The Ministry of Health, in agreement with the Councils of the Regional National Committees and after approval by the Chief Arbiter of the Czechoslovak Socialist Republic, provides in accordance with Section 392 of Economic Code No. 109 / 1964 Coll. (hereinafter referred to as "the Act"):
General provisions
Scope
This decree regulates the supply of products supplied by the national health supply undertaking (the supplier) to national health institutes - the pharmacy service and its facilities (the customer).
Delivery of products
Order and delivery plan
(1) Product deliveries shall be made according to an order and delivery plan, the design of which shall be drawn up by the supplier for a quarterly or half-yearly period and sent to the customer no later than 15 days before the beginning of the relevant period.
(2) The order and delivery plan contains the time limits for submitting the order books and individual orders to the supplier, as well as the time limits and method of delivery. The delivery cycles are determined by the Regional National Committee on a proposal from the supplier.
(3) Within 10 days of receipt of the draft order and delivery plan, the collector shall either confirm the proposal or send the supplier a proposal of amendments and additions within the same period; If they do not do so, they agree to the supplier's proposal. Disputes between supplier and customer are addressed by the Regional National Committee.
(4) The collector shall notify the supplier of changes to the network of the pharmacy facilities no later than one year in advance.
Conclusion of economic contracts
(k § 152 et seq.)
(1) The collector presents draft contracts (orders) for the supply of products listed in the order books by sending these books to the supplier; for other products, the customer submits special orders.
(2) The collector may also send orders outside the deadlines specified in the order plan. If the customer requests the immediate delivery of the products, he shall state in the order; If they do not do so, they agree to the delivery within the next deadline according to the delivery plan.
Delivery conditions
(1) When delivery is made by means of means of transport sent by the supplier, the products must be delivered at the time of the day-to-day operation of the customer; outside that period only if the supplier has so agreed with the customer.
(2) The supplier is entitled to meet the delivery even on the day after the date specified in the order and delivery plan.
(3) The collector shall be obliged to allow the unloading and collection of the products as soon as the supplier's car crew has notified him that it is ready to unload the supply. If delivery is made by means of means of transport sent by the supplier, the supplier shall be obliged to lodge the products at the pharmacy (warehouse).
Delivery of products with an expiry period and a shelf life
(to Section 168 of the Act)
(1) The collector shall not be obliged to withdraw products for which a technical standard for an expiry period of up to one year has been established after two thirds of that period. for products with a longer expiry period after the 1008th day before the expiry date. Products supplied on the route by the Institute of Serums and Vaccines (diagnostic sera, diagnostic antigens, luetic antigens, diagnostic soils) shall not be required to be withdrawn by the customer after half of the period. These provisions shall apply only if the organisation does not agree otherwise and shall also apply to products for which a technical standard of application is established.
(2) The collector may withdraw the products after the time limits laid down in paragraph 1, but not after the expiry or expiry period; where the customer could not use these products by the end of the expiry period or, where applicable, the period of application, he is entitled to return them to the supplier without undue delay. The supplier is obliged to return to the customer the price the buyer paid for the products.
(3) The products referred to in paragraph 2 must be identified by the supplier in a manner agreed with the customer.
Obligation of the customer to return certain products
The collector shall be obliged to return to the supplier within 30 days of the date of the withdrawal of the medicinal products which have been published in the "Malfunction Reports' issued by the Ministry of Health, if they are inadvertent for production, within a maximum of 30 days of the date of the withdrawal of the" Deficiency Reports', unless otherwise agreed.
Guarantee period
The warranty period shall specify the relevant technical standards.
Efficacy
This Decree shall take effect on 1 July 1964.
