DECLARATION
of 12 April 2005
laying down the model forms for the reporting of persons growing poppy seed or technical hemp plants and the method of filling in and handling those forms
The Ministry of Finance and the Ministry of Agriculture, pursuant to § 31 (2) of Act No. 167 / 1998 Coll., on addictive substances and on the amendment of certain other laws, as amended by Act No. 362 / 2004 Coll., ("the Act '):
Form models
(1) The model form for the reporting of poppy-growing persons on sown area pursuant to Article 29 (a) of the Act is set out in Annex 1 to this Decree.
(2) The model form for the reporting of persons growing technical hemp plants on sown area pursuant to Article 29b (a) of the Act is set out in Annex 2 to this Decree.
(3) The model form for reporting poppy-growing persons on the area and method of destruction provided for in Article 29 (b) of the Act is set out in Annex 3 to this Decree.
(4) The model form for the reporting of persons growing technical hemp plants on the area and method of disposal pursuant to Article 29b (b) of the Act is set out in Annex 4 to this Decree.
(5) Model of the form for reporting of poppy-growing persons with annual harvest in accordance with § 29 (b). (c) points 1 and 2 of the Act are set out in Annex 5 to this Decree.
(6) The model form for the reporting of persons growing technical hemp plants on the annual harvest provided for in Article 29b (c) of the Act is set out in Annex 6 to this Decree.
(7) The model form for reporting poppy-growing persons sold or otherwise transferred under § 29b (c) (3) of the Act is set out in Annex 7 to this Decree.
Method of filling in and handling forms for the reporting and handling of poppy plants or plants of technical hemp
The method of filling in and handling the forms for the reporting and handling of poppy growing persons or plants of technical hemp is laid down in Annex 7 to this Decree.
Efficacy
This decree shall take effect on the day of its publication.

Method of filling in and handling forms for the reporting and handling of poppy plants or plants of technical hemp
I.
METHOD OF APPLICATION
Placing data in a separate box on the top right of the form
1. When fulfilling the reporting obligation of a person growing poppy seed or plants of technical hemp in an area of more than 100 m2 (hereinafter referred to as "the grower '), he shall indicate in the left part of this box the relevant calendar year, in the middle part of this box the serial number of the form and in the right part of this box the total number of forms used.
2. In cases where all information on the fulfilment of the reporting obligation cannot be provided on a single form, the grower shall use several forms and the individual forms shall be numbered appropriately in accordance with point 1 of this Annex. Identification details of the person growing poppy seed or plants of technical hemp and contact person shall always be provided by the grower using the serial number 1 form. The growers shall confirm the accuracy and veracity of the data in box 14 of the form on all forms.
Records of the customs office
3. This box is reserved for the customs office of registration.
Data entry in box 1 of the form
4. If the grower is a legal person, the grower shall enter in this box a business firm according to the Civil Code and a registered office according to the current registration in the register of taxpayers, if there is no such registration, in the commercial register and if there is no such registration, in the register of economic operators. If the grower is a legal person established outside the territory of the Czech Republic, the breeder shall also indicate the full name of the country of residence of the legal person. The register number shall be provided if the grower is registered in such a register abroad.
5. If the breeder is a natural person, the breeder shall enter in this box his business and the place of business according to the current registration in the register of tax payers, if such registration is not in the business register, if the natural person - the entrepreneur is registered, if such registration is not in the register under special legislation (2), if such registration is not in the business register, if such registration is not in the business register, then the date of birth. If the grower is a natural person, a businessman established outside the Czech Republic, the provisions of point 6 of this Annex shall apply mutatis mutandis.
6. If the grower is a natural person, the grower shall enter in this box the name and / or the name, surname, address of the place of permanent residence, indicating the street name, the descriptive number, the name of the municipality and the postal code. If the breeder is a natural person who does not have a place of residence in the Czech Republic, the breeder shall indicate the name and, where applicable, the name, surname, place of residence and the full name of the country of residence, including any other identification details, such as the passport number or any other personal document, including its period of validity, and the address of the place where the person resides in the Czech Republic.
