DECLARATION
of 10 May 2016
amending Decree No 98 / 2011 Coll., on how to evaluate the state of surface water bodies, how to assess the ecological potential of strongly affected and artificial surface water bodies and the requirements of surface water survey and assessment programmes, as amended by Decree No 313 / 2015 Coll.
The Ministry of the Environment and the Ministry of Agriculture provides pursuant to § 21 paragraph 3 of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll. and Act No. 150 / 2010 Coll.:
Čl. I
Decree No. 98 / 2011 Coll., on how to evaluate the state of surface water bodies, how to assess the ecological potential of strongly affected and artificial surface water bodies and the requirements of surface water survey and assessment programmes, as amended by Decree No. 313 / 2015 Coll., is amended as follows:
1. Paragraph 1, including the title and footnote 1, reads as follows:
„§ 1
Subject matter
This decree, in accordance with European Unionlaw, states:
(a) how to assess the state of the bodies of surface water;
(b) how to assess the ecological potential of heavily affected and artificial surface water bodies;
(c) the details of the surface water survey and assessment programmes.
1) Council Directive 75 / 440 / EEC of 16 June 1975 on the required quality of surface water intended for the collection of drinking water in the Member States and subsequent Council Directive 79 / 869 / EEC. Council Directive 79 / 409 / EEC of 2 April 1979 on the conservation of wild birds. Council Directive 80 / 68 / EEC of 17 December 1979 on the protection of groundwater against pollution by certain dangerous substances. Council Directive 91 / 271 / EEC of 21 May 1991 on urban waste water treatment. Council Directive 91 / 676 / EEC of 12 December 1991 concerning the protection of waters against pollution caused by nitrates from agricultural sources. Council Directive 92 / 43 / EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora. Directive 2000 / 60 / EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy. Directive 2006 / 11 / EC of the European Parliament and of the Council on pollution caused by certain dangerous substances discharged into the aquatic environment of the Community. Directive 2006 / 7 / EC of the European Parliament and of the Council of 15 February 2006 on the management of bathing water quality and repealing Directive 76 / 160 / EEC. Directive 2008 / 105 / EC of the European Parliament and of the Council of 16 December 2008 on environmental quality standards in the field of water policy, amending and subsequently repealing Council Directives 82 / 176 / EEC, 83 / 513 / EEC, 84 / 156 / EEC, 84 / 491 / EEC and 86 / 280 / EEC and amending Directive 2000 / 60 / EC of the European Parliament and of the Council. Commission Directive 2009 / 90 / EC of 31 July 2009 laying down, pursuant to Directive 2000 / 60 / EC of the European Parliament and of the Council, technical specifications for chemical analysis and monitoring of water status. Directive 2013 / 39 / EU amending Directives 2000 / 60 / EC and 2008 / 105 / EC as regards priority substances in the field of water policy. Commission Directive 2014 / 101 / EU of 30 October 2014 amending Directive 2000 / 60 / EC of the European Parliament and of the Council establishing a framework for Community action in the field of water policy. ';
2. in Article 2 (f), including footnote 5,
"(f) a protected area - water or territory established pursuant to § 31 to 35 of the Water Act and European significant sites, bird areas, national nature reserves, natural reserves, national natural monuments and natural monuments, established pursuant to the Nature and Landscape Conservation Act (5), where maintaining or improving water status is a factor in their conservation;
5) Sections 14, 45a and 45e of Act No. 114 / 1992 Coll., on Nature and Landscape Protection, as amended by Act No. 218 / 2004 Coll. and Act No. 349 / 2009 Coll. '
3. In Section 13 (1) of the introductory part of the provision, the words "Annex 9 'are replaced by the words" Annexes 9 and 12'.
4. In Annex No 1, paragraph 4, the words "and the areas specially protected by small areas defined under other legislation16) 'shall be replaced by the words" national natural reserves, natural reserves, national natural monuments and natural monuments, established under the Nature Conservation and Lands5 Act'.
5. In Annex 5, Table 3, Annex 6, Table 3 and Annex 7, Table 2, the words "Government Regulation No 61 / 2003 Coll., as amended," are replaced by the words "Government Regulation No 401 / 2015 Coll. '.
6. In Annex 9, Table 1, the word "macrobezoobenthos' is replaced by" macrozoobentos'.
7. In Annex No 9 (5) (c), the words "or international 'shall be inserted after the words" competent Czech'.
8. in Annex 9 (5) (e), the following point 4 is added:
"4. Monitoring by fishing for fish or aquatic organisms must be carried out in accordance with the Fisheries Act (23).
23) § 2 (j) of Act No. 99 / 2004 Coll., on the Pond, the exercise of fishing law, the fisheries guard, the conservation of marine fishery resources and the amendment of certain laws (Law on Fisheries). '
9. The following Annex 12 is added, including the title:
