on regional planning in the Czech Socialist Republic
The Government of the Czech Socialist Republic orders pursuant to § 31 paragraph 2 of Act No. 67 / 1989 Coll., on National Economic Planning, and for the implementation of Act No. 69 / 1967 Coll., on National Committees, as amended (full version No. 140 / 1988 Coll., as shown for the Czech Socialist Republic by subsequent legal amendments and supplements):

BASIC PROVISIONS
§ 1
Regional planning as part of the nation's economic planning1) ensures the planned management of the comprehensive economic and social development of territorial units and municipalities (hereinafter referred to as "the regions'), thereby contributing to the effective and proportionate development of the national economy.
§ 2
Regional planning shall focus in particular on the following objectives and tasks:
(a) achieving a rational regional structure of the national economy by effectively deploying production and non-production sectors;
(b) the elimination of interregional and intra-regional disparities in economic and social levels;
(c) the use of local conditions, in particular labour resources, natural and economic resources and territorial technical conditions of the areas;
(d) deepening the territorial division of labour, in particular by specialising in production and activities, rationalising cooperative relations, pooling resources and activities, and developing the basic functions of areas which result in particular from natural and economic conditions;
(e) environmental security;
(f) shaping the settlement structure by deploying housing, technical and civil amenities, economic and social activities and complex housing and land renewal;
(g) the creation of conditions for the regional balance of resources and labour needs and their effective use, in particular by regulating population migration and preparing for a career.
§ 3
(1) The objectives and tasks of regional planning in the Czech Socialist Republic are ensured:
(a) comprehensive State plans for the economic and social development of the Czech Socialist Republic (hereinafter referred to as the "State plans of the Czech Socialist Republic"), 2) which set out the main objectives of the development of the areas, 3)
(b) plans for the economic and social development of territorial units and municipalities (hereinafter referred to as "regional plans"), 4) which are an essential tool for managing the comprehensive economic and social development of the territorial districts of the national committees;
(c) other instruments to ensure comprehensive economic and social development of areas (Section 4).
(2) When ensuring the objectives and tasks of regional planning
(a) takes into account the approved planning document5) and is based on binding parts of the territorial planning documentation solution, 6)
(b) make use of land-use planning documents, in particular in the material and temporal coordination of activities in the field, in the planning of housing, civil and technical equipment, transport and the creation and protection of the environment.
§ 4
In order to ensure the objectives and tasks of regional planning, instruments established by specific regulations shall be used, in particular:
(a) instruments under the authority of central authorities:
1. binding outputs of state plans of the Czech Socialist Republic, 7)
2. taxes and levies,
(b) instruments within the competence of national committees:
1. pooling of funds and activities;
2. binding opinions on proposals for the deployment of selected investments;
3. instruments which use territorial planning in territorial and building management;
4. a statement on the establishment or establishment, development and demise of socialist organisations and on major changes in the subject of their activities and the issue of consent to the location of socialist organisations or parts thereof;
5. measures to guide employment trends;
6. taxes and charges, in particular for the use of areas and equipment of the territory,
7. the creation of state enterprises and the establishment of other socialist organisations and facilities;
8. sanctions for environmental pollution.

REGIONAL PLANS
§ 5
System of regional plans
(1) The regional plans follow the state plans of the Czech Socialist Republic; in their creation and implementation, it is based on the principle of compliance with the state plans of the Czech Socialist Republic, provided in particular by the continuous exchange of information and by the unification of the opinions of participants in the planning process.
(2) Regional plans are subdivided into:
(a) long-term concepts of the development of areas which are generally developed for a period of 15 years and generally in five-year cycles are specified and extended;
(b) five-year regional plans.
Content of regional plans
§ 6
The regional plans provide for comprehensive economic and social development of areas, the creation and protection of the environment and the use of local conditions for the effective development of the national economy.
§ 7
The long-term development concepts of areas include the basic guidelines for comprehensive economic and social development and the basic guidelines for the creation and protection of the environment, including the rational use of natural resources.
§ 8
The five-year regional plans shall contain:
(a) the objectives and objectives of the comprehensive economic and social development of the areas;
(b) binding outputs of the five-year state plan of the Czech Socialist Republic, in particular the scope and use of subsidies, limits and nominal tasks of the state plan of the Czech Socialist Republic applied in the relevant areas, the way in which they are secured and the way in which taxes and levies are used to address regional proportionality;
(c) the definition of the share of the provision of comprehensive economic and social development of the territorial area of the National Committee of Organisations in its territorial district, which has not been established, managed or managed by the National Committee, as well as the conditions for the development of such organisations, in particular from the geographical technical and environmental aspects;
(d) informative outputs, in particular on development and attenuation projects in the area, local territorial resources, territorial technical conditions, principles for the localisation of buildings and activities, and information on the principles for the protection of natural resources and the creation and protection of the environment.
