on the establishment and competence of printing works and duplicates and the compulsory registration of printing machinery
The Ministry of Industry of the Slovak Socialist Republic, in agreement with the Ministry of Interior of the Slovak Socialist Republic, provides, pursuant to Section 1 of Act No. 272 / 1949 Coll., on the Management of Production and Distribution under the jurisdiction of the Ministry of Information and Information, pursuant to Article 9 of the Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation, and pursuant to Section 11 of Act No. 207 / 1968 Coll., on the establishment of ministries and other central authorities of the Slovak Socialist Republic:
Introductory and general provisions
Purpose of the Order
The purpose of this decree is to ensure uniform principles for the establishment of polygraphic production, to prevent the dispersal of means of production, qualified experts and material resources, and to establish compulsory registration of printing machinery and equipment.
Printers
A printing works within the meaning of this Decree is a production unit making printing products, equipped with printing machinery and equipment which replicates printing techniques of the design. An individual machine or device serving the same purpose as the printer shall be considered a printer under this Decree.
Printing machinery
A printing machine within the meaning of this Decree is a device which serves to print paper and plastic by printing, offset or rotogravure printing techniques. Planting machines, printing fonts, photocopying and photomechanical machines for the production of printing form are also considered as printing machines.
The printing machinery referred to in this Decree is not:
(a) single purpose machines for the manufacture and printing of packaging materials at the same time;
(b) reproduction machines and machines used for reproduction in a fast and simple way (e.g., mud, alcohol, planographic, ozalid, xerographic, all formats), as well as small-format offset machines (up to and including A3).
Authorisation procedure
Basic provisions
(1) In order to ensure the efficient distribution of printing works and the use of the production technical and material base of the printing industry in accordance with the social interests, it is permitted to establish, in addition to the national enterprises of the printing industry:
(a) special-purpose printers;
(b) racing printers;
(c) breeding plants.
(2) The establishment and operation of special purpose and plant printers and duplicates are bound by the granting of state consent under other provisions of this Decree.
(3) It is possible to buy, hold and use printing and reproduction machines of domestic or garden origin only with the consent of the Slovak Ministry of Industry of Socialist reputation.
Purpose printers
In accordance with this Decree, printing works dealing with the production of special forms are regarded as special purpose printing works where, in view of the strict settlement, the protection against misuse or for other serious reasons, it is appropriate to ensure production in special purpose printing works set up for this purpose. The Ministry of Industry of the Slovak Socialist Republic gives its consent to the establishment of a special purpose printer.
Racing printers
(1) A racing printer may be set up exclusively in a manufacturing company for its own use if printing by printing is an essential part of its production process. In particular, the following shall be considered as an essential part of the production process:
(a) the printing technique required for the manufacture of products (e.g. the printing of scales of measuring instruments, etc.),
(b) printing of packaging materials (e.g. paper, PVC, foil, sheets, glass, etc.) where printing is an indivisible part of the technological process;
(c) printing on forms or packaging material;
(d) printing of technical production documentation related to its own production programme.
(2) A racing printer can only be set up after prior approval by the Ministry of Industry of the Slovak Socialist Republic.
Reproduction
(1) The multiplication provided for in this Decree is an operational commercial establishment for the provision of local needs of the population and of customer organisations, which it produces in a fast and simple manner on propagating machines, i.e. instruments of the hymns, alcohol, planographic, and small-format offset machines, except colour printing (up to and including A3).
(2) Prior approval by the Ministry of Industry of the Slovak Socialist Republic is required for the establishment and operation of reproduction plants.
(3) A breeding establishment intended solely for its own use by the authorities, undertakings, organisations, institutes and institutions which do not carry out trade in copies shall not be considered a breeding establishment.
Common, transitional and final provisions
Common provisions
(1) Directors and responsible heads of printing works and duplicates, as well as heads of offices, undertakings, institutes, institutions and other organisations where propagating equipment is used for the purposes referred to in Article 7 (3), are required to ensure that printing works and reproduction machines are secured and, according to local circumstances, to ensure the necessary measures to prevent the misuse of such machinery and equipment.
(2) Purpose and racing printers are only authorised to manufacture those types of printing products which serve to carry out the tasks for which they have been set up. At the same time, such printing works are required to keep a record of orders and to ensure the labelling of their printing products.
(3) In the same way, reproduction plants are required to keep a record of orders and to mark copies made.
(1) The Ministry of Industry of the Slovak Socialist Republic mandates Slovak polygraphy, Directorate-General in Bratislava
a) concentrate
1. requests for special-purpose and racing printers, duplicates for the business activities of authorities and organisations to give consent to the establishment and operation of printers and duplicates. Applications for the authorisation of propagating material shall contain details of the place of the reproduction plant, the number of propagating machinery and equipment, the composition of the production programme and the preliminary observations of the relevant regional national committee for the application,
2. requests for purchase of printing machinery from domestic or import;
3. applications for export of used printing machinery;
4. requests by authorities and organisations for the transfer or sale of printing machinery, matrices and printing fonts, or other equipment, as appropriate;
5. a report on the recording of printing machinery and equipment,
6. proposals by authorities and organisations for the disposal of printing machinery and equipment. The printing machinery and equipment intended for disposal shall be disposed of by the owner at his own expense within 30 days of the date of approval of the disposal, by Slovak polygraphy, by the Directorate-General of Bratislava for disposal and by the disposal registration, as confirmed by Mr Kovokrit, of the disposal of the printing machinery or equipment.
