on measures relating to certain matters used by socialist sector organisations
The Government of the Republic of Czechoslovakia, with the agreement of the President of the Republic pursuant to § 10 paragraphs 1 and 2 of Act No. 63 / 1958 Coll., on the second five-year plan for the development of the national economy of the Republic of Czechoslovakia:
In order to further consolidate socialist production relations and to extend the material base of the socialist sector, this Regulation limits the rights to dispose of certain things that are used by socialist sector organisations and facilitates the acquisition of these things into socialist ownership.
(1) This Regulation shall apply to cases which are owned by natural persons or private legal persons and which are wholly or principally used by socialist sector organisations (hereinafter referred to as "tenants') to carry out their duties, on the basis of rental or other legal relationship arising before the entry into force of this Regulation.
(2) This Regulation shall not apply to goods used on the basis of the legal ratios established pursuant to Government Regulation No 50 / 1955 Coll., on certain measures to ensure agricultural production, and to goods used by single agricultural cooperatives on the basis of legal ratios established under the rules governing relations between those cooperatives and their members.
(1) Save as otherwise provided in this Regulation or in the implementing provisions, persons other than the lessee may treat the items referred to in Paragraph 2 (1) (hereinafter referred to as "the hired items') only with the agreement of the Executive Authority of the District National Committee in whose territory the case is (hereinafter referred to as" the competent authority ').
(2) Legal acts contrary to the provisions of paragraph 1 are invalid.
(1) The lessee may purchase the hired item if it is strictly needed for the performance of its tasks. Only movable goods of a price not exceeding 10 000 CZK and immovable goods of a price not exceeding 50 000 CZK may be bought.
(2) The consent of the competent authority is required for the validity of the purchase contract.
(3) If there is no purchase, the lessee shall, at the request of the lessee, decide on the transition of the hired item to socialist property and on the reimbursement of the contract, by the competent authority.
(4) The provisions of paragraphs 1 and 2, with the exception that the acquisition by the cooperative of the acquisition by the cooperative is deemed to be a consideration of the acquisition by the cooperative on the basis of the decision of its institution, shall apply to the case of a case hired by a member of a folk production cooperative.
The competent authority shall, at the request of the lessee, decide on the transfer of the items hired to the socialist property if their price exceeds the amounts referred to in Paragraph 4 (1) and if the lessee is required to carry out his tasks; the refund shall be decided separately.
The case is transferred to socialist property on the date on which the decision of the competent authority (Sections 4 (2) and (3) and 5) becomes final.
The Ministry of Finance shall, in agreement with the other central authorities involved and the authorities concerned, issue the provisions necessary for the implementation of this Regulation, in particular on management, valuation, prices and compensation for the items taken over.
This Regulation shall apply from 25 March 1959. All members of the government will do it.
