THE LAW
of 18 December 1969
on offences
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
General provisions
An offence
(1) In fact, it is guilty of a dangerous crime for a society whose features are listed in this law and which does not reach the level of social danger of a crime.
(2) An act whose degree of danger to society is negligible is not an offence, even if it otherwise shows its characteristics.
Specific provisions
For an offence against the interests of the socialist economy, he will be punished by deprivation of liberty for up to one year or by corrective action or prohibition of action or by a financial penalty of up to 10 000 CZK or forfeiture of a case
(a) harm consumers, in particular, by overcharging goods or services or by framing them on the quality, quantity or weight of goods or by concealing or binding on the consumer their sale for other goods;
(b) as a worker of a socialist organisation in connection with the sale of goods or the provision of services, favours consumers from whom it accepts or promises a bribe or any other unjustified advantage;
(c) conduct to a lesser extent an unjustified private production or other gainful activity to obtain a more permanent source of income;
(d) procure or accumulate articles of need intended to sell them with profit or obtain any other unjustified benefit;
(e) groupings without the need for a greater quantity of goods which are deficient on the market;
(f) by acting against the rules on the foreign exchange economy, the asset gain will be not negligible or will cause damage to the foreign exchange economy not negligible;
(g) it is intended to be unduly enriched or can be promised for the transfer of an apartment, for the transfer or sale of a real estate or other object of a higher value of the excess price or any other unjustified advantage.
(1) For an offence against property in socialist and personal property, he will be punished by deprivation of liberty for up to one year or by a corrective measure or prohibition of action or by a penalty of up to 10 000 CZK or forfeiture of the case,
who causes damage to foreign property not exceeding 1 500 CZK in particular by:
(a) take the matter by taking it;
(b) to take possession of the thing which has been entrusted to him,
(c) be enriched to the detriment of such property by misleading or making use of someone's error;
(d) destroy, damage or do an unfit foreign matter.
(2) For an offence against property in socialist property, he will be punished by deprivation of liberty for up to three months or by a corrective measure or by a financial penalty of up to 2 000 CZK,
who, out of negligence, testifying to an irresponsible attitude towards socialist property will cause damage to such property not exceeding 5 000 Kcs.
For the misdemeanor of poaching, he will be punished by deprivation of liberty for up to one year or by a corrective measure or by a prohibition of activity or by a penalty of up to 10 000 CZK or by forfeiture of the case,
who has tampered with the right of hunting or the exercise of fishing law, or who has been hunting animals or fish at the time of the defence, unless the amount of damage caused is a criminal offence.
For an offence against the interests of a socialist society in the field of foreign relations, he will be punished by deprivation of liberty for up to six months or by a corrective measure or by a financial penalty of up to 5 000 CZK or by forfeiture of a case
(a) infringes the prohibition or restriction on the import, export or transit of goods or does not declare goods for customs inspection or treat goods subject to customs legislation in an illegal manner and thereby obtain a benefit of property not negligible;
(b) it shall import or extend foreign newspapers in greater quantities, film or phonographic records the importation of which is prohibited;
(c) to a foreign country, the printing, film, phonographic record or any other matter likely to endanger or harm the good name or interest of the Republic abroad;
(d) in a more serious manner, infringes the rules on travel documents or conditions of residence abroad, in particular by drawing out a travel document or exit clause on the basis of false or incomplete data or failing to respect, without serious reasons, the time or territorial validity of the travel document or exit clause;
(e) improperly exported to a foreign country personal or other documents the export of which is prohibited or the export of which requires authorisation.
For an offence against public policy, he shall be punished by deprivation of liberty for up to three months or by a penalty of up to 5 000 CZK or, in the cases referred to in subparagraph (b), by forfeiture of the case:
(a) participate in or encourage or disobey a public policy action which distorts or threatens to promote public policy;
(b) without authorisation, produce or affix a firearm to itself or any other firearm or hold it.
In order to prevent the execution of an official decision, he shall be punished by deprivation of liberty for up to six months or by a remedy or by a financial penalty of up to 5 000 CZK,
who thwarts or makes it difficult to enforce a judgment of a court or other state body by:
(a) without authorisation and without serious reason, stay at the place or district which is subject to the sentence of the prohibition imposed on him by the court or fails to respect the restrictions imposed on him by the court in connection with the execution of that sentence;
(b) carry out an activity prohibited by it; or
(c) refuses to submit to the protection supervision, protection treatment or protection education imposed on him by the court or otherwise, in particular by escaping the Institute, makes it substantially difficult to enforce such decisions; or
(d) he intends to avoid carrying out work in the performance of a custodial sentence, to pretend to be sick, to arbitrarily refuse to eat, to be damaged to health or to be permanently damaged, and to refuse to perform the assigned work without any serious reason.
