DECLARATION
of 19 April 2005
on technical and operational conditions of amateur radio communication service
According to Section 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (the Act on Electronic Communications) ("the Act '), the Ministry of Informatics provides for the implementation of Section 16 (8) of the Act:

ČÁST PRVNÍ

GENERAL PROVISIONS
§ 1
For the purposes of this decree:
(a) an amateur radio communications service for self-education or for mutual links carried out by authorised non-employed persons;
(b) by an amateur station, one or more transmitters or a set of transmitters and receivers, including their accessories, needed at a given station to perform an amateur radio communications service (hereinafter referred to as "the station");
(c) the operation of the station by receiving and transmitting radio waves;
(d) the call sign of any station registration that allows identification during broadcasting (1);
(e) the HAREC2 (Harmonised Amateur Radio Examination Certificate) certificate of the operator of an amateur radio communication service having international validity (hereinafter the HAREC licence),
(f) certificate of proficiency NOVICE2) certificate of operator of amateur radio communication service valid in the Czech Republic ("NOVICE licence"),
(g) the operator of the person operating the station,
(h) by a leading operator, a person who is registered in an individual authorisation to use radio frequencies issued for a club station and holds a HAREC pass;
(i) by a system operator, a person registered in an individual authorisation to use radio frequencies issued for an unmanned station and holding a HAREC pass;
(j) the operator authorised to supervise the person holding the HAREC licence is authorised to supervise the activity of the operator without a certificate of professional competence at the club station and to be a management operator registered in the station log;
(k) by an amateur converter of a broadcasting radio equipment operating in the frequency bands reserved for an amateur radio communications service receiving a high frequency signal at the specified frequency and transferring it to another frequency at which the received signal is transmitted again;
(l) an amateur beacon of broadcasting radio equipment operating in the frequency bands reserved for the amateur radio communications service, to study the assessment of the conditions for the spread of radio waves and to check the receiving part of the amateur station;
(m) a packet node for transmitting radio equipment operating in the frequency bands reserved for the amateur radio communications service, allowing access to the radio network for data transmission between stations, except for the stations of the automatic positioning data transmission system (APRS);
(n) the CEPT (Conférence Européene des Administrations des Postes et des Télécom Communications) European Conference of Postal and Telecommunications Administrations (CEPT),
(o) an individual station where the authorisation holder is a natural person;
(p) a club station where one call sign is used by several persons,
(q) the maximum output power of the peak power of the transmitter supplied to the antenna feeder.

