GOVERNMENT REGULATION
of 15 June 2022
laying down certain conditions for the implementation of exceptional adjustment aid for producers in agricultural sectors in 2022
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Subject matter
This Regulation provides for certain conditions for the implementation of exceptional adjustment aid for producers in agricultural sectors in 2022 ("exceptional aid ') following the directly applicable European Union1 Regulation. The State Agricultural Intervention Fund (" the Fund').
Request for emergency support
(1) The Fund will provide exceptional support upon request
(a) the breeding of sows;
(b) chickens reared for meat production;
(c) breeding of cows kept in a system of dairy farming ("dairy cows"),
(d) for apple growers, or
(e) for potato growers.
(2) The application for exceptional aid for sows shall include the provision of information on compliance with the conditions laid down in Article 3 (1).
(3) The application for exceptional aid for the production of chickens reared for meat shall include the provision of information on compliance with the conditions laid down in Article 4 (1).
(4) The application for exceptional aid for dairy cows shall include the provision of information on compliance with the conditions laid down in Article 5 (1).
(5) The applicant will submit to the Fund an application for emergency support by 30 June 2022 at the latest on the form issued by the Fund.
Conditions for granting exceptional aid for sows
(1) An applicant for exceptional aid for sows may be a natural or legal person who:
(a) ensure the processing of part of the manure produced at the biogas station between 1 January 2022 and 31 March 2022;
(b) has received aid financed exclusively from national resources under Section 2d of the Agricultural Act in the subsidy sub-programme 20.C.b. for the financial year 2021 Support for improving the stables microclimate of pigs,
(c) submit a decision granting an integrated authorisation pursuant to the provisions of Section 13 (3) of the Integrated Prevention Act;
(d) it is registered on the date of receipt of the application for emergency support as a person engaged in organic farming under the Organic Agriculture Act; or
(e) has submitted a certificate by the treating veterinarian that it has improved the environment between 1 January 2022 and 31 March 2022 by using certified biotechnology products which reduce ammonia emissions.
(2) The Fund shall grant the applicant exceptional support referred to in paragraph 1 to the average number of sows established as the arithmetic average of the number of sows recorded in the central register under the breeding law (hereinafter referred to as "central register") for the period from 1 January 2022 to 31 March 2022, provided that the average number was at least 3 sows.
Conditions for granting exceptional aid for chickens reared for meat production
(1) An applicant for exceptional aid for the production of chickens reared for meat may be a natural or legal person who:
(a) ensure that part of the poultry manure produced is processed in a biogas station during the period 1 January 2022 to 31 March 2022;
(b) has received aid financed exclusively from national resources under Section 2d of the Agricultural Act under the subsidy scheme 20 during the subsidy period of 2021. B.d. Support for improving the stable microclimate of poultry,
(c) submit a decision granting an integrated authorisation under the provisions of Section 13 (3) of the Integrated Prevention Act; or
(d) is registered on the date of receipt of the application for emergency support as a person engaged in organic farming under the Organic Agriculture Act.
(2) The Fund grants exceptional support to the applicant
(a) in accordance with paragraph 1 (a), (b) or (c), to chickens reared for meat according to the number of chickens sold for meat during the period 1 January 2022 to 30 April 2022; or
(b) in accordance with paragraph 1 (d), to chickens reared for meat according to the number of chickens sold for meat during the period 1 October 2021 to 30 April 2022,
provided that he has sold at least 500 chickens kept for meat and that he has provided proof to the Fund of the proof of the sale of those chickens.
Conditions for granting exceptional aid for dairy cows
(1) The applicant for exceptional aid for dairy cows may be a natural or legal person who:
(a) ensure the processing of part of the manure produced or other manure from dairy farming at the biogas station during the period 1 January 2022 to 31 March 2022;
(b) has received aid financed exclusively from national resources under Article 2d of the Agricultural Act under the subsidy scheme 19 during the subsidy period of 2021. A Aid for the participation of producers and milk processors in the quality regime Q CZ,
(c) has received aid financed exclusively from national resources under Section 2d of the Agricultural Act in the subsidy sub-programme 20.A.c. for 2021. Aid for the reduction of harmful pathogenic micro-organisms in dairy cows' stables
(d) has received aid under Section 28 of Government Decree No. 50 / 2015 Coll., laying down certain conditions for granting direct payments to farmers and amending certain related government regulations, as amended, while respecting a minimum ratio of 0,2 LU / ha of protein crop area in 2021 to the number of dairy cows kept in the central register on 31 March 2022;
(e) has received a subsidy under Section 10 of Government Decree No. 74 / 2015 Coll., on the conditions for granting subsidies for animal welfare measures, as amended;
(f) it is registered on the date of receipt of the application for emergency aid as a person engaged in organic farming under the Organic Agriculture Act; or
(g) in the land use register according to the user relations provided for in Article 3a of the Agriculture Act (hereinafter referred to as the "Soil Registration Act") on 31 March 2022, it has managed permanent grassland for its own production of bulk fodder for dairy cows, while respecting a minimum intensity of 0,2 LU / ha of the number of dairy cows kept in the central register for permanent grassland.
