THE LAW
of 7 May 2009
amending Act No. 310 / 2006 Coll., on the treatment of certain items usable for defence and security purposes in the Czech Republic and amending certain other laws (Act on the Management of Security Material), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 310 / 2006 Coll., on the treatment of certain items usable for defence and security purposes in the Czech Republic and amending certain other laws (Act on the Management of Security Material), as amended by Act No. 296 / 2007 Coll. and Act No. 274 / 2008 Coll., is amended as follows:
1. In Section 4, the following paragraph 5 is added:
"(5) The integrity shall be demonstrated by a record of the Register of Penalties. The competent police department shall request an extract from the record of the Register of Penalties under the special legislation 9a). An application for an extract from the Register of Penalties and an extract from the Register of Penalties shall be sent in electronic form in a way that allows remote access.
9a) Act No. 269 / 1994 Coll., on the Register of Penalties, as amended. '
2. In Article 5, the following paragraph 2 is inserted after paragraph 1, including footnote 10a:
"(2) Sensitive activity under special legislation10a) shall be considered as:
(a) the treatment of security material of groups 1, 5, 6 or 10 listed in the Annex to this Act or of radioactive passive surveillance systems by a natural person in business;
(b) the performance of the function of the natural person's responsible representative in the activity referred to in (a);
(c) the performance of the function of a member of the statutory body, a member of the Supervisory Board, a curator, a responsible representative, if provided, of a legal person handling the security material of groups 1, 5, 6 or 10 listed in the Annex to this Act or of radiological passive surveillance systems.
10a) Act No. 412 / 2005 Coll., on the protection of classified information and on security competence, as amended. '
Paragraph 2 shall become paragraph 3.
3. In Section 5 (3) of the Introductory Part of the provision, the words "or with radioactive passive monitoring systems' shall be inserted after the word" the law '.
4. in Article 5 (3) (a) and (b), the words "natural persons under special legislation11)" shall be replaced by the words "natural persons or a valid natural person certificate under special legislature11";

"11) Sections 54 and 80 of Act No. 412 / 2005 Coll. '.
5. In Section 8, at the end of the text of paragraph 1, the words "and the radiological passive monitoring systems' shall be added.
6. in Article 14 (3), the following point (c) is inserted after point (b):
"(c) require the presentation of a valid document of safety competence or a valid certificate of a natural person in the cases referred to in Article 5 (3),";
Point (c) shall be renumbered (d).
7. In Article 16 (2) (b), "Article 5 (2) 'is replaced by" Article 5 (1) or (3)'.
8. Part Two, including the title, is deleted.
Transitional provisions
1. A natural person who, at the date of entry into force of this Act in his or her business, treats radiolating passive monitoring systems shall, within 6 months of the date of entry into force of this Act, request the issuance of a document of the security competence of a natural person or a certificate of a natural person pursuant to Act No. 412 / 2005 Coll., on the protection of classified information and on the security competence, if not already held by him; This also applies to the responsible representative, if established.
2. The legal person who, on the date of entry into force of this Act in the course of his business, treats radiological passive monitoring systems shall ensure that the statutory authority or members of the statutory body, the members of the Supervisory Board, the prosecutors and the responsible representatives, if established, apply within 6 months of the date of entry into force of this Act for the issue of a document of the security competence of a natural person or a certificate of a natural person pursuant to Act No 412 / 2005 Coll., on the protection of classified information and on the security capability, if it is no longer its holder.
Efficacy
That law shall take effect on the first day of the second calendar month following its publication.
