of 19 April 2005
on the formalities for the application for a test to demonstrate competence for the operation of radio broadcasting equipment, on the extent of knowledge required for each type of competence, on the method of conducting the tests, on the types of proficiency certificates and their duration
According to Article 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (the Act on Electronic Communications), the Ministry of Informatics provides for the implementation of Article 26 (5) of the Act:
§ 1
For the purposes of this decree:
(a) radio equipment stations such as one or more transmitters or a set of transmitters and receivers, including their accessories, needed at a given station to perform a given radio communications service;
(b) the operator of the person operating the station,
(c) an aircraft moving station other than a life-saving station on board an aircraft. The position on board the aircraft shall also be considered to be another location of the station which allows its use for the communication of a remote pilot on unmanned aircraft (6),
(d) the air station of the ground station of the air moving service, in some cases the air station may be located, for example, on board a ship or on a platform at sea;
(e) by an earth station located either on the surface of the Earth or in the main part of the earth's atmosphere and intended for connection by:
1. with one or more satellite stations; or
2. with one or more stations of the same kind using one or more reflective satellites or other objects in space,
(f) an aircraft earth station, a mobile earth station, a satellite aerial mobile service located on board an aircraft. The position on board the aircraft shall also be considered to be another location of the station which allows its use for the communication of a remote pilot on unmanned aircraft (6),
(g) by an air ground station, a land-based fixed satellite service station or, in certain cases, a satellite air mobile service located at a fixed point on land to implement modulation connections for satellite air mobile service;
(h) radio telephony on inland waterways mobile radio communications service between coastal stations and ship stations or between ship stations or between coastal stations serving to ensure the safety and operation of inland navigation1),
(i) a mobile station on inland waterways located on board a vessel which is not permanently anchored, other than a rescue vehicle, a mobile station or radio telephone service;
(j) coastal station of land station of maritime mobile services or radio telephone services on inland waterways;
(k) GMDSS (Global Maritime Distress and Safety System) worldwide maritime distress and security system providing radio communications within the maritime mobile service;
(l) an amateur radio communication service for self-education, mutual links and technical studies carried out by amateurs, that is to say, duly authorised persons interested in radio technology only from personal interest and non-profit;
(m) radio communication operation of the connection, line and termination of the radio link;
(n) radio-telephony service, radio-communications service or satellite-mobile service providing radio-telephony service;
(o) by radio-telephony operation, the operation ensuring the transmission of radio-telephony calls;
(p) by radio telephone, a telephone call coming from or intended for a moving station or a moving earth station, transmitted on its way through, in part or in full, radio communication channels of mobile services or satellite mobile services.
§ 2
Types of proficiency certificates
The following types of proficiency certificates shall be issued:
(a) a general licence for a mobile air traffic controller authorising its holders to operate an aircraft station, an aircraft station, an air station or an aircraft station in a radio-telephony service;
(b) a limited licence for a mobile air service radio operator authorising its holders to operate an aircraft station, an aircraft ground station, an air station or a station for the communication of remote pilots of unmanned aircraft in a radio-telephony service using radio frequencies allocated solely to an air mobile service or an air-mobile satellite service, provided that the station control consists solely in the operation of simple external controls, and only in the territory of the Czech Republic. Air traffic services shall not be provided when operating an air station;
(c) a general licence for a maritime mobile service operator (GOC - General Operator's Cerificate) authorising its holders to operate a ship's station, ship's land station or coastal station using all GMDSS frequency bands;
(d) a restricted licence for a maritime mobile service operator (ROC - Restricted Operator's Cerificate) authorising its holders to operate a ship's or coastal station using very short frequency bands of the GMDSS system;
(e) a general licence for a radio-telephony operator of a maritime mobile radio-telephony service authorising its holders to operate a ship's or coastal station in a maritime mobile service, without the use of elements of the GMDSS system;
(f) a limited licence from a maritime mobile radio operator authorising its holders to operate a marine mobile station at a distance of up to 20 nautical miles from the tide line officially recognised by the coastal State using only frequency bands of very short waves without the use of GMDSS elements, provided that the control of the station consists only in the operation of simple external controls;
(g) a land-based radio-telegraphy licence authorising its holder to operate a radio-telegraphic or radio-telephonic radio-communications service using short-wave frequency bands;
h) HAREC (Harmonised Amateur Radio Examination Certificate) card of the class operator And entitling its holders to operate an amateur radio service station,
(i) the NOVICE licence (including CEPT Novice Amateur Radio License) of the Class N operator authorising its holders to operate an amateur radio communications service,
(j) a general licence for a maritime mobile service operator (LRC - Long Range Certificate) authorising its holders to operate a ship's station using all GMDSS frequency bands which are not subject to GMDSS equipment;
(k) a limited licence of a maritime mobile service operator (SRC - Short Range Certificate) authorising its holders to operate a ship's station, using the frequency bands of very short GMDSS waves not subject to GMDSS equipment,
(l) a limited licence for an inland waterway radio operator authorising its holders to operate a marine or coastal station on inland waterways in the framework of a radio-telephony service, provided that the station control consists only in the operation of simple external controls.
