amending Act No. 121 / 2000 Coll., on copyright law, copyright law and amending certain laws (copyright law), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 121 / 2000 Coll., on copyright law, on copyright law and on the amendment of certain laws (Copyright Act), as amended by Act No. 81 / 2005 Coll., Act No. 61 / 2006 Coll., Act No. 186 / 2006 Coll., Act No. 216 / 2006 Coll., Act No. 168 / 2008 Coll., Act No. 41 / 2009 Coll., Act No. 227 / 2009 Coll., Act No. 153 / 2010 Coll., Act No. 424 / 2010 Coll., Act No. 420 / 2011 Coll., Act No. 375 / 2011 Coll., Act No. 18 / 2012 Coll., and Act No. 496 / 2012 Coll., is amended as follows:
1. Paragraph 100 (1) shall be added at the end of the text in point (j) "; the rates of remuneration laid down by law and the remuneration for the different uses shall always be indicated without value added tax '.
2. In Paragraph 100a, at the end of paragraph 1, the words "or if at least one of the relevant collective administrators has received a written request for the appointment of a joint representative in accordance with Paragraph 101 (11), for as long as such representative is authorised 'shall be added.
3. Paragraph 101 (11) reads as follows:
"(11) In the event that a user of a protection object enters into contracts for the purpose of granting the right to exercise the right to use the protection object for which at least two collective trustees are collectively administered by such a right, that user shall be entitled to request in writing any of them to entrust the relevant collective trustee with the conclusion of a single joint representative agreement in accordance with Paragraph 97 (5); the collective trustee to whom the application for the mandate of the joint representative has been received shall immediately inform all relevant collective trustee of that request. The first sentence shall apply mutatis mutandis in the case of the conclusion of collective agreements referred to in paragraph 4 and in the case of the recovery of a claim for damages or of an unjustified enrichment where such claim has not already been brought before the courts. In order to appoint a joint representative of collective trustees under this provision, the effective exercise of collective management shall be monitored. ';
Efficacy
That law shall take effect on the first day of the calendar month following its publication.