(b) to examine the requests, reports and proposals received in respect of the use of machine capacity and custom supplies of printing works and duplicates with commercial activity and to submit their comments on them to the Ministry of Industry of the Slovak Socialist Republic;
(c) keep records of printing works and duplicates engaged in commercial activities at the request of the authorities and organisations;
(d) to draw up expert opinions on printing machinery and products manufactured by them;
(e) facilitate services in connection with surplus printing machinery and equipment intended for sale, transfer or disposal.
(2) The authorities and organisations are required to submit, upon request, Slovak polygraphy to the Director-General in Bratislava, the documents necessary to carry out the tasks arising from this decree.
After examination of the application, reports and proposals referred to in Section 8a of this Decree, only those printing machinery and equipment which form a necessary part of the production process shall be left in operation. The excess capacity of special-purpose equipment shall be decided by the Ministry of Industry of the Slovak Socialist Republic after consultation with the competent superior body of the applicant.
(1) All organisations and bodies which are in charge of printing works or reproduction machines and equipment shall keep special records of them, whether they are used by themselves, their subordinate organisations or their members.
(2) The recording of printing and reproduction machinery and equipment should be carried out in accordance with the principles of uniform recording of machinery and equipment. The basic information shall be provided to the following extent:
(a) the name, type and machine format;
(b) the production, sorting and inventory number;
(c) the year of manufacture and the manufacturer;
(d) machine accessories,
(e) the plant or operation in which the machine is located;
(f) machine performance capacity,
(g) the acquisition value of the machine.
(3) Furthermore, the institutions and organisations, as well as the reproduction facilities for their own use, are required to keep records of the contracts, the number of copies and to ensure that products are marked with the abbreviation of the production undertaking and the contract number.
(4) The price formation of copies shall be governed by rules issued by the competent price authority.
Transitional provisions
(1) In order to obtain the necessary records of the deployment of such machinery, the authorities and organisations which have the management or use of the printing machinery shall report the types of machinery no later than two months after the effective date of this decree to the Ministry of Industry of the Slovak Socialist Republic, using the form set out in the Annex to this decree.
(2) The organisations engaged in the commercial activity of the reproduction industry are required to submit a request, through their central authority, to the Ministry of Industry of the Slovak Socialist Republic no later than two months after the date of application of this decree. If they have a printing machine in their management or use, they shall report in the same way and within the same period according to the previous provisions.
(3) In agreement with the Ministry of Interior of the Slovak Socialist Republic, the Ministry of Industry of the Slovak Socialist Republic will decide on the further authorisation to operate the printing machinery and to carry out the operation of the reproduction plant.
(4) The obligation to report printing machinery pursuant to the preceding paragraphs shall not apply to the following authorities and organisations:
(a) Ministry of Planning of the Slovak Socialist Republic and the Slovak Statistical Office;
(b) the Ministry of Justice of the SSR - printing machinery of the Management of Correctional Education in Leopold;
(c) Ministry of Transport, Posts and Telecommunications of the Slovak Socialist Republic - machinery for printing tickets of cardboard and for printing service graphics, and machinery for printing stamps, stamps and other valuables;
(d) Ministry of Education of the Slovak Socialist Republic - machines for teaching the puppy at the industrial school of graphic and art schools, used exclusively for teaching pupils or listeners;
e) Slovak Administration of Geodesy and Cartography and Slovak Cartography, n. - machinery for printing cartographic works, maps and graphic materials and expert geodetic and cartographic texts;
(f) the Ministry of Forestry and Water Management of SSR - special maps, graphics and tables which are part of forest and water plans;
(g) Union of Fine Artists - machinery used for the artistic activity of members of the Union;
h) State price printing works - machines for printing banknotes, statuses and other prices;
(ch) special printers for the production of blind printing in blind institutions - machines used for educational and educational purposes of blind persons;
(i) printers in medical facilities - machines used for rehabilitation care. The list of these institutes shall be determined by the Ministry of Health of the Slovak Socialist Republic in agreement with the Ministry of Industry of the Slovak Socialist Republic;
j) printer of the Regional Institute of the Czechoslovak State Bank in Bratislava - machines used for the production of prices, settlement and other forms used in banking operations in Slovakia;
k) Graphobale, n., Skalica - machines used for printing and further processing of packaging products;
(l) Harmanecan paper mills, n., Harmanec - machines for printing paper, paper products and cardboard;
m) North Slovak cellulose and paper mills, n., Ružomberok - machines for printing paper and paper products;
n) South Slovak cellulose and paper mills, n., Štúrovo - machines for printing paper and paper products;
o) Slavošov stationery, n., Slavošovice - machines for printing paper and paper products.
Penalties
Who acts against the regulations of this decree, in particular by:
(a) establish or carry out the operational activities of printers or duplicates without the granting of state consent;
(b) purchase, hold and use printing machinery without the consent of the Ministry of Industry of the Slovak Socialist Republic;
(c) fails to comply with the reporting obligation;
he will be punished in accordance with the applicable regulations.
This Decree shall take effect on 1 January 1971.
