The Ministry of the Environment provides pursuant to § 22 paragraph 1 (b) and (c) of Act No. 334 / 1992 Coll., on the Protection of the Agricultural Soil Fund, as amended by Act No. 41 / 2015 Coll.:
DECLARATION ON THE DETERMINATION OF DETAILS OF AGRICULTURAL BASE QUALITY PROTECTION
Determination of preventive values for the contents of risk elements and of risk substances and indicator values for the contents of risk elements and of risk substances in agricultural land
The preventive values of the contents of the risk elements and of the risk substances in agricultural land are set out in Annex 1 to this Decree. The indicative values of the risk elements and the risk substances in agricultural land are set out in Annex 2 to this Decree.
Procedures for the detection and evaluation of levels of risk elements and of risk substances in agricultural land
(1) The detection of the contents of the risk elements and of the risk substances in the agricultural land shall be carried out using the procedures and analyses set out in Annex 3 to this Regulation. The sampling procedure for determining the levels of the risk elements and the risk substances in the agricultural land is set out in Annex 4 to this Decree.
(2) The evaluation of the levels of the risk elements and of the risk substances in agricultural land shall be carried out by comparing the identified levels of the risk elements and of the risk substances in agricultural land as referred to in paragraph 1 with the preventive and indicative values.
FINAL PROVISIONS
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 on the procedure for the provision of information in the field of technical and information society services, as amended.
EFFECTIVE
This Decision shall enter into force on 1 June 2016.

Sampling procedure
1. Sampling plan
A sampling plan containing:
(1) the purpose of sampling,
(2) sampling scheme, namely:
(a) the basic sampling scheme (number and distribution of samples in the pet territory); and
(b) 2. sampling scheme on the sampling site (number and distribution of individual samples for the composite sample);
(3) type of sampling equipment and sampling technique,
4) sample depth including justification for proposed sampling depth
(5) mass of the composite sample,
6) number of individual samples (5 - 30 injection according to used device - probe) per composite sample (5 - 30 injection according to used device - probe),
(7) time and time of sampling, if any;
(8) adaptation (quarting of the composite sample) and packaging of samples (separation of the control sample),
(9) description, transport and storage of samples,
10) the range of analyses required,
(11) documentation (record of collection); and
(12) a description of the course of sampling.
2. Determination of the number of samples
Samples shall be taken as broken, composite samples. The minimum number of composite samples per area is set out in Table 1. The actual number of samples shall be determined in such a way as to ensure the representativeness of the results taking into account the expected level of risk, the level and variability of contamination and the method of evaluation of the results.

Explanatory note to the table:
(1) Including the collection of one or more reference samples taken outside the area concerned by the collection of composite samples if necessary to identify the source of pollution or capture the background condition.
3. Number of sampling, sampling equipment and mandatory data for composite samples
One composite sample shall consist of at least 5 samples. A probe rod, soil drill or blade may be used as a sampling device. During sampling, the entire soil horizon shall be applied evenly. The sampling device used shall not cause secondary contamination of the sample.
The pooled sample collected shall be supported by the following data:
(a) the sample serial number, the location of the sample (cadastral territory, the parcel number of the plot, the coordinates of the sampling point in the S-JTSK coordinate system),
(b) the climatic and soil characteristics of the sampling site expressed by the soil-protected ecological unit;
(c) relief of terrain;
(d) weather status at the time of sampling;
(e) area under investigation in hectares;
(f) the date of collection and the names of the persons responsible for the collection;
(g) the date of transfer of the sample to the laboratory, the signatures of the transmitting and receiving persons,
(h) a map of the area under investigation and the sampling point on the ground map.
4. Depth of collection of composite samples
The depth of the composite samples, depending on the type of parcel, is set out in Table 2

Explanatory note to the table:
(1) When soil is collected to detect pollution due to fall or surface application of the pollutant caused by an exceptional occurrence, the sampling depth shall be determined in such a way that the sample of soil collected is as closely affected as possible by the condition to be described by the analysis of the sample.
5. Mass of the composite sample
One composite sample shall be at least 0,5 kg.
6. Storage of composite samples
If samples are taken only to determine risk elements, they are stored in paper or PE bags. For the determination of risk substances, they are stored in a clean glass container with a sealing cap. These samples shall be transported and stored refrigerated at 4 ° C.
7. Preparation of composite samples for analysis
After removal of the skeleton, the samples are dried in the air, dilute them, homogenize them and suction them to 2 mm of net. This procedure does not apply to the determination of organic substances.