(2) The Fund shall grant to the applicant the exceptional aid referred to in paragraph 1 for the average number of dairy cows raised as an arithmetic average of the number of dairy cows recorded in the central register during the period from 1 January 2022 to 31 March 2022, provided that the average number was at least 3 dairy cows.
Conditions for granting exceptional aid to apple growers
(1) The applicant for exceptional aid for apple growers may be a natural or legal person who:
(a) has been included in the sub-paragraph of Section 12 of Government Regulation No 75 / 2015 Coll., on the conditions for the implementation of agri-environmental climate measures and amending Government Regulation No 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended, as amended, or under Section 10 of Government Regulation No 330 / 2019 Coll., on the conditions for the implementation of subsequent agri-environmental measures, as amended; or
(b) is registered on the date of receipt of the application for emergency support as a person engaged in organic farming under the Organic Agriculture Act.
(2) The Fund grants to the applicant exceptional support under paragraph 1 (a) for the area of the fruit orchard held on 31 December 2021 in the fruit orchards register under Article 3q of the Agriculture Act ("fruit orchards register") with the fruit apple tree species provided that the minimum area of the fruit orchard with the fruit apple tree species registered on 31 December 2021 was at least 0,5 ha.
(3) The Fund shall grant to the applicant the exceptional aid referred to in paragraph 1 (b) for the area of the fruit orchard which is managed under the intensive fruit scheme and which was kept on the record of land with fruit-type apple trees on 31 December 2021, provided that the minimum area of the fruit-type orchard registered on 31 December 2021 was at least 0,5 ha.
Conditions for granting exceptional aid to potato growers
(1) The applicant for exceptional aid for potato growers may be a natural or legal person who:
(a) has submitted an application for aid financed exclusively from national resources for the subsidy period of 2021 under Section 2d of the Agricultural Act in the subsidy programme 19. C Aid for the participation of producers and processors of table potatoes in the quality regime Q CZ,
(b) is registered on the date of receipt of the request for emergency support as a person operating in organic farming under the Law on organic farming and received a subsidy under Article 9 of Government Regulation No 76 / 2015 Coll., on the conditions for implementing organic farming measures, as amended, or pursuant to Article 8 of Government Regulation No 331 / 2019 Coll., on the conditions for implementing the subsequent organic farming measure, as amended; or
(c) has received aid under Section 24 of Government Decree No. 50 / 2015 Coll., as amended.
(2) The Fund shall grant to the applicant exceptional support under paragraph 1 (b) for an area covered by Article 9 of the Government Regulation No 76 / 2015 Coll., as amended, or under Article 8 of the Government Regulation No 331 / 2019 Coll., as amended, provided that the minimum size of the potatoes for which the subsidy was granted was at least 1 ha.
(3) The Fund grants to the applicant exceptional support under paragraph 1 (c) for an area as referred to in Article 24 (5) of Decree-Law No 50 / 2015 Coll., as amended, provided that the minimum area of table potatoes for which such aid was granted was at least 1 ha.
Publication of the exceptional aid rate
The amount of the emergency aid rate for the production of sows per sow per sow in accordance with § 3, the rate of the emergency aid for the production of chickens reared for meat per chicken in accordance with § 4, the rate of the emergency aid for dairy cows per dairy cow in accordance with § 5, the rate of the emergency aid for apple growers per ha of apple tree in accordance with § 6 and the rate of the emergency aid for table potato growers per ha of potatoes in accordance with § 7 shall be published by the Fund by 15 August 2022 at the latest in a manner enabling remote access.
Refusal of aid application
The Fund shall reject the application if it finds that:
(a) the applicant has received an application for emergency aid after the period laid down in Article 2 (5); and
(b) the applicant has not complied with the conditions for granting exceptional support.
Efficacy
This Regulation shall take effect on 20 June 2022.