§ 3
Forms of application for the proficiency test
(1) The written application for a proficiency test must include:
(a) the name and surname of the applicant;
(b) the date and place of birth;
(c) nationality,
(d) residence; and
(e) the type of competence required.
(2) Application for a proficiency test for the stations listed
(a) Paragraph 2 (c) and (d) shall be supported by evidence of the completion of the GMDSS course and practical training in the use of the GMDSS communication technique to the extent required under the CEPT Decision in its current version (2) and by an international contract, which is binding on the Czech Republic (3), which shall be issued to the applicant by the training centre recognised by the IMO, and by evidence of the achievement of secondary vocational education;
(b) in Article 2 (j) and (k), it shall be supported by evidence of practical training in the use of the GMDSS communication technique to the extent required by the CEPT Recommendation in the current version (4) and by an international contract, which is the Czech Republic binders (3), which shall issue the applicant with a training centre recognised by the Ministry of Transport of the Czech Republic,
(c) in Sections 2 (a) to (g), (j) to (l), the photograph must be documented; for the technical execution of the photograph, the provisions of the special legislation on the requirements for the technical execution of the photograph for the issue of the ID (5) shall apply mutatis mutandis.
§ 4
Scope of proficiency test knowledge
(1) The Czech Telecommunications Authority (hereinafter referred to as "the Office") verifies the applicant's knowledge in the proficiency test
(a) radio communications regulations;
(b) radio communications operations; and
(c) electrical engineering and radiotechnology.
(2) The required knowledge referred to in paragraph 1 shall be consistent with the standards of knowledge set out in the recommendations of the international organisations ITU8), CEPT9), IMO10), ICAO11), or IARU12) (Region 1) for the relevant competence.
(3) Part of the test for the operation of the stations listed
(a) in Article 2 (a), (c), (d), (e), (f), (j) and (k), the verification of the knowledge of radio-telephony communication in the English language, including aerial or marine frazeology;
(b) in § 2 (b), the verification of the knowledge of radio-telephonic communication is in the Czech language, including aerial frazeology,
(c) in § 2 (g) there is a practical test of telegraphy; at the request of the applicant, the Authority shall also allow the applicant to carry out the telematics examination and the applicant who requires it to be carried out in the framework of the station operator test referred to in § 2 (h) and (i);
(d) in § 2 (l) there is verification of knowledge of radio-telephonic communication in the Czech language including maritime frazeology.
§ 5
Method for conducting proficiency tests
(1) The examination committee of the Office shall verify the competence of station operators. The members of the Examination Board and its Chairman shall be appointed and removed by the President of the Council of the Office.
(2) The pre-Office examination is in writing, unless this decree provides for an oral or practical examination for specific cases.
(3) The written examination will take the form of a test. The questions in the test must correspond to the extent of the knowledge referred to in Section 4 (2). Three answers are assigned to each question in the test, one of which is always correct. A question for which only one correct answer has been selected and identified shall be regarded as the question correctly answered.
(4) The oral examination shall take place for the verification of knowledge referred to in Article 4 (3) (a) and (b), practical for the verification of knowledge referred to in Article 4 (3) (c).
(5) The examination shall normally take place at the seat of the Office.
(6) The date, time, duration and place of test are hereby declared by the Office. However, the examination may be carried out not earlier than 30 days after the date of publication of the application for the test, but at the latest 20 days before the date of the examination requested by the tenderer.
