THE LAW
of 21 April 2010
amending Act No. 513 / 1991 Coll., Commercial Code, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Commercial Code
Act No. 100 / 2004 Coll.
1. In Paragraph 43 (2), the following sentence is inserted after the first sentence: "Protection against unfair competition is provided to the Czech court or other Czech authority even if an agreement has been concluded between the Czech and foreign persons according to which the foreign court or other foreign authority should decide."
2. In Paragraph 44 (1), the first sentence is: "Unfair competition is competitive or economic behaviour which is contrary to good competitive behaviour and is capable of causing injury to other competitors, consumers or other customers."
3. In Paragraph 45 (1), the words "benefit at the expense of other competitors or consumers' are replaced by the words" or in economic contact benefit at the expense of other competitors, consumers or other customers'.
4. In Paragraph 46, the following paragraph 5 is added:
"(5) The advertising in the course of business and for the purposes of economic traffic which offers the registration in catalogues, such as telephone and other lists, by means of a payment form, an invoice, an invoice, a repair offer or in any other similar way, shall contain clearly and clearly stated information that such advertising is exclusively an offer for the conclusion of a contract. This applies mutatis mutandis to the direct offer of such a marketing authorisation. '
5.
The contract, part of it or its individual provision, in which the prohibition of unfair competition has been infringed (Sections 44 to 52), shall be void from the outset. '
EFFECTIVE
This Act shall take effect on 1 July 2010.
