DECLARATION
of 26 March 2004
amending Decree No. 292 / 1991 Coll., on Basic Art Schools, as amended
The Ministry of Education, Youth and Sports in the Agreement with the Ministry of Finance provides, pursuant to § 13 (d) of Act No. 564 / 1990 Coll., on State Administration and Self-Government in Education, and § 6a (4) of Act No. 29 / 1984 Coll., on the System of Primary Schools, Secondary Schools and Higher Vocational Schools (Education Act):
Decree No. 292 / 1991 Coll., on Basic Art Schools, as amended by Act No. 138 / 1995 Coll. and Decree No. 151 / 2003 Coll., is amended as follows:

(1) The contribution to the payment of the costs of providing basic education at school (hereinafter referred to as "the contribution") for each field shall, after consultation with the school director, set, up to 110% of the average of the actual non-investment expenses of the school per pupil over the past calendar year, reduced by the cost of salaries and compensation for salaries, wages and salary compensation, on the basis of employment agreements, non-employment and severance payments, the cost of social security contributions and the contribution to the State's employment policy and public health insurance, the allocation to the Fund of cultural and social needs and other costs arising from employment relations, the necessary increase in the costs associated with the teaching of disabled children, the further education of pedagogy workers and services relating to the development of schools and quality of education, provided by the State budget.
(2) For adult studies, the school director shall determine:
(a) for employed pupils, the amount of the contribution in full of the average of the actual non-investment costs per pupil during the previous calendar year;
(b) for pupils who are continuously preparing for a profession and who are not employed, the amount of the allowance referred to in paragraph 1;
(c) in the case of pupils who are not continuously preparing for a profession, are not employed and receive physical security for jobseekers, the amount of the allowance referred to in paragraph 1.
(3) For the purposes of this decree, a person engaged in gainful activities shall be regarded as an employed person. Expensive activities are activities in the Czech Republic which establish participation in pension insurance.
(4) In exceptional cases, taking into account the skills and benefits of the pupil, the school interest and social conditions of the pupil, the school director may, after consultation with the founder, exempt the pupil from paying the contribution in part or in full, usually for one school year.
(5) The allowance shall be fixed for the school year. A pupil or legal representative of a minor student shall pay him or her to the school.
(6) The provisions of paragraphs 1 to 5 shall not apply to private and church primary arts schools. "
2. Paragraph 13, including the title, reads:
Renting of musical instruments or teaching aids
The school may rent out a musical instrument or teaching aids to the pupil by written agreement. '
Transitional provision
The contribution to cover the costs of providing basic education at primary school of art for the second half of the school year 2003 / 2004 and the school year 2004 / 2005 may be adjusted in accordance with Article 11 (1) of Decree No 292 / 1991 Coll., as amended by that decree, with the inclusion in the average of the actual non-investment expenses of the student of the relevant field for the calendar year 2003 of the corresponding part of the expenditure on social security contributions and the contribution to state employment policy and public health insurance contributions, the allocation to the fund of cultural and social needs and other costs resulting from the employment relations that have been covered by the contribution.
Efficacy
This decree shall take effect on the day of its publication.
