THE LAW
of 23 January 1990
on political parties
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
Purpose of the law
(1) Citizens have the right to join in a democratic spirit in political parties. The exercise of this right serves citizens to participate in the political life of society, in particular the creation of representative bodies of the state.
(2) The purpose of this Act is to regulate the formation and demise of political parties.
Conditions for the formation of a political party
(1) The establishment of a political party is subject to registration in the register of political parties (hereinafter referred to as "the register") maintained by the Ministry of Interior of the Czech Socialist Republic and the Ministry of Interior and Environment of the Slovak Socialist Republic (hereinafter referred to as "the Ministry"). The political party shall be registered in one or both Republics.
(2) The notification for registration is submitted by the Preparatory Committee of a political party (hereinafter referred to as the "Preparatory Committee") whose members must be Czechoslovak state citizens over 18 years of age. The notification shall be signed by all members of the Preparatory Committee and shall indicate their names and surnames, birth numbers and residence. They shall also indicate who is the agent authorised to act on their behalf. The Preparatory Committee shall be attached to the notification:
(a) a petition of at least one thousand citizens demanding that a political party be formed. To sign the petition, the citizen must state his name and surname, birth number and residence;
(b) the statutes of the political party (s) in which they must indicate:
1. the name of a political party which must differ from that of a legal person already operating in the territory of the Czechoslovak Socialist Republic;
2. seat;
3. programme objectives which must not be contrary to the Constitution and the laws;
4. the institutions, the way in which they are established and the authorities and officials authorised to act on behalf of a political party;
5. Provisions on organisational units, provided that they are established and are to act on their behalf.
(1) If the notification for the registration of particulars referred to in Article 2 (2) is given, the Ministry shall enter the political party in the register no later than three days after the date on which the notification was received and shall issue a certificate to the Preparatory Committee.
(2) If the notification for registration does not contain the particulars referred to in Article 2 (2), or if the particulars are incomplete or inaccurate, the Ministry shall draw the attention of the Preparatory Committee within three days of receipt of the notification that, until such defects have been remedied, registration may not be carried out.
A political party shall be established as a legal person on the day of registration. Political activity may take place in the territory of the Republic of which the Ministry is registered.
The political party shall notify the Ministry of Change of its Statutes (Organisation Regulations) within 15 days.
Termination of the political party
If a political party decides on its voluntary dissolution, division or merger with another organisation, it shall notify the Ministry which shall remove it from the political party records no later than three days after the date of notification. The day of removal from the record is the day when the political party ceases to exist.
Management of political parties
Rules on the management of social organisations apply to the management of political parties. 1)
Political movements
Political movements (groupings) as legal entities may arise for electoral and other political purposes. They may include political parties and social organisations as well as citizens. The provisions of this Act apply accordingly.
Final provisions
(1) The Czechoslovak People's Party, the Czechoslovak Socialist Party, the Democratic Party, the Communist Party of Czechoslovakia and the Freedom Party are considered to be political parties already formed. The Civil Forum and the Public Against Violence are political movements under this law.
(2) The political parties and political movements referred to in paragraph 1 are legal persons.
This Act shall take effect on the day of its publication.
