amending and supplementing Act No. 142 / 1961 Coll., on the disciplinary liability of professional judges
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
Act No. 142 / 1961 Coll., on the disciplinary liability of professional judges, is amended as follows:
1. In Section 1, the words "Czechoslovak Socialist Republic" are deleted in the first sentence.
2. Article 3 (1) reads as follows:
"(1) The disciplinary proceedings are carried out by the disciplinary chambers of the Regional Courts, the Supreme Courts of the Republics and the Supreme Court of the Czechoslovak Socialist Republic."

"(2) The disciplinary proceedings against the judges of the regional courts and the supreme courts of the Republic shall be conducted by the disciplinary panel of the competent Supreme Court of the Republic. ';
4. In Article 5, paragraph 3 is added:
"(3) The disciplinary proceedings against the judges of the Supreme Court of the Czechoslovak Socialist Republic are carried out by the disciplinary panel of that court."
5. Article 6 (1) reads as follows:
"(1) The disciplinary procedure shall be initiated on application by:
(a) the President of the Supreme Court of the Czechoslovak Socialist Republic against any judge of that court;
(b) the Minister of Justice against any Judge of the courts of the Republic concerned;
(c) the President of the Supreme Court of the Republic against any Judge of the Supreme Court of the Republic;
(d) the President of the Regional Court against any Judge of the competent Regional Court or the District Court in its district;
(e) the President of the District Court against any Judge of the competent District Court. "

The President of the court seised of disciplinary action against a judge of the courts of the Republic, the Ministry of Justice of the Republic concerned, shall inform the President of the court seised of the opening of disciplinary proceedings and the time of hearing the case before the Board of Appeal. ';

The decision of the Board of Appeal shall be served on the Judge against whom the disciplinary proceedings are brought, the institution which has proposed the opening of the disciplinary proceedings and, if the judge of a court of the Republic is concerned, the Ministry of Justice of the Republic concerned. ';
8. The second sentence of Paragraph 15 (1) reads as follows:
"An appeal having suspensory effect shall be decided by the Board of Appeal of the Supreme Court of the Republic. '

"(4) No appeal may be brought against the decision of the census of the Supreme Court of the Republic of Czechoslovakia and the census of the Supreme Court of the Czechoslovak Socialist Republic. '
10. in Article 17 (b):
"(b) a measure has been imposed in proceedings before a national committee or other State body because it has committed an infringement."
11. In Paragraph 18, the first sentence reads:
"The provisions of this Act do not apply to judges of military courts and to military judges of the Supreme Court of the Czechoslovak Socialist Republic."
12. The following shall be inserted after Paragraph 18:
Unless otherwise provided for in this law, the provisions of the Code of Criminal Procedure shall apply mutatis mutandis in disciplinary proceedings. '
(1) Until the date on which the Supreme Courts of the Republics and the Supreme Court of the Czechoslovak Socialist Republic will be established, their jurisdiction in disciplinary matters shall be exercised by the Supreme Court in accordance with the existing provisions.
(2) No disciplinary action shall be taken against a judge who has been lawfully imposed before the application of this law for the same act of action in proceedings before a local court of the people because he has committed a crime.
This Act shall take effect on 1 January 1970.