For an offence against labour discipline, he will be punished by deprivation of liberty for up to three months or by a remedy or by a financial penalty of up to 5 000 CZK or by a ban on activity who:
(a) refuse to fulfil the obligations arising out of his or her status as a member of the service or title of employment in an attempt to undermine public policy or to promote actions detrimental to the interests of a socialist society or, in the same intention, encourage such failure to fulfil obligations;
(b) by violating the rules on safety and health at work, it endangers someone or causes someone to suffer injury resulting in shorter work incapacity;
(c) compromise the smooth operation or economic activity of a socialist organisation or cause damage by systematically omitting work shifts without serious reason or pretending to be incapacitated, or consistently or seriously violating technological discipline or otherwise violating important obligations from work or other similar relationship;
(d) the intention to procure an unjustified benefit to himself or to another person or organisation violates or circumvents the provisions concerning the creation or termination of a work or other similar relationship or the remuneration of the work or, in the same intention, mediates or organises the hire of labour.
(1) For an offence against socialist coexistence, he will be punished by deprivation of liberty for up to six months or by a remedy or by a financial penalty of up to 5 000 CZK or by a ban on activities who:
(a) improper behaviour, in particular threats, offensive statements or actions, defamation, brawling, sanctioning or other gross conduct, shall interfere with the socialist coexistence of citizens or affect their dignity and honour; or
(b) consume an alcoholic beverage, although it knows that it will carry out a job or other activity in which it could endanger the health of its fellow citizens or the safety of property, or provide an alcoholic drink to someone in such circumstances;
although, in the last year, for an act of a similar nature, he has been sentenced or released for such an offence in the last three years for one of the offences of a similar nature.
(2) For an offence against socialist coexistence, he will be punished by deprivation of liberty for up to three months or by a remedy or by a financial penalty of up to 2 000 CZK or by a ban on activities which allow minors to enjoy alcoholic beverages and thereby threaten their physical or moral development.
(3) For an offence against socialist coexistence, he will be punished by deprivation of liberty for up to three months or by a corrective measure or prohibition of activity or by a financial penalty of up to 5000 Cds, who
(a) falsifies or alter the contents of a medical prescription intended to be used as a genuine prescription or who uses such a prescription as a genuine prescription; or
(b) provide another prescription form intended to be used for falsification, or who, in the same intention, obtains such a form of surrender or otherwise improperly.
He will be punished for the offence of freelessness by deprivation of liberty for up to one year, or by a financial penalty of up to 5 000 CZK, or by the forfeiture of a cause that provides, even in part, the means to live in an unfair way.
For an act of participation, he will be punished by deprivation of liberty for up to six months or by a corrective measure or by a financial penalty of up to 5 000 CZK or by a forfeit of a cause that transfers a matter of value not negligible, which has been obtained by an act under § 2 to 5 or § 10, or by what has been given for such a thing.
(1) For an offence of maintenance, he shall be punished by deprivation of liberty for up to six months or by corrective action to assist the perpetrator of the offence in the intention of allowing him to escape prosecution, punishment or protection or the execution of the offence; But if he helps the perpetrator of an offence to which the law provides for a lighter punishment, he will be punished with a lighter punishment.
(2) A person who commits an act referred to in paragraph 1 for the benefit of a person close to him (§ 89 (8) (3)) shall not be punishable unless he intends to provide himself or any other property benefit.
Common provisions
(1) In the case of the offences referred to in this Act, the provisions of the general part of the criminal law apply mutatis mutandis, with the following derogations:
(a) Paragraph 7 on preparation for an offence shall not apply;
(b) the limitation period for the offence shall be one year.
(2) Paragraph 294 (2) of the Criminal Act applies mutatis mutandis to the offences referred to in this law.
(3) The enforcement of criminal penalties and protective measures imposed in criminal proceedings shall be carried out in accordance with the rules on penalties and protective measures imposed in criminal proceedings.
The offences under this law may also be dealt with in court together with the criminal offence of the same defendant.
Transitional and final provisions
Proceedings pursuant to Act No. 38 / 1961 Coll., on the Local People's Courts, as well as wrongful acts pursuant to § 33 to 41 of Act No. 60 / 1961 Coll., on the tasks of the National Committees in securing socialist order, committed before the Act is effective, shall be dealt with by the National Committees in accordance with the existing regulations.
(1) In Paragraph 6 (1) of Act No. 60 / 1961 Coll., on the tasks of national committees in ensuring socialist order, the word 'guilty' is replaced by the word 'offence'.
(2) They are repealed.
(a) Act No. 38 / 1961 Coll., on Local People's Courts,
(b) Sections 5 and 33 to 41 of Act No. 60 / 1961 Coll., on the tasks of national committees in ensuring socialist order,
(c) Act No. 58 / 1965 Coll., which regulates the punishment of the offenses and misdemeanors of persons committing disorderly conduct, violence and corruption.
This Act shall take effect on 1 January 1970.
