Government Regulation
of 7 June 1949
on compulsory pest control of beet and hops and on professional supervision of the conservation of plant production.
The Government of the Czechoslovak Republic orders pursuant to § § 11 and 13, § 16, § 2, § 17, § 10 and § 19, § 4 of the Act of 2 July 1924, No 165 Coll., on the Protection of Plant Production:
Measures against beetroot pests.
(1) Beetroot as referred to in this Regulation (2) means insects in all stages of development (egg, larva, cocoon, beetle, moth) and diseases.
(2) Beetroots are:
(a) all species of rhinoceros which occur as pests of beet crops, in particular rhinoceros (Bothynoderes punctiventris), Leloconoceros (Otiorrhynchus ligustice) and Long nettle (Tanymecus palliatus),
(b) halticae,
(c) scavengers (Silphidae),
(d) sand cloud (Opatrum sabulosum),
(e) moth (Agrotis segetum),
(f) Beet nematode (Heterodera Schachtii),
(g) aphid (Aphis fabae),
h) beets (Phlyctaenodes stiticalis),
ch) Beet pox (Cercospora),
(i) virus diseases of beet.
(1) The beet grower (including seed beetle) is obliged to destroy the beet pest on the land which it cultivates.
(2) Destruction is carried out mainly by collecting and reliably destroying pests, both in the field work before sowing or planting of beet and in the treatment of crops. Manual collection may be supplemented by the release of poultry into beet crops. In areas where beet crops are regularly attacked by nossows, growers are required to dig out early in the spring protective trap ditches of about 30x30 cm around the parcels which have been found to be infested with pests and around the beet fields and in them collected pests are destroyed, after the beet crop is provided with a protective belt which is formed by saturation of chemical contact devices to protect plants in the width of 5 to 10 cm.
(3) If it is not sufficient to destroy in accordance with paragraph 2, growers shall be obliged to destroy beet pests in the crops by spraying or spraying with effective chemical agents to protect plants.
Measures against hops pests.
Hops growers in hop production areas (§ 1 of the Government Decree of 13 July 1934, No 161 Coll., implementing the Law of 4 May 1934, No 89 Coll., on the compulsory grading of hops and the adjustment of the extent of hop cultivation) are obliged to protect their load by appropriate means (§ 4) hop crops before infestation with hops (Epitetranychus altheae), hops mould (Phordon humuli), hops squid (Psyllliodes athemata) and peri hops (Pseudomoronospore humuli), and to destroy these hops in all developmental stages.
The means used to protect hop crops are:
1. Devices against hops:
(a) destruction of affected hop bushes, separated branches, leaves and heads of hops after harvesting, at the latest when the leaves are yellowed, cut, collected and disposed of, in particular by burning them, compost them, after feeding them in such a way as to prevent the wintering of the vertical;
(b) disinfection (point (c) by bars used to guide hop bushes, if they have previously been used in hops affected by hops;
(c) timely and proper spraying by authorised plant protection products notified by the competent research institute (Section 10), as appropriate, to the local national committees of the hop communities, to the relevant regional producer organisations of hops and to the single agricultural cooperatives.
2. Means against hops aphid:
(a) the spray of hop crops (No 1 (c)) and other plants host this aphid (e.g. plums, slivers, sloes);
(b) where there is a risk of permanent infestation of hops from tree and shrub crops, the treatment of those crops in accordance with Sections 5, 3 and 9 of the Government Decree of 27 April 1948, No 101 Coll., on measures against harmful agents on fruit trees and bushes, so that aphids are safely exterminated.
3. Means against hop squid:
(a) dusting of hops by authorised and appropriate plant protection products;
(b) the cleaning of hops and adjacent parcels from the nettle (Urtica dioica) and nettle (Urtica urens) by destroying these nettles, or by mowing and burning them to such an extent as to prevent the spreading of the squid by these plants.
4. Anti-peronomic hop products:
(a) spraying of hop crops by authorised and appropriate plant protection products;
(b) the removal and disposal of spring ear hops from the hops from the hops, affected by the hops peronospore, in such a way as to prevent the spread of disease from the hops;
(c) the removal of hop plants as soon as possible on supports at least 1.5 m high (bars, wires, ropes and the like);
(d) the cleaning of hops as soon as possible after the rinsing of the hops, but no longer until yellowing, from hops (hop leaves, shoots and remaining heads) and its removal by burning, feeding, compost and below to prevent the infection of hops. The same applies to hops and hops which have not been combed at all.
