of 6 April 2005
determining the level and method of calculating the charges for the use of radio frequencies and numbers
The Government orders pursuant to § 150 (1) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (the Act on Electronic Communications) (hereinafter "the Act ') to implement § 24 (5) and § 37 (2) of the Act:
Amount of fees
(1) The amounts of the annual fixed amounts of fees or the method of calculating the annual fees are set out in the schedule of charges for the use of radio frequencies and number charges annexed to this Regulation.
(2) The amount of the fee for the use of radio frequencies and numbers for a period of less than one calendar year shall be fixed as a multiple of one twelfth of the annual fee and the number of full months from the date of the acquisition of the legal power of the individual authorisation for the use of radio frequencies or the authorisation for the use of numbers in the relevant year, including the month in which the authorisation expires.
(3) The amount of the fee for the use of radio frequencies for experimental purposes is 1% of the fee for the use of radio frequencies set out in the Annex to this Regulation.
(4) If the amount of the annual fee for the use of radio frequencies and numbers determined in accordance with the fee schedule would be lower or higher than the limit laid down in § 24 (2) or § 37 (2) of the Act, the amount of the fee shall be equal to the amount of the limit which it does not reach or exceed.
Maturity of fees
The fees for the use of radio frequencies referred to in Article 24 (2) of the Act and the fees for the rights resulting from the authorisation to use numbers pursuant to Article 37 (2) of the Act shall be payable within 15 days of the date on which the individual authorisation to use radio frequencies or the authorisation to use numbers is acquired and on 31 January of each year for the period of validity of those authorisations.
Efficacy
This Regulation shall enter into force on 1 May 2005.

The fee scale for using radio frequencies and numbers
Item 1
CHARGES FOR THE USE OF RADIO GOODS
1) For the purposes of this Tariff:
(a) by one radio frequency, the numerical value of the radio frequency, including the radio frequency covered by the restricted bandwidth within which the transmission is permitted, and one polarisation, unless otherwise specified by the Government in this Regulation;
(b) by using the radio frequency to allow its continuous use in accordance with the conditions and to the extent specified in the individual authorisation for the use of radio frequencies during the period of validity of that authorisation;
(c) the output power Q of the device used, the power of the radio broadcast device supplied to the antenna feeder.
2) For duplex or semi-duplex mode of operation, fees shall be charged for each radio frequency.
3) The charges for the use of radio frequencies by participating electronic communication devices communicating with base stations on the basis of a general authorisation shall be assessed within the framework of an individual authorisation for the use of radio frequencies granted to base station operators. This fee is equal to the fee for the use of the duplex radio frequency by the base station (not applicable to land mobile service).
A. REVIEW MOVEMENT SERVICES
A. 1. Full area radio networks

For charging purposes, flat-screen radio networks are networks in which radio frequencies can be used by radio devices throughout the Czech Republic. All-area terrestrial mobile service radio networks shall not include radio networks with a national radio frequency used only for mobile radio equipment. Furthermore, radio networks through which the important interests of the State are ensured shall be understood as flat-screen radio networks.

A. 2. Other terrestrial mobile service radio networks

A 2.1 Regional and local radio networks
Regional and local radio networks are for charging purposes radio networks where radio frequencies can be used by radio equipment in the defined territory of the Czech Republic under the conditions of radio frequency allocation, for the purpose of providing publicly available electronic communications services.

The coefficient shall be calculated on the basis of the formula:

A 2.2 Other radio networks
The radio frequency usage fee shall be the sum of the charge for the use of one radio frequency by mobile radio equipment and the charge for the use of one radio frequency by non-mobile radio equipment.
Calculation:

Ca A charge for the use of radio frequency transmitted by mobile radio equipment within the operating area, which depends on the size of the operating area and radiated power of mobile radio equipment
Cb A charge for the use of frequency transmitted by non-mobile radio equipment that depends on radiated performance of individual non-mobile radio equipment
Calculation of fee Ca
The fee shall be charged regardless of the number of mobile radio equipment in the network. For the purpose of calculating the fee, the area served for the radio frequency is a geographical area which is determined by the geographical coordinates of the centre of the area and its radius (maximum distance of mobile radio equipment from the centre of the geographical area in which it can be operated). In determining the area to be served, the technical parameters of the radio network shall be based on the provision of uninterrupted operation of other radio networks. The service area may be determined by the Authority if it is not determined in accordance with the above parameters.
For the purposes of the interaction of the essential components of the integrated rescue system on the dedicated helical radio frequencies defined in the Radio Spectrum Use Plan, the coefficient K2 = 1 shall be determined regardless of the size of the radii of the operator area.
Calculation of the fee The Ca shall also apply to mobile electronic communication devices in remote control and signalling networks.
Calculation:

K2 Coefficient of the radii of the operating area
K2 = 1,5 radius up to and including 5 km
K2 = 2 radius above 5 km to 25 km inclusive
K2 = 5 radius over 25 km to 70 km inclusive
K2 = 11 radius over 70 km up to 150 km inclusive
K2 = 15 radius over 150 km
K3 Radiated power coefficient of mobile radio equipment
K3 = 1 to 10 W permitted maximum effective radiated power inclusive
K3 = 2 above 10 W of the permitted maximum effective radiated power
K16 Frequency band coefficient
K16 = 1 for f < 1 GHz
K16 = 0,7 for 1 GHz < = f < 2,2 GHz
K16 = 0,2 for 2,2 GHz < = f < 24 GHz
K16 = 0,02 for f > = 24 GHz
Calculation of fee Cb
Calculation:
Cb = S2 x K1 x K4 x K16
where is
S2 Rate per 1 kHz used frequency band width
K1 Coefficient of frequency bandwidth used. This coefficient shall be calculated from the width (in kHz) of one frequency channel equal to the channel pitch in the frequency band used.
K1 = 1 for 1 kHz
K4 Sum of power coefficients of individual fixed radio equipment using frequencies in the operating area plus 1,5.
K4 = 1,5 + MBi = 1nXi

Note:
For MWS systems (multimedia wireless systems) of the type of arrangement of a point-to-point in the case of two-way radio operation of this system, fees shall be charged in the category of fixed service even if part of the service provided is a radio service. The charges for the use of frequencies by fixed-service radio equipment with frequencies up to and including 1 GHz shall be measured by calculating the ground mobile service.
C. Broadcasting

S4 Rate per radio frequency
S4 = 1 Kč
V Average effective radiated power at the frequency used in dBW at a value rounded down to an integer. It shall be determined as 1 / 36 of the sum of the permitted radiated power in directions of ten angular degrees starting with zero. For the average effective radiated power is V = 5. In short-wave radio bands V is equal to the output power of the transmitter in dBW.
K11 Type of transmission coefficient:
K11 = 10 Digital radio broadcasting on radio frequencies up to and including 30 MHz
K11 = 15 AM radio transmission
K11 = 30 FM radio transmission
K11 = 30 Digital radio transmission on radio frequencies above 30 MHz
K11 = 50 MWS systems
K11 = 250 Digital Television
Determination of the fee for digital television broadcasting via a single frequency network
In the case of the dissemination of digital television by a transmitter with maximum effective radiated power (ERPmax) of less than 27 dBW, which is used within a single frequency network, it is always C = 420 CZK.