Documentation for regional plans
§ 9
In particular, the underlying documents for the establishment of regional plans and programmes for the development of areas8) are:
(a) forecasts and studies of the development of areas, including analyses assessing the degree of economic and social level of each area and analyses of the development of production and non-production sectors in the areas;
(b) long-term sectoral development concepts and other development documents of cross-cutting and sectoral central authorities;
(c) long-term concepts of the development of socialist organisations or, where appropriate, their internal organisational units located in the relevant area and selected data on the five-year economic and social development plans of such organisations and, where appropriate, their internal organisational units;
(d) approved planning documentation and planning documents;
(e) analyses of the current and proposed levels of use of natural and economic resources and the conditions of each area and limits on their further development;
(f) analysis of the state and concept of the creation and protection of the environment;
(g) regional balance sheets, in particular the population balance, the resources of the labour force, the distribution of the youth, housing and amenities, water, raw materials and energy resources;
(h) data on the structure, distribution and use of building capacities in the areas;
(i) measures and decisions on the deployment of housing, civil and technical equipment, standards of civil amenities;
(j) documents defining the share of socialist organisations in ensuring the comprehensive economic and social development of the territorial districts of national committees;
k) the budgetary perspective of the Czech Socialist Republic and the budgetary outlooks of the national higher-level committees and other documents on the financial resources of the development of the areas.
§ 10
(1) Five-year regional plans are based on long-term development concepts.
(2) A binding document for the preparation of five-year regional plans is a directive of the Government of the Czech Socialist Republic for the preparation of a five-year state plan of the Czech Socialist Republic, plans of socialist organisations and regional plans (hereinafter referred to as the "Directive").
(3) Five-year regional plans shall be drawn up in accordance with:
(a) with binding outputs of the directive, the form of which is also necessary to specify by a central authority or national committee on the basis of the authorisation given by the Government of the Czech Socialist Republic, 9)
b) with the budgetary perspective of the Czech Socialist Republic and the budgetary perspective of the national committee of higher degrees.
§ 11
Modifications and changes to regional plans
(1) On the basis of the five-year state plans of the Czech Socialist Republic, the national committees will adapt their five-year regional plans if the binding outputs of the five-year state plans of the Czech Socialist Republic differ from the binding outputs of the directive; In doing so, national committees are obliged to respect and ensure binding outputs of five-year state plans of the Czech Socialist Republic. 10)
(2) National Committees are making changes to their five-year regional plans in cases where there are changes in the binding outputs of the five-year state plans of the Czech Socialist Republic resulting from the direction of economic development affecting the complex economic and social development of their territorial districts, or where there are serious deviations from the objectives and intentions of the regional plans based on the development of knowledge or changed socio-economic situation.
§ 12
Regional planning units
(1) The regional plans are drawn up by the national committees of all grades for their territorial districts.
(2) On the basis of the agreement of the relevant national committees, the regional plan may be drawn up in a global manner for several territorial districts of neighbouring national committees.
(3) The Government of the Czech Socialist Republic may determine that the regional plan will also be drawn up for other functionally defined areas.

TASKS OF THE INSTITUTIONS AND ORGANISATIONS IN THE AREA OF PLANNING
§ 13
Government of the Czech Socialist Republic
Government of the Czech Socialist Republic
(a) endorses the draft State plans of the Czech Socialist Republic, including the proposals for the main objectives of the development of areas and the way in which they are secured, as well as the use of economic instruments to address regional proportionality;
(b) submit proposals to the Government of the Czechoslovak Socialist Republic on the use of economic instruments to address regional proportionality and on the proposed nominal tasks for organisations established or set up by federal central authorities.
