 133 / 2000 Coll., on the registration of residents and birth numbers and on the amendment of certain laws (Act on the registration of residents), as amended.
16c) § 1 of Act No. 133 / 2000 Coll., as amended by Act No. 53 / 2004 Coll. '
Transitional provision
The Director of the Punk Office, who performed this function under Act No. 19 / 1993 Coll., on the Government Administration of the Czech Republic in the field of punking and testing of precious metals, as amended by Act No. 309 / 2002 Coll., is considered the President of the Punk Office under this Act.
Amendment of the punk law
Act No. 539 / 1992 Coll., on Punching and Testing of Precious Metals (Puncture Act), as amended by Act No. 19 / 1993 Coll. and Act No. 127 / 2003 Coll., is amended as follows:
1. In Paragraph 40a (1), the dot is replaced by a comma at the end of point (e) and the following point (f) is added:
"(f) a representation of the production mark (§ 46) and the liability mark (§ 46a), if assigned."
2. In Paragraph 40a (2), the words "a representation of the mark and the mark of responsibility 'shall be inserted after the words" an electronic address'. In addition, after the word "coupling 'and" comma', the words "and the representation of the mark and the mark of responsibility 'shall be replaced by" and the words' are added.
3. In Paragraph 41 (2), at the end of point (d), the sentence "For this purpose, goods and articles of materials other than precious metals shall be considered as goods if they are interchangeable in appearance with goods."
4. In Paragraph 50 (2), the words "if this designation was made by marks used on 1 May 2004 or later 'shall be added at the end.
EFFECTIVE
This Law shall take effect on the first day of the month following its publication.
