to carry out qualification tests replacing professional qualifications for the pursuit of craft trades
The Ministry of Economic Affairs, the Ministry of Industry and Trade and the Ministry of Agriculture provide, pursuant to § 22 (4) of Act No. 455 / 1991 Coll., on Trade Business (Trade Trade Act), as amended by Act No. 286 / 1995 Coll. ("the Act '):
Qualification test
(1) Qualificationexamination (1) replacing the professional competence for the pursuit of trade in craft (hereinafter referred to as "the test") shall take place before the Examination Board in secondary vocational schools2) or in secondary vocational education3) (hereinafter referred to as "educational establishments." The examination for the relevant craft trade takes place in an educational establishment which is included by the Ministry of Education, Youth and Sports in the network of schools, preschool establishments and school establishments (4) and in which a teaching or study course is taught in the daily study identical to that set out in Annex 1.
(2) The application for examination is submitted by the applicant to the educational establishment published in the Bulletin issued by the Ministry of Education, Youth and Sports. The application shall state:
(a) the name and address of the educational establishment;
(b) name, surname, birth number, ID number, permanent residence;
(c) trade (field of business);
(d) a statement that it is subject to the conditions of this Order when the test is carried out, in particular to the test rules;
(e) date of completion, signature by hand.
(3) The educational establishment shall set at least two dates for the examination in each school half-year.
(4) The invitation to be tested shall be delivered by the educational establishment to the tenderer no later than one month before the date of the examination. In addition to the invitation, the candidate will receive a range of test questions identifying the aids or means to test the holidays.
Test Panel
(1) The examination committee (hereinafter referred to as "the commission") shall be set up by the Director of the educational establishment by appointing a representative of the educational establishment, the Vice-President of the staff of the competent trade office, on a proposal from that office and by other members of the experts for each part of the examination normally from among the pedagogical staff (5). If the relevant trade association is established, 6) it shall also appoint another member on its proposal.
(2) The Commission shall act in a number of five members and shall act by a majority of its members. In the event of a tie, the chairman's vote shall be decisive.
Content and method of test
(1) The content of the test consists of the curriculum of the teaching profession, which is identical to the relevant field of business ("trade"). For a business which is not consistent with the field of study, the content of the test is determined from the related class. If the content content is not determined for each trade by these means, it is determined by the specific test content.
(2) The examination for individual trades shall demonstrate knowledge and skills within the scope of the final examination of the relevant field of study referred to in Annex 1, which is part of this decree and, where applicable, the specific content of the test referred to in Annex 1.
Notification of test result and certification
(1) The Commission shall report the result of the examination to the tenderer on the day of the examination.
(2) The educational establishment shall be issued to the successful tenderer within 14 days of the completion of the examination. The certificate shall contain:
(a) the name and address of the educational establishment;
(b) the name, surname, birth number, permanent residence of the tenderer;
(c) the date of the examination, the date of issue of the certificate;
(d) the trade for which the certificate is issued;
(e) the stamp of the educational establishment and the signature of the Chairman of the Examination Board.
(3) The certificate confirms the professional competence for the relevant craft trade to the extent provided for by the law.
Test schedule
The procedure for carrying out the test, its evaluation, the rights and obligations of the Examination Board and the applicant shall be further adapted to the test schedule set out in Annex 2, which is part of this Order.
Determination of the replacement time and repeat of the test
(1) Candidates who could not attend the examination for serious reasons or have duly apologized for their non-participation shall, in agreement with the training establishment, set a replacement test date in accordance with § 1 (3) and (4).
(2) A candidate who has failed the test may submit a new application for the test in accordance with Paragraph 1 (2).
Final provisions
The Order of the Ministry of Economy of the Czech Republic, the Ministry of Industry and Trade of the Czech Republic, the Ministry of Education, Youth and Sports of the Czech Republic, the Ministry of Interior of the Czech Republic, the Ministry of Health of the Czech Republic and the Ministry of Agriculture of the Czech Republic No. 525 / 1992 Coll., is hereby repealed to carry out qualification tests replacing the competence for the operation of certain trades.
This decree shall take effect on the day of its publication.

Conditions for carrying out qualification tests replacing professional competence for the conduct of trade
I. Rights and obligations of the Commission and its President
1.
(a) prepare test questions for oral examination and topics or text for written examination;
(b) inform the tenderer of his rights and obligations, of the organisation of the examination and of the manner in which he is assessed;
(c) notify the tenderer before each part of the examination has begun;
(d) may exclude a tenderer who, during the examination, uses illicit aids or means or, where appropriate, significantly impedes the course of the test;
(e) decide on any issue at issue relating to the examination.
2.
(a) verify the identity of the tenderer according to the personal documents and the application;
(b) manage the meetings and work of the Commission, ensure the proper conduct of the Commission;
(c) ensure a protocol record (hereinafter referred to as the "Protocol") of the course and result of the test, indicating:
- the name and address of the educational establishment, the reference number of the protocol,
- name, surname, birth number, permanent residence of the applicant,
- the composition of the Commission,
- the trade for which the test took place,
- entering and evaluating each part of the test,
- overall assessment of the test,
- the date of completion of the protocol, the signatures of the members of the commission and the stamp of the educational establishment.
The original of the protocol on the course and result of the examination shall be established for the educational establishment.
II. Method of conducting the test
(a) the test consists of two separate parts, practical and theoretical;
(b) the practical part of the test shall be carried out by the tenderer before the theoretical part of the test, in the case of the unsuccessfully completed practical part of the test no longer taking place from the theoretical part;
(c) the theoretical part of the examination shall be carried out in an oral and written form, showing the applicant a summary of the expertise in the relevant business;
(d) the theoretical part of the test shall last a maximum of 60 minutes;
(e) the practical part of the examination may take up to three days, with the fact that the invitation to the test (Paragraph 1 (4) of this Order) must inform the tenderer of the dates on which the test will take place;
(f) if the practical part of the test lasts more than 240 minutes, the training establishment shall specify the maximum period for which the tenderer may be tested on each day.
III. Evaluation
(a) the outcome of the examination shall be decided by the members of the Commission;
(b) the result of the test shall be assessed by the classification grade "benefit" or "benefit";
(c) the classification grade "benefit" shall be assessed by a tenderer who has demonstrated knowledge and skills within the scope of the final examination of the relevant field of instruction and, where appropriate, the specific content of the test referred to in Annex 1;
(d) the classification grade "failed" shall be evaluated by a tenderer who has not demonstrated the required knowledge within the scope of the final examination of the relevant class or, where appropriate, the specific content of the test set out in Annex 1;
(e) the classification grade "failed" shall also be evaluated by the candidate who has been excluded from the test.
IV. Rights and obligations of the applicant
(a) the selection of the training establishment is at the discretion of the applicant;
(b) the tenderer who has passed the test has the right to be certified under this Order;
(c) failure to participate in the examination for serious reasons (Paragraph 6 (1)) shall be subject to the obligation of the applicant to apologise to the educational establishment within three days of the date specified as the date of the examination.