Data entry in box 2 of the form
7. In carrying out the reporting obligation, the grower shall indicate on the left of this box an indication identifying the grower. The breeder always marks only one figure.
8. If the grower is a legal person, the grower shall indicate the tax identification number (hereinafter referred to as "VAT ') in the upper right-hand section of this box, if allocated to him. If the grower is not assigned a number, he shall indicate his identification number (hereinafter referred to as" IČO').
9. If the breeder is a natural person, the breeder shall indicate in the upper right of this box for identification of the ID number, if allocated. If the grower does not have an ID, he shall indicate his IČO. If the breeder does not have an ID or an ID, that part of the box shall not be completed and shall indicate the date of birth in the lower right-hand part of this box.
10. If the breeder is a natural person, the breeder shall indicate the date of birth in the lower right part of this box for identification.
Data entry in box 3 of the form
11. Where the grower is a natural person, the entrepreneur or natural person, the grower shall not enter data in this box.
12. Where the grower is a legal person, the grower shall enter in this box the name and, where applicable, the name and surname of the person authorised to act in the performance of the reporting obligation and the telephone and fax connections and, where appropriate, the e-mail address.
Data entry in box 4 of the form
13. Where the contact person is a natural person the entrepreneur or natural person referred to in box 1, the grower shall enter in this box only the telephone and fax connections and, where appropriate, the e-mail address. Where the contact person is a natural person other than those mentioned in box 1 of this form, the grower shall also indicate the name and surname, if applicable.
14. Where the contact person is the person mentioned in box 3 of this form, the grower shall not enter the particulars in this box.
15. Where the contact person is a natural person other than those mentioned in box 1 or 3 of this form, the grower shall also indicate the name and surname, if applicable.
Data entry in box 5 of the form
16. When fulfilling the reporting obligation, the grower shall enter in this box the name of the cadastral territory.
Data entry in box 6 of the form
17. When fulfilling the reporting obligation, the grower shall enter in this box the number of the cadastral territory. For the purposes of fulfilling the reporting obligation, the breeder shall enter in this box the ČSÚ code as the number of the cadastral territory according to the order establishing the list of cadastral territories with assigned average basic prices for agricultural parcels.
Data entry in box 7 of the form
18. When fulfilling the reporting obligation, the grower shall enter in this box the name of the registered variety4) of the seed or plant of technical hemp.
Data entry in box 8 of the form
19. In carrying out the reporting obligation, the grower shall enter in this box a partynumber according to the cadastral law or square and the code of the part of the soil block kept in the land use register according to the user relations according to the agriculture law 5). More than one line of this box can be entered in the same row. If, for spatial reasons, all parcustoms numbers cannot be entered in this box, further parcustoms numbers may be entered in the next line of box 8 of the form.
Data entry in box 9 of the form
20. When fulfilling the reporting obligation, the grower shall indicate in this box in Annexes 1 and 2 the area of the parcels sown with poppy seed or plants of technical hemp, or in Annexes 3 and 4 the area of the parcels on which poppy seed, plants of technical hemp or macaquin is to be disposed of. The land shall be expressed in hectares to two decimal places and in each separate line in relation to the parcustoms numbers indicated in box 8 of the form and the registered variety indicated in box 7 of the form of the same line.
Data entry in box 10 of the form
21. When carrying out the reporting obligation, the grower shall enter in this box the sum of the entries in box 9 of the form concerned - the area of parcels sown with poppy seed or plants of technical hemp or the area of parcels on which poppy seed or plants of technical hemp are to be disposed of, in hectares to two decimal places. This box shall be completed by the grower in cases where one form is not sufficient to fulfil the reporting obligation due to the quantity of data. In cases where one form is sufficient to fulfil the reporting obligation, the grower shall not complete the box and shall enter the required information in box 11 of the form.
22. When carrying out the reporting obligation under § 29 (c) or § 29b (c) of the Act, the grower shall indicate separately in this box in relation to boxes 9 and 17 of the form.
