declaring a new type of technical standards (industry standards)
The Office for Standardisation, in agreement with the participating central authorities and authorities, provides for technical standardisation pursuant to Section 2 (2) of Act No. 35 / 1957 Coll.:

Část I

Basic provisions
§ 1
(1) For a new type of technical standards, sectoral standards are declared.
(2) Trade standards are technical standards which apply only in the designated field of the national economy.
§ 2
(1) The scope of the sectoral standards is raw materials, semi-finished products, products and parts thereof, solutions, performances and procedures which are produced, processed or used in the field, or according to which production or other activities are carried out in the field and which, due to the extent of use and the importance of the product or the solution, do not require modifications to the state technical standard.
(2) Only certain provisions of state technical standards may be applicable in the relevant field (e.g. as regards sewing, thread, roughness, etc.).
§ 3
The industry standards apply to all organisations whose design, production or / or other activity falls within the specified field or which are entrusted with the control of activities in the field (test, inspection, inspection and supervisory bodies) or whose activities are related to activities carried out in the field (customer organisations, etc.).
§ 4
Trade standards shall not contradict national technical standards or other legislation.
§ 5
(1) Only organisations which are entrusted by the Minister (head of the Central Office or body) to whom the branch gesture is due may approve the industry standards in agreement with the participating ministers (heads of central offices and bodies) and with the Chairman of the Standardisation Office by managing technical standardisation in the relevant field (hereinafter referred to as the "delegated organisation"). In the case of a branch for which a branch gesture has not yet been addressed, the mandated organisation shall be agreed by the chairman of the Standardisation Office with the participating ministers (heads of central offices and bodies) and with the chairman of the State Planning Commission.
(2) The organisation's approval shall be notified by the Standardisation Authority in its Bulletin by the management of technical standardisation in the relevant field.

Část II

Production of industry standards
§ 6
(1) The production of industry standards is governed by the technical standardisation plan.
(2) If the processor of the standardisation task is not already identified in the technical standardisation plan, it shall be proposed by the designated organisation.
§ 7
(1) The draft sectoral standard shall be drawn up by the processor in such a way as to achieve the basic objective pursued by solving the standardisation task. The processor is based on the results of technical development (scientific, research, development and experimental work) and takes into account the related technical standards, the assessments of test, inspection, inspection and supervisory bodies, international recommendations and foreign standards, the justified requirements of the main candidates for the quality and technical level of the product, the method of production or the procedure for other activities (reconstruction, maintenance, etc.).
(2) The processor shall send the draft standard with the justification and the draft measures for introducing the standard to all or only the main candidates. The processor shall discuss the comments made.
§ 8
(1) The processor shall also submit a reasoned report on the review and approval of the approved organisation, unless it has been drawn up and discussed by the designated organisation.
(2) The delegated organisation will examine the proposed sectoral standard, in particular whether it achieves the stated basic objective and whether the proposal has been discussed with all or with the main candidates. If no agreement has been reached with the processor when discussing the draft standard, the discrepancies of the organisation responsible for discussing the disputed comments with those who submitted them shall be removed.
§ 9
(1) The approval of professional standards is reserved for the Director (s) of the entrusted organisation or its Deputy Director.
(2) The Standardisation Authority may reserve in the annual technical standardisation plan in order to submit a draft sectoral standard before it is approved.

Část III

Announcement and publication of the industry standard
§ 10
(1) The trade standards are announced by the mandated organisation in the Bulletin of the Office for Standardisation.
(2) The approved draft standard shall be submitted by the mandated organisation of the Standardisation Office for publication, numbering and registration. It shall submit the application in duplicate.
§ 11
The industry standards are published by the Office for Standardisation.

Část IV

Provisions common and final
§ 12
The provisions of Part II of this Decree shall apply mutatis mutandis to the procedure for amending or repealing the industry standard.
§ 13
Exceptions to the binding nature of the industry standards may be permitted by the designated organisation which approved the standard.
§ 14
This Decree shall take effect from 1 January 1961.
