amending Decree No 382 / 2003 Coll., on animal health requirements for trade in animals and on animal health conditions for their importation from third countries, as amended by Decree No 260 / 2005 Coll., and repealing Decree No 383 / 2003 Coll., on animal health conditions for imports of certain animal products from third countries
The Ministry of Agriculture provides pursuant to § 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll. and Act No. 48 / 2006 Coll., ("the Act ') for the implementation of § 28 (5), § 31 (3) (a), § 34 (5) (a) and § 38 (4) of the Act:
Amendment of the Decree on animal health requirements for trade in animals and on animal health conditions for their importation from third countries
Decree No 382 / 2003 Coll., on animal health requirements for trade in animals and on animal health conditions governing their importation from third countries, as amended by Decree No 260 / 2005 Coll., is hereby amended as follows:
1. In Article 1 (1), in the introductory part of the provision, the words "This Order in accordance with the law of the European Communities (1) 'shall be replaced by the words" This Decree (1) shall incorporate the relevant provisions of the European Communities (1a) and';
footnotes 1 and 1a read:
"(1) It shall be issued on the basis and within the limits of the law, the content of which allows the relevant provisions of the European Communities to be incorporated by decree.

2. In Article 1 (1) (b), the words "and transit 'shall be inserted after the words" import'.
3. In Article 2 (m), "(i) and (j) 'is replaced by" (k) and (l)';
4. In Article 2 (p), "(m) 'is replaced by" (o)';
5. in Paragraph 2 (u):
"(u) other animals - animals not subject to the provisions on animal health requirements governing trade in bovine animals, swine, sheep, goats, equidae, poultry and hatching eggs and the conditions for importation of equidae, poultry, hatching eggs and ungulates listed in Annex 15 to this Regulation, ';
6. In Article 47, point (f) is deleted.
Point (g) shall be renumbered as point (f).
7. in Article 48 (1) (b):
"(b) if they do not come from a herd which satisfies the conditions referred to in (a), come from a holding in which no case of brucellosis or tuberculosis has been recorded during the 42 days prior to dispatch and in which ruminants have been tested for brucellosis and tuberculosis in the 30 days prior to dispatch with negative results."
8. Paragraph 48 (2) is deleted.
Paragraph 3 shall become paragraph 2.
9. In Section 52, the words "Ferrets, foxes' are replaced by the words" Foxes'.

Dogs, cats and ferrets
Dogs, cats and ferrets may be traded if they comply with the requirements laid down in the directly applicable European Community14a). These animals shall be accompanied by a health certificate, also stating that 24 hours before dispatch of the animals, the veterinarian approved by the Regional Veterinary Administration or the competent authority of the Member State has carried out a clinical examination which has shown that the animals are in good health and that they are capable of being transported to their destination.
14a) Articles 5 and 16 of Regulation (EC) No 998 / 2003 of the European Parliament and of the Council of 26 May 2003 on the animal health requirements applicable to the non-commercial movement of pet animals and amending Council Directive 92 / 65 / EEC as amended. ';

Dogs, cats and ferrets to be the subject of trade with Ireland, the United Kingdom or Sweden shall comply with the requirements laid down in the directly applicable European Community Regulation 14b. These animals shall be accompanied by a health certificate, also stating that 24 hours before dispatch of the animals, the veterinarian approved by the Regional Veterinary Administration or the competent authority of the Member State has carried out a clinical examination which has shown that the animals are in good health and that they are capable of being transported to their destination.
14b) Articles 6 and 16 of Regulation (EC) No 998 / 2003 of the European Parliament and of the Council, as amended. ';
13. In the title above Article 56, the words "Cattle, pigs, sheep and goats' are replaced by the words" ungulates'.

The ungulates listed in Annex 15 to this Order may be the subject of import and transit, provided that:
(a) come from a third country or part thereof appearing on the list of third countries and parts thereof from which animals may be imported into the European Union, drawn up and published by the institutions of the European Union,
(b) they come from a disease-free territory which satisfies the basic general criteria set out in Annex 16 to this Regulation and which must be prohibited from entering animals vaccinated against the diseases listed in that Annex;
(c) comply with the specific animal health conditions governing imports and transit, where the provisions of the European Communities have been laid down;
(d) have remained in the territory of the third country referred to in point (a) before the date of loading for dispatch to the Community for the period laid down in the specific animal health conditions governing importation and transit;
(e) have been inspected before dispatch to the Community, carried out by an official veterinarian of a third country, verifying that they are fit and that the requirements laid down for the protection of animals during transport are met, in particular as regards drinking and feeding),
(f) they are accompanied by a health certificate in accordance with Article 56a of the Act corresponding to a model established by a decision of the institutions of the European Union, stating that ungulates comply with the requirements of this decree and other animal health legislation, or, where appropriate, other requirements laid down in specific animal health conditions for the importation and transit of European Communities or recognised as equivalent by European Community provisions;
(g) are subject to an inspection at an approved border veterinary centre on arrival in the Community in accordance with specific legislation9. "
15. Article 57 to 62 shall be deleted;
16. In Section 73, the following paragraph 3 is added, including footnote 16:
"(3) If dogs, cats and ferrets are concerned, the animal health conditions for their importation must be equivalent to those laid down directly by the European Communities Regulation (EC) No 1616 / 2006. These animals shall be accompanied by a health certificate, also stating that 24 hours before dispatch of the animals, the veterinarian approved by the Regional Veterinary Administration or the competent authority of the Member State has carried out a clinical examination which has shown that the animals are in good health and that they are capable of being transported to their destination.
16) Chapter III of Regulation (EC) No 998 / 2003 of the European Parliament and of the Council, as amended. '
17. in Annex No 12 (1) and (6) (a), "§ 2 (1) (y)" is replaced by "§ 2 (aa)";

REPEAL PROVISIONS
Decree No. 383 / 2003 Coll., on the animal health conditions for imports of certain animal products from third countries, is hereby repealed.
EFFECTIVE
This Decree shall take effect on 1 May 2006.