Placing of data in box 11 of the form
23. When fulfilling the reporting obligation, the grower shall enter in this box the total area of parcels sown with poppy or hemp, or the total area of parcels on which poppy or hemp is to be disposed of, in hectares to two decimal places. In cases where a single form is sufficient to fulfil the reporting obligation, the grower shall indicate in this box the sum of the entries in box 9 of the form. In cases where one form is not sufficient to fulfil the reporting obligation, the grower shall indicate in this box the sum of the entries in boxes 10 of each form on the form with the last serial number.
24. When carrying out the reporting obligation under § 29 (c) or § 29b (c) of the Act, the grower shall indicate separately in this box in relation to boxes 9 and 17 of the form.
Data entry in box 12 of the form
25. When fulfilling the reporting obligation, the grower shall indicate in this box an estimate of the area of land on which poppy seed or plants of technical hemp will be grown in the next calendar year. The land area estimate shall be given in hectares to two decimal places.
Indication of data in box 13 of the form
26. This box is reserved for comments by growers and customs authorities.
Placing of data in box 14 of the form
27. When carrying out the reporting obligation, the grower shall always enter in this box the place and date of the reporting obligation and certify by his signature or stamp of the legal person, where appropriate, the accuracy of the particulars on the form.
Placing of data in box 15 of the form
28. When carrying out the reporting obligation, the grower shall indicate in this box the method of disposal to be carried out to dispose of poppy seed, plants of technical hemp or macadamia.
29. The reasons for disposal may be entered in box 13 of the form. These data are optional.
Placing of data in box 16 of the form
30. When fulfilling the reporting obligation, the grower shall enter in this box the date (s) of disposal.
Data entry in box 17 of the form
31. When fulfilling the reporting obligation, the grower shall enter in this box the area of the parcels from which poppy seed or plant of technical hemp has been harvested. The land shall be expressed in hectares to two decimal places and in each separate line in relation to the parcustoms numbers indicated in box 8 of the form and the registered variety indicated in box 7 of the form of the same line.
Data entry in box 18 of the form
32. When carrying out the reporting obligation, the grower shall enter in this box the quantity of macaroni or technical hemp harvested. The quantity of macadamia harvested shall be indicated in kilograms and the quantity of technical hemp harvested shall be indicated in kilograms to one decimal place in each separate row in relation to the parchment numbers indicated in box 8 of the form and the registered variety indicated in box 7 of the form of the same row.
Placing of data in box 19 of the form
33. When fulfilling the reporting obligation, the grower shall enter in this box the quantity of seed harvested of poppy seed or of technical hemp. The quantity of seed of poppy seed harvested or of technical hemp seed shall be given in whole kilograms.
Data entry in box 20 of the form
34. When carrying out the reporting obligation, the grower shall enter in the left-hand part of this box the sum of the entries indicated in box 18 of the form concerned - the quantity of macaroni harvested or the quantity of technical hemp harvested in kilograms to one decimal place, and in the right-hand part of this box the sum of the entries shown in box 19 of the form - the quantity of seed harvested of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the seed of the plant, in kilograms. This box shall be completed by the grower in cases where one form is not sufficient to fulfil the reporting obligation due to the quantity of data. In cases where one form is sufficient to fulfil the reporting obligation, the grower shall not complete the box and enter the required information in box 21 of the form.
35. When carrying out the reporting obligation under § 29 (c) or § 29b (c) of the Act, the breeder shall indicate separately in this box in relation to boxes 18 and 19 of the form.
Data entry in box 21 of the form
36. When fulfilling the reporting obligation, the grower shall indicate in the left-hand part of this box the total quantity of macaroni or technical hemp harvested in kilograms to one decimal place and in the right-hand part of this box the quantity of seed of poppy seed or hemp seed harvested in kilograms. In cases where a single form is sufficient to fulfil the reporting obligation, the grower shall indicate in the left-hand part of this box the sum of the entries shown in box 18 of the form in kilograms to one decimal place and the sum of the entries shown in box 19 of the form in full kilograms to the right-hand part of this box. In cases where one form is not sufficient to fulfil the reporting obligation, the grower shall enter in this box the sum of the particulars given in boxes 20 of each form on the form with the last serial number.