OPERATING CONDITIONS OF AMERICAN RADIO COMMUNICATION SERVICES
§ 2
Individual permissions to use radio frequencies
(1) Individual permissions to use radio frequencies (hereinafter referred to as "permissions") for an amateur radio communications service are granted for:
(a) individual station;
(b) club station,
(c) unserved station (§ 6).
(2) A foreign national is entitled to operate a station in the territory of the Czech Republic without authorisation if:
(a) holds a CEPT3 licence or its equivalent recognised CEPT;
(b) resides continuously in the territory of the Czech Republic for less than 3 months4), and
(c) a similar advantage is also granted to the citizens of the Czech Republic by the State of which he is a national.
(3) Foreign nationals from CEPT Member States are granted an authorisation on presentation of the HAREC licence or its equivalent recognised CEPT.
§ 3
Station operation
(1) A foreign national referred to in § 2 (2) shall use his home call sign when operating the station, which shall be preceded by a pair of letters "OK." The letters "OK" and the home call sign are separated by a slash "/" or the English word "stroke."
(2) The test transmission shall be conducted in an appropriate non-radiant resistance which replaces the input impedance of the antenna (artificial load), except for the setting of antennas and antenna circuits of the transmitter.
§ 4
Operator classes
(1) The operator is assigned to Class A or Class N on the basis of a successful passing of the test under a specific legislation.
(2) Maximum output power in class
(a) A is 750 W in the frequency bands listed in Annex 1 to this Decree in Table 1, unless the status in the table provides for a lower power;
(b) N is 10 W in the frequency bands listed in Annex 1 to this Decree in Table 2.
(3) Within the limits of the frequency bands set out in the tables in Annex No 1 to this Regulation, the operator may use only the frequency sections as recommended by the International Amateur Radio Union for Region 1.
(4) On an international radio amateur race or in connection using passive reflections from extraterrestrial objects, a Class A operator can operate a station with a maximum output power of 1500 W in an indolent and 3000 W outside this territory.
(5) The performance referred to in paragraphs 2 and 3 must not be exceeded in the sum of the output of the individual transmission equipment while operating at one frequency and modulated from one source.
(6) The maximum output power of the unoperated station is 50 W.
§ 5
Club stations
(1) An operator not holding a HAREC or NOVICE licence may operate a club station only within the scope of Class N and under the supervision of the operator authorised to supervise.
(2) The name and surname of the manager, the operator authorised to supervise, the operator of the club station and the operation of the club station shall be recorded in the station log. The operator records the traffic data in the station log.
(3) The traffic data in paragraph 2 shall mean, in particular, the date, time and duration of the radio connection, the frequency band used, the type of operation, the call sign of the station and the location of the club station with which the radio connection was made.
(4) Each operator of the club station must be informed of the content of the authorisation.
§ 6
Unoperated stations
Unserved station means amateur converter, amateur beacon or packet node.
§ 7
Station stations
(1) The holder of the authorisation may operate the station permanently only at the post indicated in the authorisation.
(2) Where the holder of the authorisation operates a transitional station
(a) from another fixed post outside the position referred to in paragraph 1, the call sign shall be supplemented by the word "/ p" or the English word "portal,"
(b) from a moving position, the call sign shall be supplemented by the word "/ m" or the English word "mobile."
In a radio amateur race, adding data "/ p," or "portal," "/ m," or "mobile" is not mandatory.
(3) The approval of the owner or operator of the vehicle shall be required for the operation of the station on a means of ship or air transport. When operating a station located on the means of transport, the operator shall complete the call sign by "/ mm 'and by" / am' on the means of air transport.
§ 8
Broadcasting content
(1) The content of broadcasting must not be a commercial, radio or television message.
(2) The station cannot be used to transmit messages to third parties except in cases where there is a deterrence of imminent or existing danger to human life, health, property or the environment. In such a case, the amateur radio communication service is considered emergency communication and for this purpose each operator may use all frequency bands intended for the amateur radio communication service.
(3) Only internationally used MO, MOE, MOI, MOS, MOH and MO5 characters in the following frequency bands may be broadcast via the ARDF radio transmission equipment in an amateur direction:
(a) 3,520 to 3,600 kHz with type of operation A1A;
(b) 3 600 to 3 750 kHz with type of operation A1A and A2A; or
(c) 144,500 to 144,775 MHz and 145,225 to 145,575 MHz with type of operation A1A, A2A, F1A and F2A.
(4) An ARDF (Amateur Radio Direction Finding) radio broadcast device means a radio broadcast device of limited power intended to transmit lighthouse signals for competitions and training in an Amateur Orientation run operating in the frequency bands referred to in paragraph 3.

§ 9
Requirements for stations
(1) The performance of the individual frequency constituents of the undesirable radiation shall not exceed the following values:

(2) The width of the band prevented by transmission must correspond to the minimum bandwidth needed for the transmission of information by the type of operation.
(3) No electromagnetic energy shall be emitted by its antenna during the change of the transmission frequency when operating the station; This condition shall not apply to the operation of a station in the framework of a satellite amateur service.
(4) The output of the transmitter, with the exception of a transmitter with an output power of less than 6 W, must end with a non-symmetrical output with an impedance of 50-100 Hz. An output connector of type N or BNC, or reduction from the output of the transmitter to that type of connector, shall be available at the station for the purpose of measuring the transmitter by authorised persons.

PROVISIONS FINAL
§ 10
The operation of a station whose technical and operational parameters do not comply with this Decree shall be terminated by the holder of the authorisation no later than one month after the date of entry into force of this Decree.
§ 11
Efficacy
This Decree shall take effect on 1 May 2005.

Annex No 2 to Decree No 156 / 2005 Coll.
TYPE OF OPERATIONS
(1) The type of operation of the transmission radio equipment is determined by:
(a) the frequency band width required; and
(b) broadcasting class.
(2) The required bandwidth of the frequency band shall be expressed by four characters, of which three digits shall be the rounded value of the required frequency band width and one letter. The letter shall assume the decimal position and represent the unit used, with the necessary bandwidth:
(a) between 0,001 Hz and 999 Hz shall be expressed in Hertz (H);
(b) between 1 kHz and 999 kHz shall be expressed in kilohertz (k);
(c) be expressed in megahertz (letter M) between 1 MHz and 999 MHz; and
(d) between 1 GHz and 999 GHz shall be expressed in gigahertz (letter G).
When indicating the type of operation of the amateur radio communications service, the indication of the required frequency band width is not mandatory.
(3) The transmission class shall be a mandatory indication and shall express three consecutive characters, the meaning of which is:
(a) the first character indicates the type of modulation of the main carrier, indicating:
