GOVERNMENT REGULATION
of 8 January 2003
amending Government Regulation No. 114 / 2001 Coll., establishing production quotas for sugar for the quota years 2001 / 2002 to 2004 / 2005, as amended by Government Regulation No. 296 / 2002 Coll. and the Constitutional Court found under No. 499 / 2002 Coll.
The Government orders pursuant to § 12 (3) to (5) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund):
Government Regulation No. 114 / 2001 Coll., on the establishment of production quotas for sugar for the quota years 2001 / 2002 to 2004 / 2005, as amended by Government Decree No. 296 / 2002 Coll. and the Constitutional Court found under No. 499 / 2002 Coll., is amended as follows:
(1) Paragraph 13, including the title and footnotes 6) and 7) shall read as follows:
Minimum prices
(1) The minimum price6) diabetes is set at CZK 980 per tonne net weight of diabetes at a sugar content of 16%. The minimum price for sugar beet shall apply to sugar which meets the quality characteristics set out in Annex 5 to this Regulation. The minimum price for sugar beet does not include the costs associated with the transport of sugar beet.
(2) The minimum price6) of sugar marketed in the Czech Republic is set at CZK 17300 per tonne of sugar. The minimum price for sugar shall apply to bulk sugar. The price of sugar, which differs from sugar with a minimum price only by certain specified conditions, (7) shall be agreed at least by a difference in the economic eligible costs corresponding to those different specified conditions and by a difference corresponding to a reasonable profit. The minimum price for sugar shall not apply to sugar from imports. The minimum price for sugar shall not include the costs associated with the transport of sugar.
(3) The minimum price for sugar beet referred to in paragraph 1 shall apply only to the quantity of sugar needed to produce the quantity of sugar corresponding to the domestic share of the quota and the export share of the sugar producer's quota.

2. The following Annex 5 is added:
"Annex No 5 to Government Decree No. 114 / 2001 Coll.
Quality characteristics of diabetes related to the minimum price of diabetes
The minimum price for sugar beet shall apply to sugar which meets the following quality characteristics:
| 1. Cukernatost nejméně | 15 %. |
| 2. Obsah minerálních nečistot nejvýše | 15 % |
| 3. Obsah rostlinných příměsí nejvýše | 1 %.“. |
This Regulation shall enter into force on the day of its publication.