Provisions common and final.
(1) The breeder shall immediately notify the presence of beet and hops pests (hereinafter referred to as "pests") or the suspected presence of such pests to the local national committee of the municipality in whose district the affected parcel lies; the local national committees shall also establish the presence of pests on their own initiative.
(2) The local national committee shall immediately notify the presence of pests or the suspected presence of pests by a messenger, telegraphically or by telephone to the national district committee, and, as regards beetroot pests, also a sugar refinery whose supply district the affected parcels belong to. The report shall include the name or description of the pest, the name of the breeder, the cadastral number of the parcel, after its designation at the usual place, and its area. The Regional National Committee shall send a comprehensive report to the relevant Research Institute (§ 10) and to the Regional National Committee at least once a week on where pests have occurred in its district.
(3) In particular, the detection and notification of pests also belong to the single agricultural cooperatives and folk agronomes established by the Ministry of Agriculture.
(1) If pests occur in a municipality to a dangerous extent, growers are required to carry out their destruction together on their own load, in particular through uniform agricultural cooperatives.
(2) The obligation to carry out the destruction referred to in paragraph 1, following the manner of destruction, shall be laid down by the local national committee by a resolution which shall be published on the official plate, if otherwise at the usual place; It shall also be communicated by the single agricultural cooperative and the popular agronomy. The text of the decree will be sent by the local national committee to the district national committee and research institute (§ 10). The District National Committee shall take action in cases where they have not been adopted by the Local National Committee, although necessary.
(3) The proposed measures referred to in paragraph 2 shall include, in particular, the folk agronomes and the plant health rapporteurs, the single agricultural cooperatives and the inspection bodies referred to in Article 17 of Act No 165 / 1924 Coll., and, as regards the beetroot pest, also the sugar refinery, the supply of which the affected parcels belong.
(4) If the common pest destruction is not carried out by a single agricultural cooperative as well as by non-member growers, the local national committee may take the measures referred to in § 10 (3) of Act No 165 / 1924 Coll.
If the grower fails to fulfil the obligations under Sections 2 and 3 and Section 6, paragraph 1, the relevant measures shall be taken by the local national committee on its load. If the local national committee fails to fulfil this obligation, the district national committee shall take these measures.
The obligation to destroy pests shall be recalled by the district national committee to growers through local national committees at least once a year, no later than the end of March, otherwise as needed.
Research institutes (§ 10) and district national committees are required to provide members of single agricultural cooperatives and folk agronomists with free information on the most appropriate ways to destroy pests, in particular on the means to do so.
(1) The professional supervision of the maintenance of the provisions of Act No. 165 / 1924 Coll. and the regulations issued pursuant to it shall be carried out by the following research institutes:
a) in the regions of Prague, Česká Budějovický, Plzeň, Karlovy Vary, Ústí, Liberec, Hradec and Pardubický: Institute for Plant Protection of State Research Institutions of Agricultural Institutions in Prague,
(b) in the county of Jihlava: the Institute for Plant Protection of State Research Institute of Potatoes in Havlíčkov Brod,
(c) in the regions of Brno, Olomouc, Gottwald and Ostrava: the Institute for Plant Protection of State Research Institutions of Agricultural Institutions in Brno,
(d) in the regions of Bratislava, Nitra and Žilinský: the Institute for Plant Protection of State Research Institutions of Agricultural Institutions in Bratislava,
(e) in the regions of Báňskobyšický, Košický and Prešovský: Institute for Plant Protection of State Research Institutions of Agricultural Institutions in Košice.
(2) If it is suspected that the provisions of this Regulation are not being respected, the authorities of the research institutes and their control authorities are also entitled to carry out inspections of the land under the conditions set out in Section 17 of Act No 165 / 1924 Coll. The tour is to invite a people's agronomist, and if it is about a beetroot pest, also a representative of a sugar factory whose supply district the plot is viewed.
After the applicability of the Decree of 22 July 1932, No 140 Coll., on the professional supervision of the maintenance of the regulations of Title II of the Plant Protection Act of 20 July 1939, No 186 Coll., on measures against the peronospora of hops and Government Order of 29 October 1947, No 193 Coll., on measures against hops vertical (Epitetranychus altheae), it is hereby repealed.
This Regulation shall enter into force on the day of its publication; they shall be implemented by the Minister for Agriculture in agreement with the Ministers involved.