37. When carrying out the reporting obligation under § 29 (c) or § 29b (c) of the Act, the breeder shall indicate separately in this box in relation to boxes 18 and 19 of the form.
Data entry in box 22 of the form
38. In the case of a Member State, a Member State may decide not to apply this Regulation. (c) point (3) of the Act, details of the new transferee.
39. If the transferee is a legal person, the grower shall enter in this box a business firm under the Civil Code and a registered office under the current registration in the register of taxpayers, if not in the commercial register and if not in the register of economic operators. If the acquirer is a legal person having its registered office outside the Czech Republic, the breeder shall also indicate the full name of the country of the registered office of the legal person. The register number shall be provided if the grower is registered in such a register abroad.
40. Where the transferee is a natural person an entrepreneur, the grower shall enter in this box his business and the place of business according to the current registration in the register of tax payers, if such registration is not in the business register, if the natural person is entered in the business register, if such registration is not in the register under the Agriculture Act, if such registration is not in the business register, if such registration is not in the business register, then the date of birth. If the acquirer is a natural person, a businessman established outside the Czech Republic, the provisions of point 6 of this Annex shall apply mutatis mutandis.
41. If the transferee is a natural person, the grower shall enter in this box the name, or the name, surname, address of the place of permanent residence, indicating the street name, the descriptive number, the name of the municipality and the postal code. If the transferee is a natural person who does not have a place of residence in the Czech Republic, the breeder shall indicate the name, surname, place of residence and full name of the country of residence, including any other identification details, such as the passport number or other personal document, including its period of validity, and the address of the place where the person resides in the Czech Republic.
Data entry in box 23 of the form
42. In carrying out the reporting obligation, the grower shall indicate the identifying acquirer in the left part of this box. The breeder always marks only one figure.
43. If the acquirer is a legal person, the grower shall indicate in the upper right of this box to his ID, if assigned to him. If the grower does not have an ID, he shall indicate his IČO.
44. If the acquirer is a natural person, the breeder shall indicate in the upper right of this box the ID if the acquirer has been allocated. If the acquirer does not have an ID, he shall indicate his IČO. If the acquirer has no ID or IČO, that part of the box shall not be completed and shall indicate the date of birth in the lower right-hand part of this box.
45. If the transferee is a natural person, the breeder shall indicate the date of birth on the lower right of this box.
Data entry in box 24 of the form
46. Where the acquirer is an entrepreneur or a natural person, the acquirer shall not enter data in this box.
47. If the acquirer is a legal person, the acquirer shall enter in this box the name and, where applicable, the name and surname of the person authorised to act in the performance of the reporting obligation and the telephone, fax or e-mail address.
Data entry in box 25 of the form
48. Where the contact person is a natural person, the entrepreneur or natural person referred to in box 22, the acquirer shall enter in this box only a telephone and fax connection or e-mail address. If the contact person is a natural person other than that indicated in box 22 of this form, the acquirer shall also indicate the name and surname, if applicable.
49. If the contact person is the person mentioned in box 24 of this form, the transferee shall not enter the data in this box.
50. If the contact person is a natural person other than those mentioned in box 22 or 24 of this form, the transferee shall also indicate the name and surname, if applicable.
Data entry in box 26 of the form
51. The weight (tonnes) of macaquin sold or otherwise transferred to the new acquirer shall be entered in the box.
Data entry in box 27 of the form
52. The year in which the transferred mackerel was harvested shall be entered in the box.
Method of putting data in selected form boxes
53. If certain rows in boxes 5, 6, 7, 8, 9, 15, 16, 17, 18 and 19 remain unused when fulfilling the reporting obligation, the breeder shall cross out those free lines in the relevant box with a continuous line. Where the report is to be processed and transmitted in electronic form, the grower shall complete the free lines in the relevant boxes in accordance with the instructions laid down by the customs authorities for the use of software.

54. Local competent customs office according to the place of cultivation shall be notified in writing or in electronic form in accordance with Articles 29 (a) or 29 (b) and 29 (c) or 29b (c) of the Act.
55. The customs office which accepts the report from the person growing poppy seed or plant of technical hemp shall record the report in its register.