(7) The Office shall inform the applicant in writing of the date, time, duration and place of the examination at least 14 days before the date of the examination.
(8) The text of all questions for written tests, broken down according to the professional competence referred to in Article 2, including the correct answers to each question and outline of oral examinations, shall be published by the Office on the electronic official record (Section 125 (3) of the Act) and on its website.
§ 6
Progress and assessment of the outcome of the proficiency test
(1) The Chairman of the Examination Committee shall direct and monitor the examination.
(2) The result of the knowledge test referred to in Article 4 (1) and (3) shall be assessed separately, with the degree "benefit 'or" benefit'.
(3) The test shall be initiated by a written test. If the applicant is assessed by a "non-profit 'from the written test, he shall not continue the further part of the test referred to in Article 4 (3). If the applicant who has not benefited from the written test asks for it to be repeated, the Office shall allow him to repeat the written test not earlier than 60 days from the date of its failure. If an applicant who has not benefited from the oral or practical part of the examination asks for it to be repeated, the Office shall allow him to repeat the oral or practical part of the test without the need to repeat the written test at the earliest time of the announced examination, but not earlier than 14 days after the date of failure to perform the oral or practical part of the test.
(4) The candidate has passed the test if he has demonstrated the prescribed knowledge and has been assessed by the degree of "benefit" in the knowledge test referred to in Article 4 (1) and (3).
(5) If the candidate has not completed the examination within 6 months of the date of the start of the written examination, he may only perform the new examination on the basis of the submission of a new application pursuant to Section 3.
(6) The test result shall be recorded by the test panel in the test report. The completed written test, signed by the applicant, is annexed to this Protocol. Each protocol shall be endorsed by the signature of the Chairman of the Examination Committee.
(7) The test panel shall inform the candidate without delay of the outcome of the examination.
§ 7
Issue of a professional licence
(1) Proving professional competence (Paragraph 26 (4) of the Law) means performing the test successfully.
(2) The certificate of proficiency referred to in:
(a) Article 2 (a) to (g), (j) to (l) shall be published bilingual, Czech and English. It shall contain:
1. the name and surname of the licence holder;
2. the date of birth of the licence holder,
3rd licence number,
4. the provision that the licence holder has demonstrated the knowledge required by the ITU, ICAO, IMO or CEPT recommendations;
5. the date of issue and the period of validity of the licence;
6. a photograph of the licence holder and his signature;
7. name of the Office;
(b) in § 2 (h) it is published in four languages, in the Czech, German, French and English languages. It shall contain:
1. the name and surname of the licence holder;
2. the date of birth of the licence holder,
3rd licence number,
4. the provision that the licence holder has demonstrated the knowledge required by the CEPT Recommendation;
5. the date of issue and the period of validity of the licence;
6. name of the Office,
(c) Article 2 (i) shall be published in four languages, in the Czech, German, French and English languages. It shall contain:
1. an indication that it is a document corresponding to the CEPT Novice Amateur License,
2. the provision that the licence holder has demonstrated the knowledge required by CEPT7),
3. the name and surname of the licence holder,
4. the date of birth of the licence holder,
5. licence number,
6. the date of issue and duration of the licence,
7. name of the Office.
(3) The models of the proficiency certificates referred to in Article 2 shall be published by the Office on an electronic official plate.
§ 8
Duration and scope of validity of proficiency certificates
(1) Duration of the licence
(a) Paragraph 2 (h) and (i) is unlimited;
(b) in Article 2 (a), (b), (e) to (g), (j) to (l), it shall be 10 years at first issue; after the first period of validity, the validity of the licence shall be five years;
(c) Article 2 (c) and (d) shall be five years at first issue; after the first period of validity, the validity of the licence shall be five years.
(2) The applicant for the extension of the validity period of the licence referred to in § 2 (a) to (g), (j) to (l) shall support the application by confirming that, during the period of validity of the licence, he has been operating for at least one year by the operator of the station for which that type of licence is required.
(3) In the event of loss, damage or destruction of a professional licence, the Office shall issue a duplicate at the written request of its holder.
§ 9
Efficacy
This Decree shall take effect on 1 May 2005.