§ 14
Czech Commission for Planning and Scientific and Technological Development
The Czech Commission for Planning and Scientific and Technological Development is responsible for ensuring comprehensive economic and social development of areas, including the creation and protection of the environment, in terms of planning process. To this end, in particular:
a) processes analyses of the socio-economic development and achievement of the Czech Socialist Republic;
b) Presents to the Government of the Czech Socialist Republic
1. the draft state plans of the Czech Socialist Republic, including the proposals for the main objectives of the development of areas and the way in which they are secured;
2. in cooperation with cross-cutting and sectoral central authorities, proposals for the use of economic instruments to address regional proportionality and proposals for nominal tasks approved by the Government of the Czech Socialist Republic or submitted for approval by the Government of the Czechoslovak Socialist Republic;
(c) organise and coordinate the activities of central authorities and national committees in the area of regional planning;
(d) cooperate
1. with the Ministry of Construction and Construction of the Czech Socialist Republic in the creation and assessment of land planning documentation submitted for approval by the Government of the Czech Socialist Republic and for the development of an integrated information system on areas for regional planning,
2. with the Czech Statistical Office in creating socio-economic information for regional planning.
§ 15
Cross-cutting central authorities
Cross-cutting central authorities 11) in particular
(a) they are based on the proposals for the relevant parts of the national plans, the five-year budgetary outlooks and the national budgets, and in order to guide the economic development from the objectives and tasks of regional planning and propose measures to safeguard them;
b) discuss with the Czech Commission for Planning and Scientific and Technological Development, the Regional National Committees and the National Committee of the City of Prague (hereinafter the "Regional National Committees") proposals affecting the effective and balanced development of the areas.
§ 16
Sectoral central authorities
Sectoral central authorities 12) in particular
(a) develop concepts for the development of complexes, sectors and disciplines, including from regional aspects, and discuss their proposals with the Czech Commission for Planning and Scientific and Technological Development and the Regional National Committees;
(b) cooperate with the Regional National Committees to ensure the objectives and tasks of regional planning.
National Committees
§ 17
National committees of all stages shall ensure the objectives and tasks of regional planning.
§ 18
Regional National Committees in particular
(a) draw up:
1. the long-term concept of regional development and they are presented to the Czech Commission for Planning and Scientific and Technological Development as a basis for the development of the Basic Guidelines for Economic and Social Development of the Czech Socialist Republic,
2. five-year regional plans and provide the Czech Commission for Planning and Scientific and Technological Development with selected data of these plans,
(b) cooperate:
1. with the Czech Commission for Planning and Scientific and Technological Development in the drafting of documents of the long-term prospects of the Czech Socialist Republic and of the five-year state plans of the Czech Socialist Republic and of proposals of economic instruments to address regional proportionality,
2. with the relevant regional national committees and national committees of the cities of Brno, Ostrava, Plzeň and Ústí nad Labem (hereinafter referred to as the "district national committee") in order to ensure the objectives and tasks of regional planning.
§ 19
Regional National Committees in particular
(a) develop long-term regional development concepts and five-year district plans;
(b) cooperate with relevant regional national committees and local national committees to ensure the objectives and tasks of regional planning.
§ 20
In particular, local national committees
(a) develop long-term urban and municipal development concepts and five-year urban and municipal regional plans;
(b) cooperate with the relevant regional national committees to ensure the objectives and tasks of regional planning.
§ 21
Socialist organisations
Socialist organisations
(a) cooperate with the national committees and participate in ensuring the comprehensive economic and social development of the territorial districts of the national committees;
(b) are obliged:
1. Discuss and respect the long-term concepts of their development with national committees in whose territorial districts they have their headquarters and national committees in whose territorial districts they have their internal organisational units; Socialist organisations have the same obligation to the national committees in whose territorial districts they intend to build their internal organisational units,
2. to provide the national committees with the information and data necessary for drawing up and monitoring the implementation of regional plans, 13), which characterise in particular their
- projects affecting the development of the territorial districts of the national committees, the state of the environment and the natural environment and the satisfaction of citizens' needs and interests,
- share in ensuring the comprehensive economic and social development of the territorial districts of the national committees,
- the requirements for regional resources, in particular for labour and youth, land and forestry stocks, including protected areas and protection zones of all kinds, the need for the use of natural, aquatic and energy resources.

COMMON AND FINAL PROVISIONS
§ 22
National committees shall draw up regional plans in cooperation with the National Front authorities and the organisations associated therein.
§ 23
This Regulation shall not apply to tasks included in specific parts of State plans.
§ 24
The Decree of the Government of the Czech Socialist Republic No. 36 / 1977 Coll., on Regional Planning in the Czech Socialist Republic, as amended by the Decree of the Government of the Czech Socialist Republic No. 138 / 1983 Coll.
§ 25
This Regulation shall enter into force on 1 January 1990.
