supplementing the basic conditions for the supply of chemical, rubber, asbestos and cellulose and paper products
The Ministry of Chemical Industry, in agreement with the Ministry of Consumer Industry and after approval by the Chief Arbiter of the Czechoslovak Socialist Republic, provides pursuant to Section 192 of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Čl. I
The Ordinance of the Ministry of Chemical Industry No 171 / 1958 Ú. l., which issues the basic conditions for the supply of chemical, rubber, asbestos and cellulose and paper products, shall be added as follows:
The following text shall be inserted after Article 14, including the title, of Section 14 (a) to (c):
"Receipt procedure and property penalties for defects caused by the elasticity of artificial viscose silk and polyamide fibres
§ 14 a
(1) In order to determine whether the supply of artificial silk of viscose or polyamide fibres has characteristics which could cause the elasticity of the fabric or of the knitted fabric, the customer shall, within 14 days of receipt of the supply, make an experimental fabric of the fibre, taken to the extent and in the manner specified in the technical standard for sampling *) and colour the fabric
(a) if it is viscose silk approved with Saturn blue L 4 G or another colour agreed with the supplier,
(b) if the polyamide fibre is a dye agreed with the supplier.
(2) If the customer finds in this procedure the elasticity of the weaponization which he considers to be a defect of the product, he shall inform the supplier without undue delay and invite him to appear to discuss the result of the test.
§ 14 b
(1) If the supplier does not agree with the customer's finding carried out in accordance with § 14 a, the test shall be repeated in the same way on the fibre taken in the presence of the supplier's authorised representative. In addition, the colour of the same knitted fabric shall be carried out in such proceedings by other colours to be determined by the customer according to the likely operational use. These tests, or with the agreement of both parties, will be decisive for the application of the claims of the established flexibility, in particular for the agreement on the amount of the discount.
(2) The entry for the performance of the test involving the supplier, if it also contains a definition of the customer's requirements, is simultaneously a complaint.
§ 14 c
(1) A supplier who has supplied viscose silk or polyamide fibres whose defect consists solely in causing the fabric or knitted fabric to elasticity shall pay the customer only 2% of the penalty payment.
(2) If the supply of viscose silk or polyamide fibre is also defective for another reason, the supplier of the periodic penalty payment provided for in § 140 of Act No. 69 / 1958 Coll. '
Čl. II
This Decree shall take effect from 1 November 1960 and shall apply to supplies of artificial viscose silk and polyamide fibres made between organisations of the Ministry of Chemical Industry and the Ministry of Consumer Industry until 31 December 1962.
