amending and supplementing Decree No 85 / 1976 Coll., on a more detailed modification of the zoning and construction rules
The Federal Ministry of Technical and Investment Development provides, pursuant to § 143 (1) (d) to (j) of Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act):
The Decree of the Federal Ministry of Technical and Investment Development No. 85 / 1976 Coll., on a more detailed modification of the zoning and construction rules is amended as follows:
1. Paragraph 2 (1) (d) reads as follows:
"(d) connections to public distribution networks and sewerage,"
2. in Article 2 (1), the following points (e) and (f) are inserted after point (d):
"(e) supporting walls,
(f) underground structures, provided that their built-up area does not exceed 300 m2 and a depth of 6 m ';

Small buildings
(1) Small buildings are buildings that perform a complementary function to the main construction (for housing, civil equipment, for production and storage, for individual recreation, etc.) and which cannot significantly affect the environment, namely:
(a) ground-floor buildings, where their built-up area does not exceed 16 m2 and a height of 4,5 m, such as shed, laundry rooms, summer kitchens, shelters, garbage containers, small-scale buildings, agricultural small buildings, concierge rooms, closets, washrooms, sanitary facilities, saunas, bicycles and baby carriages, waiting rooms and sports facilities,
(b) underground buildings, provided that their built-up area does not exceed 16 m2 and a depth of 3 m, such as cellars, storages without an ambush.
(2) Small buildings shall also be considered as:
(a) construction of forest-based organisations to ensure forest production and hunting, where their built-up area does not exceed 30 m2 and a height of 5 m, such as portable simple shelters, feeders, artisans, forage lines, postures, couches, feed warehouses, tools or fertilisers;
(b) fencing
c) connection of small buildings to distribution networks and sewerage of the main building, 13)
d) entry islets of public public transport, crossing the pavements and to neighbouring land, 14) passes etc.
(3) The buildings referred to in paragraphs 1 and 2, which are the premises, buildings of garages, warehouses of combustible and explosive substances, buildings for civil defence, fire protection, construction of the uranium industry and nuclear power equipment, construction of domestic sewage treatment plants, shall not be regarded as small buildings. ';
4. Paragraph 7 (5) becomes paragraph 6 and the following paragraph 5 is added:
"(5) With the authorities concerned whose opinions, where appropriate, have been given on the documentation required under points (a) and (b) of paragraph 3 before the start of the territorial proceedings, the construction office shall restrict the examination of the application for a territorial decision to the extent that their requirements have been met. ';
5. The heading of Section 14 reads:
"Announcement of small buildings, building modifications and maintenance work."

(1) If the construction office indicates in writing that it has no objection to the implementation of the construction, it shall attach to the communication a certified simple situation sketch. A copy of the communication with a certified sketch shall be forwarded by the construction office to the municipal or local national committee.
(2) The communication of the construction office referred to in paragraph 1 does not replace the decisions of the authorities concerned under specific rules. 15). "

"(b) gradually to the stages of the construction, that is to the parts of the construction capable of being used separately, or to other parts, if the specific regulations allow it, 16) and to the construction of construction site facilities. The construction office may, in view of the social interests (protection of the environment, protected areas, ensuring the complexity of the construction, etc.), provide that it shall not carry out proceedings until the application has been extended to other parts (objects) or to the whole construction (point (a)). '

"(1) The documentation of the building, the construction of which is a citizen, contains in particular:
(a) a 1: 200 scale situation drawing showing connections for public distribution and sewerage;
(b) building drawings of at least 1: 100, of which both the present and proposed condition is evident (floor plans indicating the purpose of use of all premises, sections, views and schematic marking of internal installations),
(c) a technical description with an estimate of the construction costs;
(d) an overview of construction materials, parts and products; for family houses, the builder will show how they are secured.
(2) Separate drawings of structures, connections and internal installations shall be requested by the construction office if it is an unusual solution or if it is not possible to reliably assess them from the marking in the situation drawing and in the building drawings. '
9. Paragraph 42 (2) (d) reads as follows:
"(d) a geometrical plan or other documentation in accordance with the property registration rules to indicate changes if they are subject to real estate registration or confirmation that such documentation has been ordered; such documents shall not be affixed in cases where there is no change in the external layout of the construction and in the case of small buildings. ';
This Decree shall take effect on 1 January 1981.

14) A derogation under Paragraph 16 (3) (d) of Decree No. 136 / 1961 Coll., implementing the Road Act, must be granted in road protection zones.
15) For example according to § 13 (a) and § 14 of Act No. 53 / 1966 Coll., on the Protection of the Agricultural Soil Fund, as amended by Act No. 75 / 1976 Coll., § 4 of Act No. 61 / 1977 Coll., on Forests.
